Terms & Conditions

COMMUNITY; Rental agreement is conditioned upon respectful, quiet guests fitting in with the spirit of the village of Semur-en-Auxois. Sound travels far more than one would expect and we therefore ask tenants to be conscientious of their impact on the community. While the lower garden along  the Armancon River is the perfect spot for entertaining, please be aware that  activity late into the evening can often disturb and otherwise quite environment. Upon registration of a call or complaint, we will automatically have the right to give the tenant notice to vacate the property.

GUESTS; Occupancy is limited to the maximum number stated on the Booking Form. Any increase above the number you have stated on your Booking Form for any length of time during your rental - including overnight guests - requires prior agreement from the owner.  In addition, no subletting is permitted.  Property may not be used for business purposes of any kind, without prior agreement in writing from the owner.

PETS & SMOKING;Smoking is not permitted in the house. No pets are allowed without prior written agreement from the owner.

ARRIVAL & DEPARTURE TIMES; Unless otherwise agreed, all lettings run from 3 pm on the day of arrival until 11am the day of departure. Rental periods run from Saturday to Saturday.  It is often possible to accommodate earlier arrivals and later departures with sufficient advance notice.  If you are unable to arrive at a reasonable time or wish to leave before 6am, please notify the owner beforehand. If you arrive at an unreasonable hour without notification and are unable to gain access to the property, we cannot be held responsible for any costs incurred for alternative overnight accommodation.

RESERVATIONS & PAYMENT: Reservations are made on a first come first serve basis and may be made by phone, fax or email. A confirmation will be sent by email and/or post/fax indicating that the house is still available or including a list of alternate dates. Upon confirmation of dates in writing from the owner, a temporary reservation will be held for seven working days.  Reservations become permanent upon receipt of your reservation deposit (50% of rental fees) and Booking Form by email, fax or post within seven working days. Your permanent reservation will be confirmed in writing or by email from the owner. If form and deposit are not received within seven working days, the dates will become available once more and passed on to other interested parties.   The balance of the funds, along with a security deposit of 500 euros must be received 60 days before your booking date and may be paid by PayPal  (www.paypal.com) or payment  wire in euros.  If your holiday falls within this 60-day period, payment must be made in full within seven days of the booking. If balance is not received 60 days prior to booking date, the dates will become available once more and passed on to other interested parties and costs will be incurred as indicated above. The security deposit will be returned to you within 45 days after leaving the property provided there is no damage to the property, no additional cleaning required, no long distance phone calls and no excessive utility charges. The house will have been thoroughly cleaned for your arrival and should be left in a similar condition. Tenants are responsible for removing all rubbish from the property before departure.  If more than the customary amount of cleaning is required after your departure in order to return the property to a condition suitable for the arrival of the next vacation guest, an hourly charge for that extra amount of cleaning will be deducted from your security deposit. Should you or other members of your party or guests cause any damage to the property, its contents, grounds, or any third party then you will be deemed responsible for such damage. If repair or costs of any such damage exceed the amount of the security deposit, the guest agrees to pay for such additional costs.  We advise you to take out insurance to protect you from such an eventuality.   It is your responsibility to notify the owner or caretaker immediately if you notice anything amiss upon arrival.

GUEST CANCELLATION: Notification of cancellation must be made in writing by fax, email or post. We will confirm receipt of the cancellation notice by email and/or post/fax. The effective date will be the date the notice was received.  If notification of cancellation is 90 days or more before the date of booking, the reservation deposit is refundable, less a 50 euros cancellation charge.   If notification of cancellation is between 60 - 90 days prior to the booking date, 100% of the reservation deposit will be forfeited immediately, unless the time is re-rented. If the time is rented, only a 50 euro cancellation charge is forfeited. If notification of cancellation is less than 60 days, 90% of rental costs are due immediately, unless the time is re-rented. If the time is rented, only the reservation deposit is forfeited.  We recommend travel insurance, including cancellation cover, taken out at the time of booking to avoid costs due to cancellation.

OWNER CANCELLATIONS: In the unlikely event that we have to cancel your booking or there are major changes to it due to matters beyond our control which are not covered below, we will advise you as soon as possible to reserve alternate dates or refund you 100% of your payment.

PHONE: Tenant will be billed and held responsible for any long distance calls made from the house. This amount will be deducted from the security deposit. Any charges in excess of the security deposit will be charged to the tenant. You are advised to bring a suitable charge card with you so that long distance and other calls can be charged directly to your home phone number.   If using the phone line for Internet connection, be aware that there may be a charge.  

UTILITIES: Utilities, including firewood, are included in the rental charge, not to exceed normal usage.   Any amounts above normal usage ( See below for normal usage) will be deducted from the security deposit. Any charges in excess of the            security deposit will be charged to the tenant .

LINENS AND KITCHEN NEEDS: All linens necessary for your stay, including bath towels, dishtowels, sheets and blankets will be provided. All cooking supplies are also provided along with a  fully functional kitchen..

PRICING: Prices are listed in euros. Rates are subject to change in the event of currency fluctuations. Low Season (October - April): 1-4 people 900 Euro/week , 5-8 people  1100 Euro/week, High Season (May - September): 1-4 people 1200 Euro/week , 5-8 people   1500 Euro/week 5% discount for bookings of 3 consecutive weeks 7.5% discount for bookings of 4 consecutive weeks 10% discount for bookings of 6 consecutive weeks or more Depending on availability, you may rent the house in low season for shorter time periods or weekends. Please consult us for any special requests. We are flexible to work something out that works for everyone.         

LEGAL DISCLAIMERS: Any claims under these conditions shall be within the exclusive jurisdiction of the French/English/US courts. FORCE MAJEUR: We cannot accept liability in any circumstances where performance of the contract is prevented by reason of: War or threat of war, riots, civil strife, terrorist activities, industrial disputes, natural or nuclear disasters, fire, flood or adverse weather conditions, acts of God, closure of ports or airports, epidemics, government action or any similar events outside our control.  If a problem arises, please notify the owners immediately. No complaint will be entertained unless it is raised with the owners personally before the property is vacated and confirmed in writing within 7 days of the end of your holiday. We reserve the right to terminate a booking at any time if any of these conditions are not met in full and you will be asked to leave the property. Please check all details of your booking confirmation carefully. A signed booking form is taken as proof that you have read understood and agree with the above Terms and Conditions and will abide by them. Under no circumstances shall the Owners liability to the Client exceed the amount paid to the Owner for the rental period.  The European legal system does not require the owner of the property to be responsible for accidents that occur to the occupants. By entering into a rental arrangement for the use of a property, the client accepts full responsibility for accidents, injuries or damages that may occur at the property to anyone in the rental party or their invitees during the period of the client's occupancy.
