Towards the end of Clinton's first term in 1996, it was disclosed that over 900 FBI background files were requested by someone or some people in the Whitehouse. These included records of high ranking officials from previous Republican administrations. Clinton called the incident "a completely honest bureaucratic snafu," but the White House placed Craig Livingston, in charge of security for the White House, on leave, and a week later he resigned his position. Special prosecutor Starr investigated the matter to determine whether Hillary helped Livingston get this White House appointment and whether White House counsel Bernard Nussbaum covered up her alleged role.

FBI files are routinely requested in the process of clearing individuals for access to the Whitehouse and obtaining security clearences. One area of confusion about this is that the Clinton Whitehouse bypassed background checks for most of its staffers and are now trying to convince the American people that someone thought Bush cabinet members and high ranking staffers still worked in the Whitehouse and needed a new set of background checks! Use of FBI files for purposes other than Background checks for staffers is expressly forbidden by law.

Testimony that those files were reviewed and the information transcribed into computers at the Whitehouse has been given. This is a clear violation of the law above and beyond the fact that there was no legal reason for the Whitehouse to request those files. Some have compared this to the tactics of the old Soviet Empire where citizens lived in fear of the KGB invading the lives of citizens.

It has later been admitted by the Whitehouse that many Whitehouse staffers, including interns had access to those files. Despite this there were no Justice Department charges made. It should be noted that one Nixon staff member had viewed one FBI file, was convicted, and served jail time for the offense.
