Constitution of the College Democrats at the University of Houston

Preamble

We, the College Democrats at the University of Houston, in order to educate the students, faculty, and staff of the University of Houston about democratic government, foster and promote the ideals of the Democratic Party and to provide community service to the University of Houston and its surrounding community do ordain and establish this Constitution.
 

Article I
Name and Membership

Section 1. This organization shall be known as the College Democrats at the University of Houston.

Section 2. Currently enrolled students, staff or faculty at the University of Houston (Main Campus) in good standing are eligible for membership.

Section 3. Persons not covered by Section 2 of this Article may be granted honorary membership by a majority vote of the membership present. Honorary members are non-voting members.

Section 4. Persons covered by Section 2 of this Article may apply for membership by filling out a membership form and submitting it to the Vice-President. The completed form shall be submitted to the Membership Committee for consideration. The Committee shall make a recommendation to the general membership before the next scheduled meeting. At that meeting, the membership shall vote on accepting or denying membership. A majority vote is needed to grant membership.

Section 5. A person who is granted membership shall become a member at the next general meeting following the payment of their dues.

Section 6. A member may be removed from membership only for due cause using the procedures stated in Robert's Rules of Order Newly Revised for removal of members.

Section 7. A member is automatically removed from membership if they fail to pay their dues by the 12th class day of the semester.

Section 8. Dues shall be five dollars ($5.00) per semester.

Section 9. Dues paid for the spring semester shall also cover the summer semester period. Dues paid during the summer semesters shall cover the fall semester. Required dues shall not exceed ten dollars ($10.00) for an academic year.
 

Article II
Officers and Duties

Section 1. There shall be four executive officers: a President, a Vice-President, a Secretary, and a Treasurer.

Section 2. The President may assign any duties not assigned to a specific officer to any member of the organization subject to a majority vote of the members attending the next general meeting.

Section 3. The President shall preside over the meetings of the membership, oversee all operations of the organization, provide direction, maintain relations with the UC Reservations office, and represent the organization with outside interests.

Section 4. The Vice-President shall preside over the meetings in the absence of the president, chair the Membership Committee, oversee all membership drives, maintain the organizations' carrel/office, and oversee all day-to-day operations.

Section 5. The Secretary shall take minutes of all meetings of the membership, keep records of all activities, and maintain relations with the Department of Campus Activities and the Daily Cougar.

Section 6. The Treasurer shall maintain all financial records of the organization, prepare and present a budget to the membership, chair the Finance Committee, and oversee fundraisers.
 

Article III
Meetings

Section 1. The organization shall meet no less than bi-monthly.

Section 2. A quorum shall be defined as three (3) executive officers and five (5) regular members.

Section 3. If an executive officer shall be outside the State of Texas for a period in excess of one month, their duties shall be transmitted to the three (3) remaining officers until his/her return. During this period, the number of executive officers contributing to a quorum shall be two (2).

Section 4. No official business of the organization shall be transacted unless a quorum is present.

Section 5. There shall be an open floor period during all regular meetings.

Section 6. On all votes taken of the membership, all abstentions shall count neither in the affirmative or the negative.

Section 7. Voting by proxy is only allowed in writing and only on previously announced issues. Members voting by proxy shall not be counted toward a quorum.
 

Article IV
Election of Officers

Section 1. The term of office shall be from the last regular meeting of the spring semester of the year until the last regular meeting of the spring semester of the following year.
 
Section 2. The period for filing to be a candidate for office shall last two (2) weeks beginning at the first regular meeting following the University's spring recess.
 
Section 3. Any voting member at the time of filing may be a candidate for office. The candidate must file in writing with the secretary stating their name and the office for which they wish to run.
 
Section 4. The election of officers shall take place at the first regular meeting following the close of the filing period. There shall be a minimum of five days between the end of the filing period and the general election.
 
Section 5. The Secretary shall announce the election schedule to all members prior to the start of the election process.
 
Section 6. The Secretary shall prepare a written ballot to be used during the election. The ballot shall allow for write-in candidates for all offices.
 
Section 7. At the Secretary's discretion, he/she may provide for absentee voting by electronic mail provided that the anonymity of the votes is preserved.
 
Section 8. No person shall serve in any one office for more than four (4) long (fall/spring) semesters. In case of vacancies in office, the remainder of the semester shall not be counted toward the new officer's four (4) long semesters as specified in this section.
 
