PREAMBLE
We, the Pampango-speaking students
of the University of the Philippines System, in a desire to promote the
spirit of kinship, to consolidate our efforts towards our educational,
physical, and social well-being, and to serve the best interest of our
people, do hereby promulgate this constitution.
ARTICLE I. OFFICIAL NAME, EMBLEM,
MOTTO, CREED, DOMICILE, COLORS
Section 1. Official Name
This organization shall
be known as the U.P. AGUMAN.
Section 2. Official Emblem
(See logo in the mast head).
Section 3. Official Motto
The official motto of the
U.P. AGUMAN shall be "Non Nobis Sola", which means "Not for ourselves alone".
Section 4. Official Creed
The official creed of the
U.P. AGUMAN shall be as follows:
"I believe in truth and
in truth I will walk this earth.
I have faith in man and
mankind I will serve.
I cherish kinship and kinship
will be my way of life.
I will live not for myself
alone.
Forever in the U.P. AGUMAN
I will belong."
Section 5. Official Domicile
The official domicile of
the U.P. AGUMAN shall be in the Diliman campus of the University of the
Philippines System.
Section 6. Official Colors
The official colors of the
U.P. AGUMAN shall be black, blue, maroon, and silver.
ARTICLE II. AIMS
The aims of this organization
shall be those embodied in the preamble of this constitution, which are
as follows:
To promote the spirit of
kinship.
To consolidate efforts towards
educational, physical, and social well being.
To serve the best interest
of the Capampangan people.
ARTICLE III. MEMBERSHIP
Section 1. Definition
All applicants accepted
and inducted after undergoing all the necessary requisites, as set forth
by the Membership Committee shall be known as the members of this organization.
Section 2. Requisites for
Application
Application for Regular
Membership
An applicant to the U.P.
AGUMAN for regular membership, who is presently an enrolled student of
the University of the Philippines in Diliman, should possess at least two
(2) of the following qualifications:
He should be a resident
of Pampanga or Tarlac; or had been a resident for at least one (1) year.
He should be of Capampangan
parentage (i.e. at least one (1) of his parents is one-half (1/2) Capampangan).
He should speak or understand
the Pampango language.
Application for Honor Membership
A candidate to the U.P.
AGUMAN for honorary membership should satisfy the following conditions:
He should possess the qualifications
of a regular member set at Section 2 letter A of Article III. He may be
a student or graduate of any college or university.
He must have been nominated
by at least ten (10) and elected by at least two-thirds (2/3) of all registered
members of the U.P. AGUMAN.
Section 3. Classifications
of Regular Members
All regular members shall
be classified as either registered members or non-registered members.
A. Registered Members
Registered members are those
who have complied with all the necessary registration procedures as set
forth by the Membership Committee. As such, they are bounded by this constitution.
B. Non-registered Members
Non-registered members are
those who, by force of circumstances, cannot fulfill the necessary registration
procedures. They are further classified as temporary or permanent non-registered
members.
a) Temporary Non-registered
Members
Temporary non-registered
members are those who have filed their leave of absence either from the
University or from the organization and those who desire to register again
with the organization as soon as their leave of absence becomes ineffective.
b) Permanent Non-registered
Members (Alumni)
Permanent non-registered
members are those who have left the University for good (e.g. those who
have stopped schooling, those who have transferred to other schools, those
who have graduated from the University.
Section 4. Leave of Absence
A. New Members
New members are those who
have just been accepted and inducted after undergoing all the necessary
requisites set forth by the Membership Committee.
New members are not allowed
to file their Leave of Absence from the organization in the semester following
their application period.
Leave of Absence from the
University shall not be considered a violation of no. 1, letter B, Section
4 of Article III.
B. Old Members
Old members are those who
have been in the organization for at least one (1) semester.
Old members, who have registered
and wish to take a leave from the organization should file a Leave of Absence
with the Membership Committee. Failure to do so will merit an Absence Without
Official Leave (AWOL) status.
A member who has gone AWOL
and wishes to register again will have to through re-instatement proceedings,
which shall be as follows:
His re-instatement should
be nominated by at least three (3) registered members.
His re-instatement shall
be enacted upon fifty percent (50%) plus one (1) vote from the General
Assembly.
Section 5. Charter Members
All signatories of the original
constitution (1973) shall be known as the charter members.
