Sometime on September 2001, Angelo 'Ador' Mawanay was spotted at the Senate selling cellphones. Since he was not allowed to go up to the Senate offices, he stayed in the employees' canteen beside the parking area on the ground floor. His clients were the staff of Sen. Franklin M. Drilon, Nenet Gumabay of the Public Assistance Office, Luz Guerrero of the Printing Office and some employees of the Secretariat. Reportedly, he swapped new units of cellphone for his clients' old ones plus a certain amount of cash.

Records at the Quezon City Regional Trial Court disclose that Angelo Mawanay has an estafa case, which was filed against him by one, Kenneth Y. Wang, in 1994. Mr. Wang claimed that on May 18, 1994, his company, Asia Cotton Manufacturing Co., Inc., delivered towels to Mawanay for which the latter issued a Citibank Check, in the amount of P811.00, as payment. However, when the check was presented to the bank for payment, it was dishonored on the ground that the account was closed. Mr. Wang further claimed that Mawanay was appropriately informed about the situation but the latter still refused to deposit the necessary amount to cover the check.

After conducting a preliminary investigation, Asst. City Prosecutor Santiago M. Arenas found reasonable and sufficient grounds for the filing of the case and set the bail at P10,000.00.

Criminal Case No. Q 94-59079 was set for hearing at Br. 88 of RTC Quezon City, under Hon. Judge Elsa I. de Guzman. On August 11, 1998, Judge de Guzman issued a warrant for Mawanay's arrest for his failure to appear in court despite due notice.
