In the name of God, Amen. I Philip Crist of the County of Fairfield a
nd State
of Ohio am now of perfect mind, memory and understanding, thanks be t
o God. Do
make this my last will and testament vz:
First: I give and command my soul unto the hands of almighty God wh
o gave it
and my body to the earth to be buried in a decent christian lik
e manner
at the discretion of my executors hereinafter named. And as t
o my worldy
estate and property where unto it has pleased God to bless me i
n this
life I give and dispose of in the following manner, that is t
o say
First: Considering that I have given my son JACOB CRIST one quarte
r section of
land in the thirtyfourth section in the eighteenth range and co
nveyed to
him the same I give and bequeth to him one dollar in full of hi
s share of
my real and personal estate.
Secondly: Having heretofore given unto and conveyed to JOHN CRIS
T a quarter of
the section number thirtyfour, aforesaid, I bequeth unto him th
e sum of
one dollar as his part of my estate.
Thirdly: Having in like manner given and bound to convey unto my dau
ghter
BETSY CRULL and JOHN CRULL her husband a quarter of the eightee
nth
Section in the seventeeth township and sixteenth range do giv
e and be-
queth unto them the said BETSY and JOHN one dollar as their sha
re of my
estate.
Fourthly: Having given unto WILLIAM CRIST the N.E. corner of the 18t
h section
in the eighteenth township and seventeeth range,in addition I w
ill and
bequeth two hundred and ninety three dollars.
Fifthly: I will and bequeth unto my son DANIEL CRIST one hundred an
d twenty
six dollars and twenty five cents with is in addition to $473.7

paid him is his full share of by estate real and personal.
Sixthly: I give and bequeth unto CATHERINA SUTTON, wife of LEVI SUTT
ON, my
daughter one hundred and thirty one dollars and sixty five cent
s.In
addition to $168.35 heretofore received, make her share in ful
l of what I
allow of my estate.
Seventhly: I give and bequeth unto my daughter SARAH DRUM three hund
red
dollars.
Eighthly: I give and bequeth unto my beloved wife CHRISTINA CRIST th
e place
whereas I now live to wit: a half section in the 24th sectio
n eighteenth
township in the seventeenth range now occupied and possessed b
y me from
my decease until my sons FREDERICK and PHILIP CRIST arrive of a
nd be
twenty-one years of age. The clothing and schooling my said sons
FREDERICK AND PHILIP.
I also give and bequeth unto my
said wife such parts of
my personal property as she may have need of or a wish to retai
n until my
sons Frederick and Philip shall arrive of the age aforesaid an
d after my
decease I order and direct that my waggon, two horses,plow, an
d harrow
shall be the property of my said sons, Frederick and Philip fo
r their
purpose and shall be use by them in working and farming the pla
ce
attending the saw mill.
Ninthly: I give and bequeth unto my said sons Frederick and Philip t
heir heirs
or assigns the half section aforesaid or the farm whereon I no
w live in-
cluding the saw mill to be by them owned and possessed as thei
r real
estate in fee simple as tennants in common and not as joint ten
ants from
the time the youngest of them (Philip) shall be of the age of t
wenty one
years forever. They, the said Frederick and Philip subject of t
he payment
of the legacie aforesaid mentioned or so much thereof as may re
main
unpaid after appropriating the remainder of my personal propert
y that is
not heretofore in this will disposed of to the payment of the s
aid
legacies which personal property I order and direct after my de
cease to
be sold at public sale and the proceeds thereof applied to th
e payment
of my funeral charges, just debts and the legacies aforesaid t
o my wife ,
her bed and bedding and such other articles of household furnit
ure as she
may stand in need of as aforesaid and further order and direc
t that when
my sons Frederick and Philip aforesaid arrive at lawful age an
d take
possession of my place as aforesaid that they shall thereafte
r support
and maintain my said wife CRISTINA, their mother during her nat
ural life
and at her death give her a decent christian like burial. And i
n case of
a disagreement between my said sons and their said mother tha
t she should
wish separate maintenance, I order and direct that she shall ha
ve the use
of the saw mill house during her life and that the said Frederi
ck and
Philip their heirs or assigns yearly and every year pay, procur
e, and
deliver unto her at their own costs and charges one milk cow o
f the
keeping thereof if she should then have one of her own. Kept i
n good
manner in the Summer and winter firewood hauled and chopped a
t her door.
four hundred weight of good flour as she may have occassion fo
r it. Two
hundred pounds of good pork with sufficient quantity of salt
. Twelve lb
of good coffee and twelve bushels of sound corn, together wit
h twenty
pounds of sugar and twenty pounds of flax from them single year
ly and
every year during her natural life.
