Dear Commissioner Guns,
As I’m sure you recall, you met with the Whitaker Woods Homeowners Association Board of Directors in late December of 2005. During the meeting, you addressed a number of the questions that the board has been seeking to answer for years. Thank you! We appreciate that you took the time to meet with us and to address and investigate our concerns.
The board can foresee a day when members of the community inquire about the specifics of these issues, or a day when we need accurate records to provide a contractor doing work for the community. In order for us to complete our records, be able to provide reliable and accurate answers to our member’s inquiries, and have documentations supporting the position that all parties involved have completed their legal obligations regarding the community, we are formally requesting the following:
- Any and all documents regarding the construction, inspections, and maintenance records of the three ponds on the property.
- Specific references to any and all Code, Statute, Guidelines, Rule and Regulations, or any other legislative utensil to which the county is bound with respect to “Ponds” and “Common Areas” that were in place from 1997 to the present. (At the meeting you stated that the developer had met the minimum requirements with respect to the conditions in which the he left the ponds and common areas. Unfortunately, at the time, we did not ask to what you were referencing, thus our current request).
- The final “as-built” plat for the entire community. We are in possession of preliminary blueprints, but have been unable to obtain the final prints.
- The final “as-builts” for the SWM facilities numbers one and three.
The simple motivation behind seeking these documents stems from the need to properly serve and preserve the interests of our community. The community, through its board, is financially responsible for every aspect of the ponds and common areas within the confines of the property. Possessing all applicable information is necessary and elementary in carrying out these duties.
We look forward to receiving the county’s formal, written response, addressing each of the topics listed above within 30 days of receipt of this letter. As always, we greatly appreciate your time and attention in aiding us in resolving these issues. Thank you again.
