C. The major purpose for this contract is to protect, preserve, and maintain the standards as spelled out by the American Kennel Club of the German Shepherd Breed.
II. Definitions:
A. For the purpose of this contract, show quality prospect shall mean a dog free from major faults, and estimated to be capable of achieving an AKC/SV Title with proper handling and promotion. And capable of attaining OFA hip and elbow Certification, and free of inherited Eye Disease. However, NO dog is quarantined show quality.
B. For the purpose of this contract, major faults shall mean those faults recognized by the appropriated AKC breed Standard in force at the time of this contract which disqualify said dog from show conformation classes.
C. For the purpose of this contract, OFA Certification shall mean a dog certified free of hip disease in the manner as prescribed by the Orthopedic Foundation of America, as free of hip and elbow dysplasia and given a registration number by the OFA for such disease.
III. Obligations of Seller:
A. Seller warrants that said dog is a purebred dog and is registrable with the AKC.
B. Seller will provide buyer at the time and date of this contract a true copy of the dog's AKC registration slip or litter registration slip and a true copy of said pedigree of at least four (4) generations.
C. Seller warrants that said dog has been properly cared for up to and including the date of this contract, and will provide buyer with an individual health record for said dog. All contractual agreements are void if dog is not examined by a licensed veterinarian within Forty-eight (48) hours of purchase, and at buyers expense.
D. Seller hereby agrees that the buyer may, for any reason, return said dog at any time during its life. Any shipping expenses are the responsibility of the owner. If this dog fails to receive OFA Certification for hips and elbows, or CERF (Canine Eye Registry Foundation), attested to by two (2) competent Veterinarians of OFA/CERF, it will be replaced with a like prospect from the next available litter of a different breeding,Or half (1/2) of the purchase price refunded. Buyer may choose to retain said dog, however, no refund or replacement be given until such time as proof of sterilization is provided to Seller. NO REFUND OR REPLACEMENT will be made if the fault is the result of mistreatment, improper, or lack of, care, either intentionally or unintentionally.
IV. Obligations of Owner:
A. Owner hereby agrees to properly care for said dog. Providing quality food as recommended by the breeder, fresh water, daily exercise, and to maintain said dog in such health at all times, keeping current with vaccinations, worming, and any other appropriate veterinary care to include heartworm preventative, and agrees to assume all financial and legal responsibility for said dog from the time and date of this contract.
B. Owner hereby agrees that said dog will never be used in any manner which would be detrimental to the health, safety, or well being of said dog and public.
C. Owner hereby agrees to confine said dog in a securely fenced and locked enclosure at all times when not under the supervision of a qualified adult. Dog shall NEVER be chained or tied our with less then a 20 foot lead, proper shelter, food, and water, for more than an eight (8) hour period. Said dog shall not be allowed to run or roam free unless under direct supervision or voice control of a qualified adult, and must NEVER run free in violation of any Local, State, or Federal Laws.
D. Owner agrees that said dog will not be bred or used for breeding purposes unless ALL of the following conditions are met, nor bred to any dog, Male or Female, which does not meet the same conditions:
1. Dogs(dog shall mean male and/or female)must be AKC/UKC/CKC registered, and of the same breed.
2. Dogs MUST be OFA/CERF certified.
3. Dogs MUST have current and be negative for Brucellosis.
4. Dogs must be of very good to excellent quality according to breed standards in order to be used for breeding.
5. No Bitch shall be bred back to back in any calendar year. However, if the Bitch runs a four (4) month cycle, and a competent Veterinarian has determined that this is not the cause of any health problems, two (2) litters per calendar year are acceptable, but still not recommended or approved by this seller.
6. All puppies produced or sired by this dog shall be sold on a contract in accordance with the practices and guidelines of the German Shepherd Dog Club of America. This dog shall NEVER be bred, in any manner, or provide any breeding stock to any commercial or backyard breeders. All puppies produced/sired by this dog being sold as pet quality WILL be sold on limited registration, with a spay/neuter contract required.
E. Owner hereby agrees that any abuse or neglect of dog, physical, emotional, or otherwise, whether intentionally or unintentionally, will void all claims to said dog, and that all right, legal claim, and full ownership will be immediately and automatically reverted to seller with no reimbursements to owner. If said dog is confiscated for any reason by any Humane Society, or Animal Control, and owner is not allowed to retrieve the animal, the owner shall be obligated to contact the seller at once with proper information for seller to retrieve the said animal.
F. Owner agrees that in the event owner no longer wishes to keep or is unable to keep said dog for any reason, that Abintra Afortori Kennels will be notified at once and offered FIRST RIGHT OF REFUSAL to purchase dog at one half (1/2) original purchase price. Dog shall NOT be sold, transferred, given away, disposed of, or change ownership in any way without the express written permission and approval of Abintra Afortori Kennels. Should said dog be so transferred in violation of this contract, seller shall be entitled to damages up to five (5)times the original purchase price or $5,000 US, whichever is greater. Owner agrees to keep Abintra Afortori Kennels advised of current addresses and telephone number(s) for the lifetime of the dog. Abintra Afortori Kennels shall be notified within forty-eight (48) hours of any serious injury, illness, or death for whatever reason.
G. Owner hereby grants Christine Neville, or any representative of Abintra Afortori Kennels, the First Option to purchase the said dog should the dog ever be offered for sale, or should owner wish to give or grant possession/ownership of the dog to any other person, whether actually or legal. The First Right of Refusal Option shall run for the life of the dog, and may be made null and void only by the express written refusal to exercise the option by Christine Neville, or any representative of Abintra Afortori Kennels, should the dog ever be put up for sale, or offered to another person, whether actual or legal. Owner hereby understands and grants Christine Neville, or any representative of Abintra Afortori Kennels, permission for 'Home Inspections'!
H. Owner agrees that said dog will be trained to no less than Basic Obedience and Socialization by the age of 18 months.
I. owner agrees that each and every breeding made by this dog in violation of this contract wherein a litter is whelped and registered will result in a monetary penalty of $2,000 US, and would make this contract Null and Void.
V. Legal Responsibilities:
A. In the event of transfer of ownership or transfer of interest of said dog from owner, either intentionally or unintentionally with or without consideration, seller's said obligations shall end and owner shall provide that all interest of seller, financial or otherwise, shall pass in full and be legally binding on the subsequent owners of the dog.
B. In the event any legal action is necessary by either owner or seller to enforce the terms of this contract, the prevailing party shall be entitled to recover in addition to any other sums as may be due, the cost of said legal action, including but not limited to a reasonable attorneys fee.
C. Owner agrees to relinquish seller for any legal action arising from the actions of said dog.
D. When you sign this contract, you acknowledge you have read and agreed to the provisions of this contract. This contract is executed in two counterparts with an executed counterpart retained by each party. The undersigned have carefully read the entire contract, and so understand and agree to it's terms and conditions. The written terms of this contract constitute the entire agreement and no other written, verbal, statements, promises, documents or writings shall have any weight or effect upon this contract.
