WHEREAS...Don't Mean SQUAT!


      2nd Amendment to the Constitution:

     "A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed."

     It seems like a simple, straight-forward statement.  A concise declaration that Government must not interfere with the natural right of each Citizen to possess the means of self-defense.

     However, the enemies of freedom have made a big point of claiming that the initial phrase, "A well regulated militia being necessary to the security of a free state", limits the right to bear arms to the militia and does not guarantee it to individual citizens.  This corrupt interpretation of the 2nd Amendment, whether it be innocent or conniving, is anathema to the intent of the Founding Fathers and flies in the face of Reason.

     After a long history of abuse by the English Crown, the founders well knew that the only effective defense against dictatorial Government is weaponry at least equal to Government's weaponry.  In point of fact, "the shot heard round the world" at Lexington Green was a signal to the British that the colonists were 'mad as Hell and weren't going to take it anymore'!  They would not  lay down their arms and bend over to greet the Red-Coats!  Ultimately, the American Revolution won for the colonists the right to be Americans and govern themselves rationally.  No thinking person can believe that the Founding Fathers intended to reserve to Government the very powers which had been used to trample all their other rights!

     But aside from flying in the face of Reason, the mongers of the power-of-the-state theory of the 2nd Amendment deliberately use the "Whereas" clause as an excuse for misinterpreting the entire Article.  The phrase "the right of the people to keep and bear arms shall not be infringed" is crystal clear.  It can admit of only one interpretation.  More importantly, it is the active clause in the Amendment.  It is the only part of the Amendment that is enforceable!

     The "Whereas" clause on the other hand, can have no force at law whatsoever!

     In logical proof of this, consider the following scenerio: John Doe saves a child from a burning building and is highly praised by his fellow citizens.  The Mayor of the Town, always on the lookout for a good sound-bite, pushes an ordinance through the City Council that says: "John Doe, having displayed courage and concern for human life without regard to his own safety, the City hereby declares that April 1st shall forever more be known as John Doe Day and the Mayor shall read this ordinance from the front steps of City Hall at precisely High Noon every year on that date."

     The ordinance is passed, there is much rejoicing, and for several years the Mayor does indeed read the ordinance on the front steps of City Hall at precisely High Noon every year on that date.  It is the Law.  He must do it.  To fail to do it would be a breech of office and a violation of the Law.

     But then, one day it is discovered that John Doe is an axe-murderer, voted for Perot in the last four elections - and had himself committed the arson that set the fire from which he had saved the child!

     Oh, the gnashing of teeth!  The embarrassment!  The injustice of it all!  BUT - the Law still stands.  It still requires the reading of the ordinance on the steps of City Hall.  The fact that John Doe is not the brave hero, but rather a slimy scum-bag is irrelevant.  The "John Doe" phrase of the Ordinance has no effect.  It cannot because it has no force at law! That phrase might as well have declared that the moon is made of green cheese for all the effect it would have!  The only recourse in a civilized, democratic, constitutional society - is to repeal the Law.

     And thus it is with the 2nd Amendment.  The "Whereas" clause can have no force at law, no matter what it does or does not say and any theories as to it's intent are not germane to the issue of "the right to bear arms shall not be infringed."!
