Samuel Bays. -Born in Fayette County, Va. Lived some time in Boone County, and returned to Fayette last spring. Offered to vote for secession in May last, but his vote was rejected because he had not been in the country twelve months. Has always been a Southern rights man. Was probably arrested because there was a general removel of the citizensin the rear of General Floyd's army. Bays' brother-in-law was in the army. He is a man of good character, and of a family sound in the Confederate cause. I recommend his discharge on taking the oath of allegiance. Witnesses, Colonel Coleman, W. Atchison.

He was buried in Trinity Methodist Church Cem., Brushy Fork of Elk Creek, Harrison Co. WV. According to Wirt Co. History, "In 1766 Matthew, together with Christopher, John, Thomas, and Thomas' son, Christopher, moved to Augusta County, Va., where they lived until l769, then removed to Fayette Co., Pa.

Matthew was in the Revolutionary War, a defender of Fort Nutter. Matthew married Elizabeth and lived about the mouth of Simpson Creek area. Matthew had 500 acres on Elk Creek, Harrison County joining John Radcliff's land, 1781 a certificate for 300 acres on the east side of Elk creek was included in his settlement made in 1772.

In this Nutter's lifetime, the Thirteen Colonies would become a nation based on the three principles of Life, Liberty and the pursuit of happiness. He lived during the Indian Wars, the American Revolution and the Louisiana Purchase! Matthew Nutter was a second cousin of Thomas and John Nutter. Thomas was married to Susan (Sarah) Goodwin and Elizabeth Goodwin (Susan's sister) was the wife of Matthew.

The British government was offering land patents for 400 acres for 7.5 pounds for taxes and the additional costs of surveying the land. In Matthew's land patent, the words 'Improvement of 1772' is used. In 1772, they moved to West Augusta, now Harrison County, WV.

The Indian method of warfare at that time was the indiscriminate slaughter of all ages and sexes. It was therefore necessary to create a defense mechanism. This was generally accomplished by banding together in structures called forts. on the banks of Elk Creek , two miles from what is now Clarksburg on Buckhannon Road on land belonging to Thomas Nutter . Thomas, Matthew's brother-in-law , began Nutter's Fort near the town of Clarksburg, West Virginia. Matthew, Thomas, and John were the three Nutter's who established the Nutter's in the interior of Colonial Virginia. Nutter's Fort, in the modern day world is part of the Roosevelt-Wilson campus in Clarksburg, West Virginia. In 1763, the British government had established the Proclamation of 1763. The proclamation forbade any settlement west of the Alleghenies. The government thought this might prevent the growing problem of Indian hostilities. The proclamation was ineffective and by 1772, the Proclamation had been repealed. According to the Nicholas County History book of 1985 (WV); Christpher Nutter, who was the son of Thomas, page 133, "That the family stopped over at Redstone Fort for a season before moving up the Monongahela to the West Fort." Matthew Nutter was the third generation of the pioneer family. Thus, that covers the fourth generation of the Nutter family and its mark in West Virginia history.

Matthew, Thomas and John Nutter are listed as voters at the Court House in Clarksburg for the County of Harrison on Wednesday, the 7th day of January 1789 for an elector acceptable to an act of the General Assembly passed at Richmond in October 1788. At this election, George Washington was elected President.

Hannah MILLER was born 1772. She died 1838. Hannah married Mathew Nathen NUTTER Sr. on 1769.

Eli was a veteran of the Mexican War, a steamboat captain and a saw mill worker. He was a confederate who served in Co. D, 14th Virginia Cavalry as a private. Eli died in a cavalry charge at Gettysburg. He was bur. on, or near, the battlefield, but his remains were later moved to Richmond, Va. [according to John Emick in John Emich Pioneer..]

Geneva Amick Dyer writes about Eli's family:
The children of Eli Amick were: John, Matilda, Mahulda, Lorenzo, Andy and Jane. Jane died at a very early age, and Andy did in his hatter teens, I believe.
Aunt Pernecia married Bill Thomas, and became the mother of Alfred and Sally.
Aunt Hulda married Alfred Brown. I believe she was the mother of two sons, and one daughter, the daughters called Della or Dillie, or a name similar to that. I have forgotten the names of the boys.
Uncle Lorenzo was married late in life. He married Fannie Jones, but I can't remember the names of any of his children.

Jesse AMICK [Parents] was born about 1822. He died in Nicholas County. Jesse married Lucy J. BAYS in Nicholas County.

