An Act for better Securing the Honour and Independence of the Legislative Council of this Colony.
[Passed 29th April, 1874.]
WHEREAS the Nomination of Members of the Legislative Council of this Colony, as Candidates or Members to serve in the House of Assembly, is subversive of the Honour and Independence of the Legislative Council; and it is expedient to make provision for the better securing the Honour and Independence of the Legislative Council in that behalf;
Be it therefore enacted by the Governor, Legislative Council and Assembly, in Legislative Session convened:--
I.--Any person holding a Commission as a Member of the Legislative Council of this Colony, who shall hereafter be nominated as a Candidate at any General or other Election of Members, or of a Member, to serve in the House of Assembly of this Colony, shall thereon and thereafter cease to be a Member of the said Legislative Council, and the Commission of such person as Member of the said Legislative Council shall thereon and thereby become and be vacated and superseded.
II.--Nothing in this Act contained shall be of any effect until Her Majesty's pleasure thereon shall have been signified.