Section 9. The inauguration of officers shall occur during the last regular meeting of the spring semester.
 
Section 10. The oath of office shall be as follows: I, (state name), do solemnly swear (or affirm) that I shall faithfully execute the duties of the office for which I have been elected, and I shall defend the constitution and the interests of all members of the College Democrats and the University of Houston.
 

Article V
Vacancies

Section 1. An office shall become vacant after the resignation of an officer, the impeachment of an officer, the failure of an officer to pay their dues pursuant to Article I or their disenrollment from the University of Houston (Main Campus).
 
Section 2. If there is a vacancy in an office other than that of President, the President shall appoint a replacement within ten days, subject to a two-thirds (2/3) vote of the membership at the next regular meeting.
 
Section 3. If the office of President becomes vacant, the Vice-President shall succeed the Presidency. The new President shall fill the office of Vice-President pursuant to Section 2 of this article.
 
Section 4. If a vacancy of office occurs during the fall semester, a special election shall be held at the end of the semester following the process outlined in Article IV of this Constitution.
 

Article VI
Impeachment Code

Section 1. Any officer may be impeached using the procedures of this article.
 
Section 2. To initiate impeachment proceedings, a petition must be signed one-third (1/3) of the voting members of the organization. The petition must include the officer being charged, the exact charges being brought, and the legal signature of all of the accusers listed on the petition. The petition must be filed with the Secretary, or if the Secretary is the accused, the President.
 
Section 3. The officer shall immediately be notified of the charges and shall have a period of two weeks to rectify the situation and explain his/herself without being tried. If the membership deems necessary, after the two weeks, an impeachment trial shall commence.
 
Section 4. At the next regular meeting, the accused and the accuser shall present evidence and witnesses to plead their cases. The President shall preside over the meeting, or, if s/he accused, the Vice-President shall preside.
 
Section 5. Following the cases of the accuser and the accused, a two-thirds (2/3) vote of the membership present voting by anonymous written ballot shall be required to convict and the office shall become vacant.
 

Article VII
Standing Committees

Section 1. There shall be four standing committees: the Membership Committee, the Finance Committee, the Policies Committee, and the Programming Committee.
 
Section 2. Committee members, Committee Vice-Chairs, and Committee chairs not provided for in Article II shall be appointed by the President and confirmed by a majority vote of the membership.
 
Section 3. The Membership Committee shall consider all requests for membership in the organization, make recommendations on such requests, plan and coordinate all membership drives, and coordinate communication with members.
 
Section 4. The Finance Committee shall coordinate all financial actions of the organization, prepare an annual budget with the Treasurer, plan and coordinate fundraisers, and consider organization expenditures.
 
Section 5. The Policies Committee shall consider and recommend all proposed revisions to the Constitution, consider all recommendations for political endorsements by the organization, and assist the President in providing direction.
 
Section 6. The Programming Committee shall consider and recommend all programs of the organization, discuss and invite guest speakers, coordinate all social aspects of the organization, and plan all trips made by the organization.
 
Section 7. Committees shall meet no less than once per month.
 
Section 8. A quorum for a committee shall be two members and either the Chair or Vice-Chair. One member shall keep minutes at each meeting and report the minutes at the next general meeting.
 
Section 9. Upon the recommendation of the President, and a majority vote of the membership, the duties of a committee can be transmitted to the membership during a general meeting.
 

Article VIII
Parliamentary Authority

The Parliamentary Authority of the organization shall be Roberts' Rules of Order Newly Revised.
 

Article IX
Affiliations

Section 1. The College Democrats at the University of Houston is a member organization of the College Democrats of Texas and the Texas Young Democrats.
 
Section 2. Although the organization is affiliated with said groups, the College Democrats at the University of Houston is an independent organization.
 

Article X
Amendments

Section 1. All proposed changes to this Constitution shall be reviewed by the Policies Committee, or the general membership pursuant to Article VII, section 9 of this document.
 
Section 2. The Policies Committee shall make a recommendation on proposed amendments at the next regular meeting. A two-thirds (2/3) vote of the membership present shall be required for the amendment to pass.
 

Article XI
Ratification

This document shall become valid upon its adoption by a unanimous vote of the members present during the general meeting of March 7. 1997.