ARTICLE IV. BILL OF RIGHTS
Section 1. It shall be the
right of every member to carry the name U.P. AGUMAN.
Section 2. It shall be the
right of every registered member to avail fully of the benefits a U.P.
AGUMAN member is entitled to.
Section 3. It shall be the
right of every registered member to have equal voting privilege on any
question raised before the general assembly.
Section 4. All questions
pertaining to the preceding section shall be resolved in a manner that
will satisfy all parties concerned.
Section 5. No registered
member shall be collected of fees more than what the organization requires.
Section 6. It shall be the
right of each member to access to the documents of the organization, which
include all official acts, transactions, accounting of funds and minutes
of the meeting.
Section 7. The right to
join other organizations shall not be abridged. However, the U.P. AGUMAN
shall not assume responsibility of the member in such functions other than
those of this organization.
Section 8. No member shall
be suspended, expelled, or condemned to resignation without undergoing
due process.
ARTICLE V. BILL OF RESPONSIBILITIES
Section 1. It shall be the
duty of each member to know and to obey this constitution and the by-laws
of this constitution.
Section 2. It shall be the
duty of each member to uphold, respect, and protect the good name and image
of the U.P. AGUMAN.
Section 3. It shall be the
duty of each registered member to participate and cooperate with the officers
and with all the members in the orderly attainment of all the goals of
this organization.
Section 4. It shall be the
duty of each member to settle all his obligations within the specified
time.
Section 5. It shall be the
duty of every registered member to engage in committee work and participate
actively in the affairs of the U.P. AGUMAN.
Section 6. It shall be the
duty of every registered member to attend the meetings and official gatherings
of the U.P. AGUMAN and propose measures for its welfare.
Section 7. It shall be the
duty of every registered member to perform with the best of his ability
any job that may be assigned to him by the U.P. AGUMAN.
Section 8. The rights of
the individual member impose upon him the correlative duty to exercise
them responsibly and with due regards for the rights of other members.
ARTICLE VI. THE OFFICERS OF THE
U.P. AGUMAN
Section 1. The General Officers
The general officers of
the U.P. AGUMAN shall consist of a President, an Internal Vice President,
an External Vice President, a Secretary, a Treasurer, an Educational Committee
Chairperson and a Socio-Cultural Committee Chairperson.
Section 2. General Qualifications
Only a registered member
with at least one year of membership immediately prior to his assumption
into office can be a president, an internal vice-president, or an external
vice-president. All other positions shall be open to all registered members.
All the general officers
shall not be allowed to hold any major office under any organization.
Section 3. Terms of Office
The tenure of office of
the general officers shall start one day after their induction into office
and end on the day the next set of officers assumes office. No one shall
hold the same position for more than two (2) consecutive terms.
Section 4. Powers and Duties
of the General Officers
The President
He shall be the head of
the U.P. AGUMAN and shall represent it in all its official transactions.
He can send his duly designated representative in his stead if the necessity
calls for it.
He shall be the chairman
of the executive council and shall preside in all its meetings and meetings
of the general assembly.
He shall be responsible
for the annual recognition of the organization from the University.
He shall sign all resolutions,
communications, and papers pertaining to the vital transactions of the
U.P. AGUMAN. Where his signature is not absolutely necessary, he shall
still be informed properly.
Together with the Treasurer,
he shall sign all checks, bills, accounts and annual fund reports of the
U.P. AGUMAN.
Together with the Internal
Vice-President and Secretary, he shall sign certificates of membership,
leaves of absence, and similar instruments.
He shall render a final
report of the problems, accomplishments and recommendations of the Executive
Council or the General Assembly in a meeting called for that purpose.
He shall perform all other
functions as may be entrusted to him by the General Assembly or the Executive
Council.
The Internal Vice-President
He shall act as the President
when the President becomes incapacitated, is impeached, or resigns until
such a time that a new president is elected.
He shall be the chairman
of the Membership Committee and shall function in line with the responsibilities
of the committee.
He shall attest to all certificates
of membership and leaves of absence and all recommendations for disciplinary
action against any member.
He shall preside on all
hearings for disciplinary actions.
He shall perform all other
functions as may be entrusted to him by the General Assembly or the Executive
Council.
