---- Will of James McCutchen
I, James McCutchen of the county of Lawrence and State of
Tennessee.
Farmer do make and publish this my last will and testament
revoking and
making void all former wills by me at any time heretofore made,
and first i
direct my body be decently intered in a manner corasponding with
my estate and
situation in life and as to such worldly estate as it has pleased
God to
intrust me with I dispose of the same as follows first I direct
that all debts
and funeral expences be paid as soon after my decease as possable
out of the
first monies that come into the hands of my executors from any
portion of my
estate also I direct that my beloved wife be and remain in
peaceable possession
during her life of all of that part of the farm on which I now
live commencing
at the cross fence including the present stubble field adjoining
the dwelling
house in which I now live with all other fields , lots, gardens,
and orchards
lying above and north of the first discribed field on the tract
of land on
which I now live together with all the appurtinances there unto
belonging also
I direct that she have all the farming tools also she have the
choice of stock
of horses on hand at my decease two also that she have all my
stock of cattle
sheep and hogs also all the household and kitchen furniture also
that she have
my oxen and cart also that she have one hundred dollars in cash
so soon as
collected by exectitors also that she have negro boy Lias and
negro girl Martha
Jane all of the above property I direct to be hers and at her
entire
disposition and further direct that she have negro woman Jenny
Negro boy Harry
and negro Joe during her natural life at her death they be sold
by my executors
and the proceeds therof divided equally among my legatees with
the exception of
the heirs of my son Andrew McCutchen also I direct that my son E.N.
McCutchen
have the tract of land on which I now live including all I hold
by deed grant
or entity, and that he them in possession all of it except that
part left to
my beloved wife and to have possession of all that part at her
death also I
direct that the heirs of my beloved son Andrew McCutchen have the
sum of one
thousand dollars in the following manner to wit; that John D.
McCutchen have
the sum of two hundred and fifty dollars when he arrives at the
age of twenty
one years, also that James P. McCutchen have the sum of two
hundred fifty
dollars when he arrives at the age of twenty one years,
also that Andrew McCutchen have the sum of two hundred and fifty
Dollars when he arrives at the age of twenty one years, also that
William C.
McCutcheon have the sum of two hundred and fifty dollars so soon
as he arrives
to the age of twenty one years, making the above named sum of one
thousand
dollars and I direct that it be their intire portion or part of
my estate also
I direct that negro woman Peg Negro man Jerry and negro man Jack
be sold to the
highest bidder by my executiors and the proceeds be equally
divided among my
legatees except the heirs of my son Andrew McCutchen also I
direct what I have
given to my beloved wife be her intire portion or part of my
extate also I
direct that
my executors sell or cause to be sold a certain occupant claim
that my beloved
son Campbell McCutchen made in the state of Arkansas on the
waters of Buffalo
and the procuor therof with all other moneys or claims for money
to be equally
divided among my legatees except those heretofore excepted I do
hereby make and
ordain James R Dickey E. N. McCutchen and Nathaniel Hays to this
my last will
and testament. In witness whereof I James McCutchen the testator
have to this
will written on one sheet of paper, set my hand and seal the 26th
day of
September 1836
