The Precedents of Law

March 8th, 2003

Visiting slave rook {Witness} caught outside of Laura and detained secondary to vagrancy (role played being dirty, unkempt, and odoriferous intentionally) Upon cleaning, the slave was found to have stolen a coin purse from a free.

16.  Thievery is illegal and harshly punished. The first offense is punished by an ear notching. For a second offense, the punishment depends on the sex of the offender. Males are punished by the loss of their left hand and both feet. Females are punished by enslavement.

However this law pertains to Frees.  This was not the case here.

54.  Any free person may discipline an insolent or errant slave, even one who is in the least bit displeasing. If the slave is killed or injured, the free person need only pay compensation to the master and only if the master requests such compensation.

Based on said law, the slave was punished, whipped with a gorean five bladed strap whip, and marked with the penalty brand of a thief (all done with the slave's knowledge and without reprisal in ICQ).  The beast was detained until the arrival of her Mistress

Mistress of rook {Witness} arrives in Laura for return of her property.  Negotiations for terms of release ensue.  Based on intent, not effect.  Witness of Kassar DSC was given the option to reimburse 125% of the value of stolen property to get unconditional release of her property.

Argument over the actual no loss of coin was discussed, but it was decided that a criminal should be judged on intent of crime.  For a clumsy murderer still intended to take the life of another, and would be punished accordingly.  The logic will follow for lesser crimes as well.

The girl rook {Witness} was released to Witness for two finely crafted quiva, and the condition that if the slave was caught stealing within the City of Laura or its region again that Witness would receive 3 silver tarsk by Gim courier with no questions asked.  (I.E. The City of Laura takes over all legal rights pertaining to said property). Witness agreed, but declined the acceptance of payment if infraction reoccurs.
