Judge OKs Removal of Schiavo Feeding Tube

PINELLAS PARK, Fla. - The presiding judge in the case of Terri Schiavo ruled Friday that the feeding tube keeping the brain-damaged woman alive can be removed despite efforts by congressional Republicans to block the move by seeking her appearance at hearings.

Pinellas Circuit Judge George Greer refused a request from U.S. House attorneys to delay the removal, which he had previously ordered to take place at 1 p.m. EST. Greer determined that it should go forward about an hour after another judge issued a temporary delay blocking the tube's removal.


There was no immediate word on when the tube might be removed.

PINELLAS PARK, Fla. - Doctors removed Terri Schiavo's feeding tube Friday despite an extraordinary, last-minute push by Republicans on Capitol Hill to use the subpoena powers of Congress to keep the severely brain-damaged woman alive, a source close to the case told The Associated Press.

It is expected that it will take one to two weeks for Schiavo to die, provided no one intercedes and gets the tube reinserted. The source had been briefed on the situation but spoke on condition of anonymity.

The removal came amid a flurry of maneuvering by Schiavo's parents, state lawmakers and Congress to keep her alive. Committees in the Republican-controlled Congress issued subpoenas for Schiavo, her husband, and her caregivers demanding that they appear at hearings on March 25 and March 28.

But the judge presiding over the case later refused a request from House attorneys to delay the removal, which he had previously ordered to take place at 1 p.m. EST.
The U.S. Senate requested Friday, that the brain damaged woman and her husband testify before Congress in ten days. The move announced by Senate Majority Leader Bill Frist, MD (R-TN) was meant to prevent doctors from immediately removing Terri Schiavo’s feeding tube. Florida’s courts have repeatedly in favor of her husband saying doctors may remove the life support early Friday afternoon.
The senates invitation makes it a crime to in any way inhibit Schiavo from appearing before lawmakers. According to court appointed doctors she has lived in a persistent vegetative state due to brain damage since 1990.
Schiavo’s parents have fought their son-in-law for years now to keep their daughter alive. Their attorney said on Friday the couple looked forward to having their daughter appear before congress to show how really alive she really is.
“We have a clear sense that our President feels that we should air on the side of life, I think we have a pretty clear sense that both the Senate and the House believe that Terri Schiavo’s life should be spared” -David Gibbs, Schiavo’s attorney
Also on Friday the House Committee issued subpoenas to stop doctors from removing the feeding tube. If the doctors do go ahead with the court approved removal of the tube, they could then be found in Content of Congress.
