On 4 Mar 1690, Gerard's guardian, Richard Martin, acting on Gerard's behalf, confirmed a deed to John Rowley...land formerly belonging to Adam Banks, Gerard's father....200 acres in Pasbitanzy Forest. Adam is then deceased. Land adjoins Dr. Richard Bryant, Richard Rosyer, Francis Hale and Rowley's house. Document indicates that Gerard is the only son and heir of Adam. On 9 Sep 1690, the Stafford Co., VA court ordered the sheriff to summon Adam Waffendahl to the next session to answer the complaint of Gerrard Banks. On 19 May 1698, Gerrard Banks was a witness of the will of Thomas Elzey in Stafford Co., VA. [Possibly related is will of one Jas. Ozey of St. Mary's Co., MD...proved 29 Dec 1665 which left all estate to Capt. Rd. Banks (Maryland Calendar of Wills). This will is also listed in Some Wills from the Burned Counties of Virginia, Hopkins, 1987. This will was proved 10 Nov 1698 and other witnesses were William Withers and Thomas Gregg.

On 11 Apr 1709, Gerard Banks conveyed 1/4 of 733 acres in the forest of Pasbitanzy between the Potomac and Rappahannock Rivers to John Rowley, land originally deeded to his father by William Heaberd in 1674. This deed is one source for information that Gerard was Adam's only son and heir. Witnesses were Wm. Waugh and Wm. Allen. (Stafford Co., VA Order Book Z, p 466-8) In the Deed and Will Abstracts of Stafford Co., VA, 1699-1709, Sparacio, 1987, p 466-8, apparently the same transaction is recorded, mentioning 1000 pounds of tobacco to be paid. It uses the term "Mr." William Heabard...all others without titles. Witnesses were John Waugh and Wm. Allen. On 13 Apr 1709, Elizabeth, wife of Gerard, relinquished dower on the property at the Stafford Co. county court session. [In 1656 in Maryland, [Lt] Richard Banks was one of the witnesses to deed of Thomas and William Allen to Henry Potter....relationship of the Allens or Lt. Richard Banks -- if any -- unknown]
