This site has been developed for the REP (Rights for Equitable Pension) AllianceThe REP Alliance is an association of former employees and retirees of the former Bell Sygma Inc a wholely owned company of BCE and a former BCI Ottawa group, who have retained Koskie Minsky LLP to represent them in their efforts to recover the substantial surplus in their BCE pension plan .

We have developed these web pages in order to provide general information on issues of interest to you. The contents of this site are subject to solicitor-client privilege and all rights to that privilege are expressly claimed and not waived.

BRIEF PROGRESS STATUS

(March 19, 2008): - Separate letters were mailed out to both Ontario members, and REP Quebec Members bring them up-to-date. Mailings were based upon most recent address that BCE had for members. If you expect a letter and did not receive a copy please contact Koskie and Minsky.

(July 11, 2007): - The proposed sale of BCE does not alter BCE's legal obligation to distribute surplus in accordance with the Monsanto decision.

- BCE indicated that the proposed sale has thus far not affected the settlement process it has engaged with the Member Committee and it has indicated to FSCO recently that it is continuing in that process.

- The proposed sale has and likely will cause some delays in the process, given the consuming resourses being dedicted to the sale by BCE internal staff.

(Nov 14, 2006): Delays in out expected communication to members have been unfortunate. We are still in discussions with the legal teams. Prior to any mailing we need to ensure home addresses with BCE are up-to-date. We are seeking instructions from BCE on how to advise you to submit new addresses if it is necessary in your particular situation.

(June 26, 2006): Discussions between BCE’s legal team, Osler Hoskin & Harcourt LLP and our legal counsel Koskie Minsky LLP continues. The parties are currently working out the ground rules for negotiating a settlement of any pension surplus distribution. The REP Steering Committee will in short order be mailing out a member communication in which we will be canvassing member support for us to continue to negotiate the terms of a settlement with BCE.

(Oct 13, 2005): In Aug 2005 BCE appointed Osler Hoskin & Harcourt LLP as their counsel. BCE has agreed in principle to engage in discussion of surplus settlement.

(Sept 28, 2004): The FSCO sent a letter in mid-Aug to BCE Pension Plan administrators seeking information on the current status of the surplus.

(July 29, 2004): The Supreme Court of Canada ruled today in favour of Monsanto employees. The precedent has been set for our claim to the BCE Pension Surplus.

(April 2, 2004): Koskie Minsky LLP have written on behalf of the REP Alliance to Blake, Cassels and Graydon, BCE's legal representatives seeking to initiate discussion on broader resolution of surplus issues and a format for discussion pending such resolutions.

(March 1, 2004): The Monsanto appeal in the Supreme Court was heard on Feb 16th.The Court reserved its decision. It may be several months, perhaps even six months or more, before the Court releases its decision. We are optimistic that there will be a positive decision which will require a distribution of surplus to the Bell Sygma Group. However, any actual distribution may still be years away and there may still be subsequent litigation.

(Nov 7, 2003): The highest court in the land agreed Jun 5 to hear an appeal in a widely watched case involving 146 former employees of Monsanto Canada Inc. The Court date is expected to occur in early Spring 2004 with hopefully a decision by late summer of 2004.

(Jan 21, 2003): Monsanto filed an application for leave to appeal to the Supreme Court of Canada. It will take approximately 6 months before the Court will decide whether or not they want to hear the appeal.

(Dec 4th, 2002): In an unusual move and apparently without informing the Minister of Finance, the Ont. government moved to Committee of the Whole House and withdrew the section 25 of Bill 198. Congratulations to everyone of you that helped our campaign. Our voices have been heard. The letter writing can now be stopped (for now).

(Nov 28th, 2002): Ministry of Finance has announced the measures in Bill 198 dealing with pension issues will never be proclaimed. Click on Bill 198 Debate Button for Details. Thanks to all those that wrote ERNIE EVES. You all made the difference. To show you're still concerned keep those letters coming to ensure they don't alter their plans and leave the section pertaining to pensions in Bill 198. Don't leave it to someone else. (Nov 23rd, 2002): An important court ruling by Ontario Appeals Court has been confirmed. Decision in favour of Monsanto Employees. Court case presentations were back on April 29/30, 2002.
