How Tharu families walk into a bondage contract on Maghe Sakranti

GULARIA, Jan 13 - It has been a year since Shivaram Tharu ofKhairichandapur VDC-9 sent his 14-year old daughter to a landowner's house in Nepalgunj to work as a kamaiya (bonded labourer).

But now, since maghe sankranti (a major festival for the Tharus which falls on Jan 15) is just round the corner, Tharu, a father of 10, wants his daughter to come home for the celebrations. And in the process, of her hard-earned money. "It is very difficult to sustain our family of 10 with the little land that we have," Tharu says. " Thus, I sent my grown up daughter to work."

There are a number of Tharus like Shivram who send their children to work as kamaiyas for anywhere between Rs.1000 to Rs. 5000 a year. This is the time of the year when many of those young kamaiyas come back home

Because, maghe sankranti is not just a big festival of family togetherness, but it is also the time when the kamaiyas are traded to the local landed gentry, much like cattle or vegetables.

During that one day, labourers are released by old masters, and new ones take over after receiving the appropriate price. Sometimes, the old masters keep them. All the transactions take place without any paperwork.

The kamaiya system, which has been a blot on Nepal's social scene, is mostly prevalent in five districts in the west. It is a result of debt, often small but which balloons over time due to interest and which is handed down generation to generation. Until the kamaiyas pay off the debt, they remain bonded to the master. On maghe sankranti, it is the debt that is traded off to a new master. There is no data accounting for the number of children who work as kamaiyas, says Pram Bahadur Chand, a government official office that looks after kamaiya welfare.

There are 15 thousand one hundred and 52 persons working as kamaiyas in Western Nepal's Dang, Banke, Bardia, Kailali and Kanchanpur districts. 83 thousand 3 hundred and 75 families in these district depend upon the kamaiyas for work, says Chand. According to the District Land Reform Office, Bardia alone has 5 thousand 37 kamaiyas.

For the Tharus, the entire month of Magh (from Jan 15 to Feb 12), is a holy month and a month of honesty. Thus, in this month, they are bonded to work, without a written commitment. This is also a month of relaxation for them. For three days, they celebrate joyously.

Poshan Pokhrel from Gularia says that the Tharus are not bonded but are just labourers. However, for the kamaiyas, they are indeed bonded. According to Chand, the kamaiyas from the five districts have borrowed Rs. 48 million, 876 thousand, 932 all together from the landlords, all of which they have to pay back.

The government has made efforts to release the kamaiyas from their bondage but due to a lack of clear policy, many still remain in bondage. In the Rural Development Bank, Nepalgunj, in the fiscal year 98/99 Rs. 500 thousand was sanctioned to relieve the kamaiyas from bondage but due to the lack of clear policy, the money has not yet been used, says Chand.

In the fiscal year 96/97, the government designed programmes for the development of the kamaiyas and for their debt relief. Institutional programmes as well as income generating programmes were launched. This FY 99/2000, an amount of Rs. 14 million 460 thousand 3 hundred has been sanctioned for these five districts.

From that programme, in Bardia alone, from a total budget of 5 million 232 thousand, from the FY 96/97, a total of Rs. 4 million 942 thousand has been spent.

In Bardia, after the launching of that programme, a total of 265 persons have taken skill development training and 257 have taken a enterprise development training. 81 persons have been able to release themselves from bondage and are carrying on with activities learnt during the training, say Danda Pani Poudyal, Chief of Land Reform Office.