The External Vice-President
He shall act as the President
when the President and Internal Vice-President become incapacitated, are
impeached, or resign until such a time that a new president is elected.
He shall be the chairman
of the External Affairs Committee and shall function in line with the responsibilities
of this committee.
He shall act as liaison
officer between the U.P. AGUMAN and other organizations. In his capacity
as liaison officer:
He shall attend personally
or send his duly designated representative in meetings and all other occasions
where the organization is needed.
He shall make regular reports
to the Executive Council and the General Assembly as regards to his liaison
activities.
He shall perform all other
functions as may be entrusted to him by the General Assembly or the Executive
Council.
The Secretary
He shall act as the chairman
of the Records & Publications Committee and shall function in line
with the responsibilities of this committee.
He shall be the custodian
of the seal and records of the U.P. AGUMAN.
He shall record the minutes
of the meeting of the General Assembly and Executive Council and all resolutions
and drafts approved. .
Together with the President,
he shall prepare the annual report of activities of the U.P. AGUMAN to
be presented to the General Assembly.
He shall maintain an up-to-date
record of members and release a directory of all the registered members
of the semester.
He shall act as a historian
of the organization and as such, he shall make an annual review of the
activities of the U.P. AGUMAN.
He shall supervise all U.P.
AGUMAN publications particularly the ASLAG, the official newsletter, and
shall function as the Managing Editor of its Editorial Board.
He shall coordinate all
necessary press releases regarding the organization's projects and activities.
He shall perform all other
functions as may be entrusted to him by the General Assembly or the Executive
Council.
The Treasurer
He shall act as the chairman
of the Finance Committee and shall function in line with the responsibilities
of this committee.
He shall collect al fees
and be custodian of the funds of the U.P. AGUMAN.
He shall take charge of
the safekeeping of the funds of the U.P. AGUMAN and make disbursements
of these under the supervision of the Executive Council.
Together with the President,
he shall sign all checks, bills, and accounts of the U.P. AGUMAN.
He shall render financial
reports at least once a month in one of the regular meetings. Then, together
with the President, he shall prepare the annual financial report of the
U.P. AGUMAN and present it to the General Assembly at the last regular
meeting.
He shall perform all other
functions as may be entrusted to him by the General Assembly or the Executive
Council.
The Educational Committee
Chairperson
He shall act as the chairman
of the Educational Committee and shall function in line with the functions
of this committee.
He shall be responsible
for the enhancement of the academic performance of the members of the U.P.
AGUMAN.
He shall perform all other
functions as may be entrusted to him by the General Assembly or the Executive
Council.
The Socio-cultural Committee
Chairperson
He shall act as chairman
of the Socio-cultural Committee and shall function in line with the responsibilities
of this committee.
He shall be the property
custodian of the organization and shall submit as inventory at the end
of the semester.
He shall perform all other
functions as may be entrusted to him by the General Assembly or the Executive
Council.
Section 5. The Faculty Adviser
The General Assembly shall
elect by a simple majority of fifty percent (50 %) plus one (1) a faculty
adviser for a term of one (1) year. Re-election shall be allowed.
ARTICLE VII. ELECTION AND ELECTORAL
PROCEDURES
Section 1. Date of Election
Election of officers shall
be held one (1) month before the close of the second semester of each academic
year at a meeting called for that purpose.
Section 2. Nomination of
Candidates
Nomination of candidates
shall be held three (3) weeks before the elections. A letter formally accepting
or rejecting the nomination must be submitted by the nominee to the ad
hoc committee formed for the elections not later than one (1) week after
the nomination. Failure to submit aforementioned letter shall be taken
as a formal acceptance of the nomination.
Section 3. Number of Candidates
There shall be only two
candidates per position. If there are more than two nominees for a given
post, there shall be a preliminary election to determine the two (2) candidates
for the specific post.
Section 4. Manner of Election
The elective officers shall
be chosen through secret balloting.
An election may be held
only if two-thirds (a quorum) of the General Assembly is present and/or
represented.
A simple majority vote of
fifty percent (50%) plus one (1) or more of the votes cast is sufficient
to elect all the general officers of the organization.
In case of ties, re-elections
will be done until such time that the tie is broken.
Section 5. Vacancies
Vacancies shall be filled
immediately by special elections the manner of which is similar to that
of the regular elections.
