THESIS ON THE RULING OF THE SUPREME COURT WITH RESPECT TO THE INDIGENOUS LAW

1. The Supreme Court of Justice of the Nation, maximum organ of legal defence of our country, organ that in the last instance judges on diverse controversies among the different powers of the nation, has promulgated a ruling by means of which it determines that the "Indigenous Law" that Vicente Fox presented to the Legislature is at last legitimized, and cannot be an object of appeal, under any circumstance neither by any legal figure, group, person or power of the nation, be it federal or state.

2. With this fact is shown, one more time, that the supposed legal rationality of a State of Law; that is to say, its intended reason to promulgate laws that favor a democratic life, participative, rational, just, worthy and with quality, is not characteristic either of the Executive Power, nor of the Legislature, nor of the court.

3. Equally, such action shows that the Judicial Power is not only incapable of responding to the ethics and the democratic social values of contact, participation, rationality, justice, worth and quality; but isn't capable of guaranteeing the full exercise of the rights of the citizens of our nation, as well as can never can guarantee the recuperation of its own legal norms to the benefit of our people.

4. Likewise, such decisions evince that the organs of power of the Mexican State have rejected the legitimate right of the native peoples to the self-determination and the recovery of their history, their culture, language, values and their uses and customs.

5. With this resolution is shown, yet again, that the State of Law, so boasted by the owners of the power and by its lackeys in the government and the political parties' officials, is rhetoric and lacking speech of substance and objective content for the people of Mexico and, particularly, for the native peoples.

6. With this is shown, besides, the class character (the class in the power, the bourgeoisie) of the State, that responds only to the interests of the great capital, national and foreign.

7. What does this resolution propose to us? It suggests perhaps that we continue to forget the oppressed, excluded from the benefits of the development and exploited over five hundred years? That we continue being miserable, destitute, illiterate, ignorant, dead of hunger, sick of preventable or curable illnesses, malnourished and considered redundant "human capital"? That we accept submissively and quietly its denationalising, alienating and confiscatory decisions? That the indigenous or original peoples stop existing as willing and conscious peoples to recover their political, historic dignity and citizenship?, Or that they serve, like Indians in reservations, to be become pieces of collections and present only in the images of folklore and tourism? What do they intend to tell us?

8. This legal policy (initiated by the Executive power, validated by the Legislative Power and guarded by the Judicial Power) confirms to our people what the Zapatista Army of National Liberation (EZLN) has shown since its First Declaration of the Lacandon Forest: That the armed struggle is valid, besides seeming the only way accessible to our people, to guarantee the recognition of our most elementary rights and claims of justice and dignity; shows to all the peoples of the world that the armed struggle in our Mexico is the only instrument that permits to require and to cause to comply the most elementary principles of a just, worthy and democratic life.

9. This decision evinces that the ¡Enough Already! listening with the weapons of the reason and shouting with the reason of the weapons was, is and will continue being necessary while there doesn't remain another way to our people; that we are soldiers because we want that our children do not have need to be soldiers in the future; that they will be able to question the way, but not the causes.

10. Before this fact, inapelable legally, we call for the mobilization of all the people of Mexico, through its revolutionary, popular, and democratic organizations, so that through the diverse trenches of struggle we fight against this privatizing, exclusive, racist, lying and hypocritical government, building the people's power.
