Highlights of the New Law
This bill transfers the responsibility for the implementation, enforcement, and administration of the Aboveground Petroleum Storage Act (APSA) from the State Water Resources Control Board to the CUPA, effective January 1, 2008.

Responsibilities of the CUPA
Identify tank facilities that are subject to APSA
Inspect facilities every 3 years for compliance with their Spill Prevention, Control and Countermeasure (SPCC) Plan
Periodically inspect SPCC-exempt faciliites

Owner/Operator Responsibilities
Prepare a SPCC Plan for facilities storing 1,320 or more gallons or petroleum
Conduct periodic inspections to assure compliance with 40 CFR 112
Implement SPCC Plan in compliance with 40 CFR 112
