Subpoena Duces Tecum (supeona ducey tecum) is a process by which the Court commands a witness who has in his/her possession or control some documents or paper which is pertinent to the issues of a pending controversy to produce it. Simply stated, it is a subpoena for the production of documentary evidence.
A Subpoena Duces Tecum should be generated and signed by the Court to gain possession and control of any electronic, paper records, and notes that CPS, a school, local law enforcement, the prosecutor's office, or anyone else has that is relevent to your case.
