Legal Descriptions of the Parcel(s) concerned This parcel of land is also listed (on other documents) with the State of Hawaii office of the Bureau of Conveyances precisely as situated at Kualapa and Kanahena, District of Makawao, Island and County of Maui, State of Hawaii and Grant 1295 to Kuewa (k) Honuaula, Ulupalakua, Maui TMK: 2-1-4-105 (Sec. D Owner who is selling) The property as described by a Kehei resident and Land Surveyor, Randell Sherman - Ph# (808) 874-8848) is as follows: Being all of Grant 1295 to Kuewa Situated approximately 1,500 feet southerly of Kanio-Kalama Park Road and approximately 11,500 feet Northerly of Makena-Keonioio Government Road At Kualapa, Honuaula, Maui, Hawaii Tax Map Key: 2-1-04:105 Detailed Property Description The parcel TMK: 2-1-4-105 Section D belongs to Owner that is selling (as per provided in the property map) Recorded at the State of Hawaii Office of the Bureau of Conveyances as: Document No. 99-018739 Annual taxes are currently 5% of the total Agricultural tax bill (which as of 2/20/2004 was $305.00) The property parcel TMK: 2-1-4-105 is a gated (Hui) community, owed by 4 land owners, all having separate clear title deeds recorded by the office of the Bureau of Conveyances to the various properties on agriculturally zoned property (9.272 acres). Owners have their own separate (subsidiary) water meters, coming off of four large water storage tanks. Tank #1 is on parcel 104, Tank # 2 is on parcel 103 and Tank # 3 & # 4 are on the immediate hui of parcel # 105. The main agricultural water meters # 958-95705 & 978-615650 services the entire extended 3 parcel hui and all 4 water tanks. The Ulu Hui Co-tenancy Agreement When an offer suitable for both parties (buyer and seller) is agreed upon, the property would then enter into escrow. Another Hui (Partnership) land meeting would be called, during the time it is in escrow at which time the potential new buyer, would be introduced to the other members of the hui, for their possible consent and agreement, about a new member joining the existent hui. In May of 2004 a Hui land meeting was held to notify the 3 other land owners, that the owner, would sell his 5% interest (Section D, see TMK map in this website) in the hui. The property is on the public market for the price of $300,000. Also at this same meeting a co-tenancy proposal change document was given to the other 3 owners, on what needed to be adjusted, changed, updated and discussed for possible change, in the original co-tenancy agreement. A copy of the document of the proposed changes handed to the other members of the hui in May of 2004 will be shown to the new potential buyer/s Surveying the Property The owners property (Section D) is 5% interest located in the mid and west section of the 9.27 acre parcel TMK Parcel # 105. A few years after the current owner purchased the hui interest property in 1989, it had been surveyed and it will be needing to be re-surveyed, before change of ownership buyer to pay all survey costs. List of approx.expenses of Property Management Monthly Propane use was about two 10 lbs tanks (Two 40 gal tanks) a month, based on single family use of 3 people. Monthly water bill for family of 3 was about $25 (minimum) to $40 every month. Broken down to: a $10.00 monthly minimum and there is a $15.00 monthly billing fee - Total $25.00 Depending upon actual water use after a minimum amount of gallons included in the first $25, whether one uses the water often for gardening &/or bathing purposes. Phone line connection was about $25 a month for one line. Solar Electric is virtually maintenance free although occasionally the batteries should be replaced over the years. If maintained well they can last for many years. Occasional maintenance of the personal property phone wire line, leading from main box, located at 801 Kalama Park Road which is above the hui property and is located where Verison Phone Company goes to do their hook ups and connections for the hui land owners. One has to take out ones own garbage in ones own vehicles to the dump. There is a road repair committee of which the Tierneys (hui land owners) are the manager and there is periodic repairs and upgrades needed for this. Either a work exchange of two hours when a day to repair is planned, roughly about once every 3 to 6 months, or if one can't make it then one could possibly pay $10 an hour per person for however many people are currently staying on the property at the time. See document with realtor, "Kanahena Road Neighborhood Association" A rough guess would be that the hui expenses for the 5% interest property, would be roughly averaged out to be approximately $100 a month, over a year period. There is a larger plan to do major upgrades to the road (repaving) and since it is a private easement road, all the owners would have to pay into that at their respective interest share. Bear in mind even if there was a considerable large road upgrade or damages done due to a storm or natural disaster if for example the property had to come up with a $5,000 payment 5% of that, would still be a minimal $250. Annual road easement varies slightly according to the usage, fee is approx. $30 a year. The share of the Hui group partnership Liability Insurance for the 5% interest (Section D) is approximately $229 annually. Agricultural zoned land taxes are currently minimal about $30 annually, for the 5% interest. |
