Resolution passed in the House of Assembly of Newfoundland, April 29, 1999

The Honourable the Premier to Move:

RESOLUTION

WHEREAS section 43 of the Constition Act, 1982 provides that an amendment to the Constitution of Canada in relation to any provision that applies to one or more, but not all provinces may be made by proclamation issued by the Governor General under the Great Seal of Canada where so authorized by resolutions of the Senate and House of Commons and of the legislative assembly of each province to which the amendment applies;

AND WHEREAS Term 1 of the Terms of Union of Newfoundland with Canada provides as follows:

1. On, from, and after the coming into force of these Terms (hereinafter referred to as the date of Union), Newfoundland shall form part of Canada and shall be a province thereof to be called and known as the Province of Newfoundland.

NOW THEREFORE the House of Assembly of the Province of Newfoundland resolves that His Excellency the Governor General be authorized to issue a proclamation under the Great Seal of Canada amending the Constitution of Canada in accordance with the Schedule set forth below;

AND BE IT FURTHER RESOLVED that, upon approval and adoption by this House of this Resolution, the Speaker be directed to forward a true copy of this Resolution to His Excellency the Governor General certifying that the requirements of the Constitution Act, 1982 respecting the adopition of a Resolution by the House of Assembly of Newfoundland have been met.


SCHEDULE

AMENDMENT TO THE CONSTITUTION OF CANADA

1. The Terms of Union of Newfoundland with Canada set out in the Schedule to the Newfoundland Act are amended by striking out the words "Province of Newfoundland" wherever they occur and substituting the words "Province of Newfoundland and Labrador".

2. Paragraph (g) of Term 33 of the Schedule to the Act is amended by striking out the word "Newfoundland" and substituting the words "the Province of Newfoundland and Labrador".

3. Term 38 of the Schedule to the Act is amended by striking out the words "Newfoundland veterans" wherever the occur and substituting the words "Newfoundland and Labrador veterans".

4. Term 42 of the Schedule to the Act is amended by striking out the words "Newfoundland merchant seamen" and "Newfoundland merchant seaman" wherever they occur and substituting "Newfoundland and Labrador merchant seamen" and "Newfoundland and Labrador merchant seaman", respectively.

5. Subsection (2) of Term 46 of the Schedule to the Act is amended by adding immediately after the word "Newfoundland" where it first occurs the words "and Labrador".

6. This Amendment may be cited as the Constitution Amendment, year of proclamation, (Newfoundland and Labrador).


ANNEXE

MODIFICATION DE LA CONSTITUTION DU CANADA

1. Dans les Conditions de l'union de Terre-Neuve au Canada figurant à l'annexe de la Loi sur Terre-Neuve, « province de Terre-Neuve » est remplacé par « province de Terre-Neuve-et-Labrador ».

2. Dans l'alinéa g) de la clause 33 de l'annexe de la même loi, « Terre-Neuve » est remplacé par « la province de Terre-Neuve-et-Labrador ».

3. Dans la clause 38 de l'annexe de la même loi, « anciens combattants de Terre-Neuve » est remplacé par « anciens combattants de Terre-Neuve-et-Labrador ».

4. Dans la clause 42 de l'annexe de la même loi, « marins marchands de Terre-Neuve » et « marin marchand de Terre-Neuve » son respectivement remplacés par « marins marchands de Terre-Neuve-et-Labrador » et « marin marchand de Terre-Neuve-et-Labrador ».

5. Dans la clause 46(2) de l'annexe de la même loi, « autres que Terre-Neuve » est remplacé par « autres que Terre-Neuve-et-Labrador ».

6. Titre de la présente modification: Modification constitutionnelle de (année de la proclamation) (Terre-Neuve-et-Labrador).