Section 6. The Electoral
Board
The Electoral Board shall
be formed by the Executive Council not later than one (1) week after the
nominations to supervise the elections and ensure honesty and order. It
shall be composed of five (5) registered members chosen from among the
non-nominees, all of which are graduating students, or if in such cases
as the graduating students are not sufficient to form the Electoral Board,
the remaining slots shall be filled by the alumni who shall be determined
by the Executive Council. The members of the Board shall not be allowed
to cast their votes.
ARTICLE VIII. THE GENERAL ASSEMBLY
Section 1. Composition
The General Assembly shall
be composed of all the registered members of the U.P. AGUMAN.
Section 2. Powers and Duties
The supreme authority of
the U.P. AGUMAN shall be vested upon the General Assembly.
Its mandate shall be a final
approval of all contracts, businesses, transactions, and other understanding
entered by the U.P. AGUMAN.
C. It shall elect the General
Officers of the U.P. AGUMAN.
By a two-thirds (2/3) vote
of a quorum, it can reverse decisions or policies made by the Executive
Council or any committee of the U.P. AGUMAN.
D. The General Assembly
shall function through the following committees:
Membership Committee
It shall be headed by the
Internal Vice-President.
It shall be composed of
not more than ten (10) members whom the chairman chooses with the approval
of the Executive Council.
It shall formulate rules
on all programs of activities for the application and acceptance of the
members.
It shall decide on the resignation
of the members subject to the approval of the Executive Council.
It shall hear and decide
cases on disciplinary actions against any member.
It shall be responsible
for undertaking impeachment proceedings, the final decision resting on
the General Assembly.
It shall be charged with
the maintenance of order in all meetings and official gatherings.
External Affairs Committee
It shall be headed by the
External Vice-President who shall choose his members, the number depending
on the approval of the Executive Council.
It shall be responsible
for the affairs of the organization with outside entities, persons, agencies,
and organizations, and shall report to the Executive Council and the General
Assembly all proceedings from these external affairs.
It shall be responsible
for keeping track of permanent non-registered members (alumni) and keep
and maintain an up-to-date directory of alumni members and other contact
persons and entities.
Records & Publications
Committee
It shall be headed by the
Secretary who shall choose his members, the number depending on the approval
of the Executive Council.
It shall function in line
with the Secretary's functions and responsibilities, keep records of all
drafts, resolutions, minutes of the meetings, correspondence, rules promulgated
by the different committees, constitution and by laws, and other pertinent
records and important papers.
It shall publish all write-ups
regarding the U.P. AGUMAN'S activities, compiling all these into an annual
history.
It shall handle all dissemination
of information and publish all write-ups regarding the organization's activities,
compiling them into an annual history.
It shall be responsible
for informing the general Assembly about the regular and special meetings
of the organization.
It shall publish a newsletter
at least once per semester. It shall assemble the Editorial Board from
any of the registered members. Composition of the Editorial Board shall
be as follows:

Managing Editor-(Secretary)
News Editor
Features Editor
Graphics Editor
Contributing Editors
It shall be in-charge with
the task of maintaining orderliness of the AGUMAN bulletin board.
Finance Committee
It shall be headed by the
Treasurer who shall choose his members, the number depending on the approval
of the Executive Council.
It shall function in line
with the functions and responsibilities of the Treasurer.
It shall conduct feasibility
studies on any financial activity that the organization may wish to undertake.
It shall prepare the annual
budget of the organization.
It shall coordinate and/or
take charge of fund-raising projects, solicitations and donations.
It shall see to it that
a standing fund of two thousand hundred (P2,000.00) be available for the
incoming administration.

5) Educational Committee
a) It shall be headed by
the Educational Committee Chairperson who shall choose his members, the
number depending upon the approval of the Executive Council.
It shall function in line
with the functions and responsibilities of the Educational Committee Chairperson.
It shall undertake independent
studies and/or evaluations regarding the existing and/or proposed projects
and activities of the organization for the review and/or approval of the
Executive Council.
Socio-cultural Committee
It shall be headed by the
Socio-cultural Committee Chairperson who shall choose his members, the
number depending on the approval of the Executive Council.
It shall function in line
with the functions and responsibilities of the Socio-cultural Committee
Chairperson.
It shall be responsible
for formulating programs in line with the social, cultural, and sports
activities of the U.P. AGUMAN.
