Street Beat Sportswear's Contractors Threaten Workers' Organization; Tries to Stop Enforcement of Labor Law

Statement of Trinh Duong
Released May 6, 1998

I write this statement after spending hours at the 72nd Precinct filing charges against Feng Chen, Bin Lin and Peter Yan. Today, I will have to go to criminal court to file for an order of protection. I fear for my life; I fear for the safety of those that I love. Yesterday, these three individuals along with Jian Wen Liang orchestrated an attack on me and members of CSWA, one day after workers at Hua Great Procetech & CCY New Worktech factories exposed the cruel conditions that Liang and manufacturer Street Beat Sportswear fostered. I spoke at the press conference on behalf of Chinese Staff & Workers' Association and the 8 workers.

Yesterday, May 5, 1998, Feng Chen, the supervisor of the Hua Great Procetech who has been also named in the suit filed by the Asian American Legal Defense & Education Fund as a supervisor and employer under the FLSA, led approximately 40 people to CSWA's Brooklyn Workers' Center at around 5:15 p.m.

I saw Mr. Jian Wen Liang in his car, NY license R38 6ZZ directly in front of our center. He though his factory supervisors and managers was orchestrating the assault.

Ms. Chen, a man who identified himself as Han Cheng Chou, On-Leong Tong member Peter Yan pushed, shoved, elbowed me and two senior citizens who members of CSWA. One senior Mr. Eddie Dun was hit on the chest, knocked backwards and suffered an asthma attack. The other senior Mr. Yee Thom and I were also knocked backwards. Mr. Peter Yan used the occasion to touch and grab me; I have filed a sexual abuse charge against him and Mr. Yan is to be arrested on sight.

The 40 individuals who charged into our center, blocking our only exit. They surrounded me; Feng Chen pointed at me and told others to direct their anger towards me. Mr. Peter Yan continued to take close-up headshots of me; he along with the Feng Chen continued screaming at me. JoAnn Lum along with others tried to reason with them but the mob of people they brought ignored what we were saying. Only after the police came about 15-20 minutes later could we leave our office.

I asked the officers who arrived at the scene to remove Feng Chen who was directing this mob. I explained to the officers what had happened. The officers helped to get the people who were unlawfully inside our office out.

Mr. Lin Bin lingered even after most of the others were leaving. He pointed his finger directly in my face and said, "I'm going to kill you dead. I'm going to kill you dead. Watch your back. I'm coming back."

Ms. Chen, Mr. Yan, Mr. Lin and Mr. Liang came here yesterday with the intent of hurting us. The attack on me was in retaliation for my support of the Street Beat Sportwear workers. I fear that they will use their ties to the gangs and the On-Leong Tong to carry out the threat they have issued to me.

Last night I could not sleep. I am tired and I am afraid, but I come forward to tell you this today because now I am only safe in the public's eye.

Street Beat Sportswear's Contractors Threaten Workers' Organization; Tries to Stop Enforcement of Labor Law

One day after press conference exposing sweatshop conditions at two Sunset Park Factories, Boss's Agent Points at Organizer and says: "I'M GOING TO KILL YOU DEAD. I'M GOING TO KILL YOU DEAD. WATCH YOUR BACK. I'M COMING BACK."

Press Conference: TODAY, Wednesday, May 6, at 12 Noon Location: Chinese Staff & Workers' Association, 5411 7th Avenue, Brooklyn, NY (between 54th and 55th Sts.)

Chinese Staff & Workers' Association (CSWA) and its supporters will hold a press conference tomorrow, May 6, to denounce manufacturer Street Beat's contractors Hua Great Procetech and CCY New Worktech and their agent who threatened to kill a CSWA organizer because of her role in helping to enforce the labor law and to expose Street Beat's sweatshops.

The Hua Great Procetech employers, Jian Wen Liang and Feng Chen, and their agents Bin Lin and Peter Yan came to CSWA's Brooklyn center on May 5. Feng Chen, Bin Lin and Peter Yan tried to force their way into the center by pushing and elbowing senior members of CSWA. (Peter Yan is well-known as a member of the On Leung tong.) One of the contractor's agents Bin Lin (CCY New Worktech foreman) pointed at CSWA organizer Trinh Duong, and repeatedly threatened to kill her.

What the employers did at CSWA was calculated organized crime. These sweatshop owners have used all kinds of intimidation tactics to prevent the enforcement of labor laws: they retaliated against workers who spoke out against sweatshop conditions; they physically theatened workers-rights advocates.

Last year, CSWA's Manhattan office was firebombed because of the organization's support of the State Attorney General's efforts to enforce labor law in Chinatown restaurants.
