THIS INDENTURE Made the first Day of February in the Year of our Lord one
thousand Seven hundred and Sixty four Between John Ekman of the Township of
Strasburg in the County of Lancaster and Province of Pennsylvania Yeoman and
Magdalena his wife, Philip Grimm of the County of York and Province aforesaid
Yeoman and Barbara his wife, John Bushong of the said County of York Yeoman
and Jacob Bushong of the County of York aforesaid Yeoman which said
Magdalena, Barbara, John, and Jacob are Children of John Bushong late of Lampeter
Township in the County of Lancaster aforesaid Yeoman deceased of the one part,
and Philip Bushung of the Township of Lampeter in the County of Lancaster and
Province aforesaid Yeoman eldest Son of the said John Bushong deceased of the
other part. WHEREAS as Benjamin Whitmore and Mary his wife, in and by their
certain Indenture bearing date the Tenth day of March in the Year of our Lord
one thousand Seven Hundred and Forty three four for the considerations
therein mentioned did Grant and Convey unto the said John Bushong (deceased) a
Certain Tract or piece of Land Situate in Strasburg Township in the County of
Lancaster and aforesaid containing Six Acres bounded and Described as follows
VIZ: Beginning at an Hickory a Corner of Toris Boughwalter's Land thence by the
Same South Forty two Degrees East Sixty Seven perches to a Hickory thence
North by West by the said Benjamin Whitmore's other Land fifty Seven perches to
a post thence West by South by the London Companys Land thirty five perches
to the place of Beginning with the appurtenances To Hold to him the Said John
Bushong his heirs and assigns forever as in and by the said received
Indenture recorded at Lancaster in Book B page 235 of the Tenth Day of June 1745
Reference being thereto had may appear and Whereas the said Benjamin Whitmore and
Mary his wife, in and by their certain other Indenture bearing date the
Twentieth Day of December in the year of our Lord one thousand Seven hundred and
forty four for the Consideration therein mentioned did Grant and Convey unto
the said John Bushong a Certain Tract of Land situate lying and being in the
Township of Strasburg in the County of Lancaster aforesaid therein bounded
and described as follows North by West one Hundred and Thirty four perches to a
post thence East by North Ninety three perches to a post thence South by
East Two Hundred and Seventy four perches to a post thence North thirty five
Degrees West by the said Toris Buchwalter's land one hundred and thirty perches
to a post thence North Seventy Seven Degrees West by the Same fifty perches
to the place of Beginning Containing one hundred and three acres with the
appurtenances to hold to him the Said John Bushong his heirs and assigns forever
as in and by the same Indenture Recorded at Lancaster in Book B page 235 and
the 10th Day of June 1745 reference thereto being had may appear and Whereas
the said John Bushong died Intestate Seized in fee as aforesaid of and in the
said two above mentioned and Described Tracts or parcells of land leaving
issue the above named Philip Bushong his eldest Son and the said Magdalena the
Wife of John Eckman, Barbara the Wife of Philip Grimm, John Bushong and Jacob
Bushong to and amonst whom the Same Lands descended and came And Whereas at
an Orphans Court held at Lancaster for the County of Lancaster the 6th day of
March 1750/1 Before the Justices of the said Court It was Ordered that the
said Philip Bushong Should on paying or Securing to be paid the respective
shares of the other children of the said John Bushong deceased According to a
valuation made of the same premises in fee according to the directions of the
Acts of Assembly in Such case made and provided as in and before Records and
proceedings of the said Court Reference thereto being had may appear Now this
Indenture WITNESSETH that the said John Ekman and Magdalena his wife, Philip
Grimm and Barbara his wife, John Bushong and Jacob Bushong for and in
Consideration of the Sum of Two Hundred and Forty pounds lawfull money of
Pennsylvania to them in hand well and truly paid by the said Philip Bushong at and
before the Execution hereof in full for their Several and Respective Shares of
and in the premises according to the valuation or appraisement aforesaid (the
receipt and payment whereof they do hereby acknowledge and thereof and of every
part thereof do exonerate release and forever discharge the said Philip
Bushong his heirs and assigns by these presents) have and each of them hath
Granted Bargained Sold aliened released quit claimed and confirmed and by these
presents do and each of them doth Grant bargain Sell alien release forever quit
Claim and Confirm unto the said Philip Bushong his heirs and assigns all
their and each and every of their parts Shares and ..........whatsoever of in to
and out of the said two above mentioned and described Tracts or parcel of
land which to them and each of them descended and Came or belonged at and upon
the decease of the said John Bushong deceased and of in and to all and
Singular the houses outhouses edifices and Buildings thereon erected and being and
all Ways waters Water Courses Woods Underwoods Trees Fences Garden and
Orchards Liberties Priviledges Advantages Hereditaments and appurtenances
whatsoever thereto belonging or in any wise appertaining and Reversions and Remainders
thereof and also the Estate and Estates Right Title Interest Use Trust
property Possession Claim and Demand whatsoever of them the said John Ekman and
Magdalena his wife, Philip Grimm and Barbara his wife, John Bushong and Jacob
Bushong and each and every of them at Law and in Equity or otherwise howsoever
of in to and out of the Same premises and every or any part thereof and
Together also with all Deeds Evidences and Writings whatsoever any ways relating
to touching or concerning the Same TO HAVE AND TO HOLD all and Singular the
said parts Shares and ......... Hereditaments and premises hereby granted and
released formerly mentioned or intended so to be with their and every of
their appurtenances unto the said Philip Bushong his heirs and assigns to the
only proper use Benefit and Behoof of the said Philip Bushung his heirs and
assigns forever at and under the yearly Quit rents due and so become due for the
Same premises to the Chief Lord or Lords of the Fee thereof and the said John
Ekamn, Philip Grimm, John Bushong and Jacob Bushong for themselves severally
and respectively and not one for the other and for their Several and
respective Heirs do Covenant and Grant to and with the said Philip Bushong his heirs
and assigns by these presents that they the said John Ekman, Philip Grimm,.
John Bushong, and Jacob Bushong and their heirs the said parts Shares and
...........Hereditaments and Premises hereby granted and released (or meant
mentioned or intended so to be) with their and every of their appurtenances unto
the said Philip Bushong his heirs and assigns against them the said John
Ekman and Magdalena his wife, Philip Grimm and Barbara his wife, John Bushong and
Jacob Bushong and against all and every other Person and Persons whatsoever
lawfully Claiming or to Claim by from or under them or any or either of them
Shall and will Warrant and forever defend by these presents.
In Witness whereof the said parties to these presents their hand and Seals
have hereto Interchangeably Set the day and year first above Written.

Be it remembered that on the nineteenth Day of November AD 1772
Before me the Subscriber one of his Majesties Justices of the Peace for Said
County came John Ekman and Magdalina his wife in the within Indenture
mentioned and acknowledged the same to be their act and Deed and desired that as
such the same might be Recorded the said Magdalina there unto voluntarily
consenting She being of full age and by me duly Examined the Content thereof being
first made known to her.

The Twenty fifth day of November AD 1772
Before me the subscriber one of his majesties Justices of the Peace for the
said County of Lancaster came William Atlee Esq. one of the subscribing
Witnesses to the within written Indenture and made Oath that he was present and
saw John Busham Jacob Busham Philip Grimm and Barbara his wife Sign Seal Execute
and Deliver the Same that John Barr was also present and Subscribed his Name
as a Witness to the Same and that the names John Barr and William Atlee to
the same Subscribed as Witnesses are the Proper Hand writings of said John
Barr and of this Indenture at the time of Execution thereof
