Detective Constable Abbott
You are alleged to have committed misconduct in that you did without lawful excuse, disobey, omit or neglect to carry out a lawful order, contrary to section 2(1) (b) (ii) of the Schedule Code of Conduct of Ontario Regulation 123/98 and therefore, contrary to Section 74 (1) (a) of the Police Services Act, R.S.O. 1990, as amended.
Statement of Particulars
Being a member of the Toronto Police Service, attached to the Central Field Command Drug Squad, you, while on duty, on Monday March 02, 1998, were working from 1:00 p.m. to 9:00 p.m.., assigned to plain clothes duty.
At approximately 4:27 p.m., you, along with other members of the Service conducted an investigation into drug trafficking at .... Toronto, Ontario, and subsequently took part in the execution of a search warrant.
Investigation has revealed that at approximately 4:30 p.m., you exited the apartment accompanied by Detective Constable Mark Denton, #3229, of Central Field Command Drug Squad. While entering the elevator, you observed Mr. Pieters walking in the hallway towards the area of the apartment you left.
Mr. Pieters observed Detective Constable Denton watching him and asked you to identify yourselves. At this time Detective Constable Denton identified verbally that you were police officers, however, upon his further request, you failed to identify yourself with your police identification card and badge.
In so doing you failed to comply with Rule 3.1.2., The Rules, Toronto Police Service.