It shall take charge of
procuring and maintaining supplies and facilities of the organization.
It shall be responsible
for maintaining the orderliness of the tambayan and its immediate vicinity.
Section 3. Committee Responsibilities
and Duties
All committees are to initiate
and execute at least one project in their respective fields per semester,
which will promote the welfare of the organization.
Each committee shall meet
regularly at least once a week and report to the General Assembly and to
the Executive Council on its undertakings, plans, progress, and completion.
Ad hoc committees shall
be created by the Executive Council as necessary. Its chairman shall be
appointed by the Executive Council who shall also choose its members.
Section 4. Meetings
The General Assembly shall
meet weekly for its regular meetings. An attendance of two-thirds (2/3)
of all registered members shall constitute a quorum; a simple majority
vote of fifty percent (50%) plus one (1) of those in attendance shall be
necessary for the approval of all contracts, business transactions, and
all undertakings entered into the U.P. AGUMAN. Voting through official
representation will be permitted.
Special meetings may be
called by the President or the Executive Council or upon a petition of
at least one third (1/3) of the registered members and shall have the same
authority and requirements of a regular meeting.
ARTICLE IX. THE EXECUTIVE COUNCIL
Section 1. Composition
The General Officers shall
compose the Executive Council.
Section 2. Powers and Duties
The Executive Council is
the main policy-making body of the U.P. AGUMAN. It shall be responsible
for the formulation of all the organization's policies subject to the approval
of the General Assembly.
It shall confirm all appointments
made.
It shall create ad hoc committees
when the need arises and shall appoint the heads of the said committees.
It shall take charge of
all matters regarding scholarships, citations, and awards to deserving
persons.
It shall approve all cases
of disciplinary actions the final decision resting upon the General Assembly.
Section 3. Meetings
It shall meet regularly
at least once a week. A quorum of five (5) shall be necessary to transact
business and create policies. A two-thirds (2/3) vote shall be required
for approval of any motion. Voting through official representation will
be permitted. Official representation will be counted as attendance to
permit the quorum.
Special meetings may be
called by the President or any two (2) members of the Executive Council
when the need arises and shall have the same requirements and authority
of a regular meeting.
ARTICLE X. TERMINATION OF
MEMBERSHIP AND DISCIPLINARY ACTION
Section 1. Resignations
Resignation of Members
Resignation can be made
any member.
Any resigned member wishing
to return to the U.P. AGUMAN shall be accepted only upon submission of
a formal letter signifying his intention to do so and upon the recommendation
of the Membership Committee and approval of the Executive Council.
Resignation from Office
Resignation can be made
by any officer.
Approval of resignation
shall be a fifty percent (50%) plus one (1) vote of the General Assembly.
Section 3. Expulsion
Any member, by the joint
recommendation of any member and the Membership Committee with the approval
of the Executive Council, can be expelled from the organization for any
of the following reasons:
using the name of the organization
in bad faith
gross negligence of duties
malversation of funds
grave and direct violations
of the constitution
Section 4. Impeachment
An officer of the U.P. AGUMAN
may be impeached for any of the following reasons:
gross negligence of duties
malversation of funds
using the name of the name
of the organization or his office in bad faith
unauthorized and/or unofficial
representation of the U.P. AGUMAN
insubordination
grave and direct violations
of the constitution
A motion for impeachment
may be made by any member to be addressed to the Membership Committee.
The final decision, which shall be made by a two-thirds (2/3) vote of the
General Assembly, is not subject to appeal.
ARTICLE XI. AMENDMENTS
Section 1. Proposals
Any amendment to or revision
of this constitution may be proposed by a simple majority vote of fifty
percent (50%) plus one (1) of the General Assembly or by a two-thirds (2/3)
vote of the Executive Council. The Executive Council upon a simple majority
vote of fifty percent (50%) plus one (1) of the General Assembly may authorize
an ad hoc committee to draft amendments or revisions to this constitution.
Section 2. Ratification
Any amendment to or revision
of this constitution shall be valid when ratified by a two-thirds (2/3)
vote of the General Assembly cast in a referendum which shall be held only
after deliberations on the proposals have been made.
Section 3. Overrule
Any provision in this constitution
may be overruled by a two-thirds (2/3) vote of the General Assembly in
a special meeting called for that purpose.