After the death of his father, John AMICK, Jesse assumed much of the responsibility of the home helping his mother rear the younger children. He later established a home near where Nallen, West Virginia is now located. He built a grist mill on Meadow River and while operating it he fell, severely injuring himself. Jesse died shortly thereafter. He is buried in the cemetery at Sugar Grove.

While operating this mill he fell and received injuries from which he never recovered. He was buried in the cemetery at Sugar Grove.
George, his oldest son, married Kate Zerkle, lived near Belva, and have two sons, Fred and Ada.
Fred married Miss Lizzie Marin. They had six children: Clinton, Anna, Beulah, Bertha, Evelyn and one child who did in infancy. Ada married James Nuckols, lived in Charleston, W. Va., and operated a hotel. They had one son.
Robert Amick married a Miss Crew. They lived at Beaver Mills, W. Va. They had two children. Cordia, the daughter, did in infancy and the son, Ernest, is now living in Fayetteville, W. Va.
Robert Amick was a millwright and a farmer. He is now living at Dempsey, W. Va., being married the second time to Emma Carter.

While Uncle Gid. Lived in a town in Iowa named Western, he helped build a college by the same name. Both college and the town "faded out" because the railroad failed to come their way, and Cedar Rapids instead, became the city the westerners had hoped for.
William, the oldest son of Gideon Amick, west from Iowa to California, and was living there at the time of the San Francisco earthquake and fire. He was thrifty and accumulated quite a good sized fortune. He had learned the stone-mason's trade, at which he worked for a while. It was in the hotel business in San Francisco that he accumulated his wealth.
After Aunt Emily's death, he (Uncle Gid.) came back to W. Va. And married Martha Sudreath. Two daughters were born to them, Lee Ana, and Nancy. After Uncle Gid's death, aunt Martha returned to her native state and lived at Sewell, Fayette County, W. Va. Lee Anna married a Mr. Saunders.
Nancy married a Mr. Herbert; and lived in or near Wheeling. They had a daughter, Ruby, who was a graduate nurse and practiced her profession in Huntington.
At one time Uncle Gid was working for Mathew McClung, a wealthy farmer who had built and owned the "White House." This year Mr. McClung had raised a considerable crop of buckwheat and having a part of it ground into flour, took it to Kanawha Falls for sale. Having received a higher price than he expected, he decided to speculate a little, whereupon he asked Uncle Gid if he know of any one who had raised buckwheat that season. Uncle Gid replied: Arnold has a hundred bushel of the finest I have ever seen."
McClung ground and sold the remainder of his crop, then went to father; to buy his. Father told him he had not raised more that year than he wanted for his own use. When McClung returned he said: :Gid, I thought you said Arnold had raised a hundred bushel of buckwheat:, Uncle Gid replied: "He did, straw and all."

Emily Jane STUART [Parents] was born 14 Jan 1823 in Russellville, Fayette, Virginia. She died 19 Sep 1861 in Blackhawk Iowa (unmarked grave). Emily married 1 Gideon AMICK on 1843 in Fayette County, Virginia.

Emily Jane was a sister William A. Stuart, husband of Mary Ann AMICK.

William A. STUART [Parents] was born 13 Jun 1815 in Virginia. He died 1862 in Luka, Tishimingo County, Mississippi. William married Mary Ann AMICK on 20 Dec 1844 in Nicholas County, Va..

After his marriage to Mary Jane, the couple and their first two Children moved to Elkhart, Goshen, Ind. in 1851, where their third son was born 25 Dec of that year. Gideon and Emily Jane (Stuart) Amick followed the Stuarts to Goshen sometime later during that same year of 1851. Gideon and Emily Jane moved a few years later to Iowa, while William and Mary Ann (Amick) Stuart remained briefly in Indiana before moving on to Illinois.
William A. Stuart enlisted to fight in the Civil War on 15 Jan 1862, as a private from Menard County, Ill. in Company G, 18th Regiment, commanded by A. M. Pollard. He died of typhoid fever at a Union hospital at Iuka, Tishimingo County, Mississippi, 22 Aug 1862, just six months after enlisting. [Union Army Civil War Widow's Pension File #34998].

Mary Ann Amick applied for a pension from her husband's Civil War service and subsequent death. The pension application was No. 34998 dated 26 September 1863. The Claim was admitted 17 May 1886 to a pension of $8.00 per month, commencing 29 Aug 1862. Widows declaration for increase dated 3 September 1866. The pension certificate was No. 74300. Since this pension was retroactive she had abit of money by the time the claim was admitted - somewhere around $2,200. However, we do not know how much she had to suffer during the close to 23 years she waited for the pension.
