Tibo's family to report executions to International Court

Jakarta (ANTARA News) - The family of Fabianus Tibo, one of three death-row convicts executed last Friday (Sept.22) for committing alleged atrocities in the sectarian conflict in Poso, Central Sulawesi, in 2000, are to report their case to the International Court of Justice.

Tibo's son, Robertus Tibo, in the company of his father's spiritual adviser Father Jimmy Tumbeleka, told newsmen here Friday the action would be taken as Tibo and his two associates had been put to deatb illegally.

Robertus said the government's decision to execute Tibo, Marinus Riwu and Dominggus da Silva was illegal because they were not given a chance to exercise their constitutional right to appeal for clemency for a second time as provided for in Law No.22/2002, specifically the law's Article 3 point 2 on clemency.

There had been pros and cons before the execution of Tibo, Marinus and Dominggus. Some wanted the execution implemented soon while others opposed it.

Robertus said since the beginning the executors had been telling the trio's families that they (Tibo et al) were innocent but their eventual action contradicted their own words.

"That's why we feel unjustly treated and have come to the conclusion it is difficult for common people to get justice," he said.

About the execution of Tibo and friends, Robertus said it was done in an inhuman and uncivilized manner and so it was against Presidential Regulation No.2/1964 on procedures to carry out the death penalty.

Father Jimmy Tumbeleka said there was something wrong in the bodies of the convicts like scratchs on Tibo's temples and it seemed that he had a broken rib.

In addition, Tibo's request to be buried in Maumere was not fulfilled, he said. Therefore, Robertus said, he wanted to continue seeking justice through peaceful means without bearing any rudge against anyone.(*)
