W. F. Cone To William Hooley

Conveyance

The State of South Carolina

Know all men by these presents, that I, William F. Cone in the State aforesaid, planter, in consideration of the sum of twelve hundred and ninety dollars to me in hand paid at and before the sealing of these presents by William Hooley in the State aforesaid (the receipt whereof is hereby acknowledged), have granted, bargained, sold, and released, and by these presents do grant, bargain, sell, and release unto the said William Hooley all that plantation or tract of land situated, lying, and being in St. Paul's Parish, Colleton County, and state aforesaid on the east side of the Edisto River about four miles from Sullivan Ferry, containing twelve hundred and forty six (1246) acres, more or less, said plantation or tract of land having been granted to Bayard B. Davidson by Eliza C. Grimke, special trustee and executrix of the last Will and Testament of Henry Grimke, Esqr., decd and by the said Bayard B. Davidson, granted, sold, and conveyed to James Perry and by the said James Perry to Daniel Willis to title bearing date January 1st 1860, and recorded in Register Office for Colleton County, and by the said Daniel Willis to me by deed bearing date the first day of August A.D. 1870, said tract bearing bounded on the northeast by the public road leading to Beach Hill, on the northwest by a road called the Cane Acre Road, and on the same road last aforesaid, and on the southwest by lands of Benjamin Perry and of the heirs of H. Ewing, and on the southeast by lands of the heirs of H. Ewing and of the Estate of Boone late Sauls as is meanfully shown by a plat hereto annexed, also all that plantation or tract of land situated, lying, and being in St. Paul's Parish, county and state aforesaid, on Beech Hill and a bay called Wolf's Castle, containing one hundred (100) acres, said plantation or tract of land was granted to Daniel Willis on the tenth day of June A.D. 1858 and conveyed to me by the said Daniel Willis by deed bearing date the first day of August A.D. 1870, bounded on the north by lands of Daniel Postell, south by James Perry "Bruner" tract, west by lands of Wilson and Daniel Postell, east by lands of Willis and Perry, on said tracts of land are two dwellings, houses, barn, corn house, five negro houses, about 100 acres of corn and cotton land cleared and under fence, and 300 acres of cleared land,

TOGETHER, with all and singular the Rights, Members, Hereditaments and appurtenances to the said Premises belonging, or in anywise incident or appertaining:

TO HAVE AND TO HOLD, all and singular the said premises before mentioned unto the said William Hooley, his Heirs and Assigns forever.

And I do hereby bind myself and my Heirs, Executors, and Administrators, to warrant and forever defend all and singular the said premises unto the said William Hooley, his Heirs and Assigns, against me and my Heirs, and all and every other person lawfully claiming, or to claim the same, or any part thereof

Know all men by these presents, that I, W.F. Cone of the county of Colleton in the State aforesaid, farmer, in consideration of the sum of eight hundred dollars to me in hand paid at and before the sealing of these presents by Joel West in the State aforesaid, county of Colleton (the receipt whereof is hereby acknowledged), have granted, bargained, sold, and released, and by these presents do grant, bargain, sell, and release unto the said Joel West of the said State and County all that parcel, piece, or tract of land situated, lying, and being in St. Paul's Parish, State and County aforesaid containing thirteen hundred (1300) acres, more or less, and bounded as follows 'to wit' on the north by the road known as the "Cane Acre Road" and lands of Estate of Thos. Gelezer (?), south by lands of Estate of Mitchell, east by the "Beech Hill Club House" road and lands of Estate of Grimke, west by lands of William Mitchell,

TOGETHER, with all and singular the Rights, Members, Hereditaments and appurtenances to the said Premises belonging, or in anywise incident or appertaining:

TO HAVE AND TO HOLD, all and singular the said premises before mentioned unto the said Joel West, his Heirs and Assigns forever.

Perry of St. Paul's Parish in the State aforesaid, in consideration of the sum of three hundred and fifty dollars to me paid by Miles Cone in the State aforesaid, planter, have granted, bargained, sold, and released, and by these presents do grant, bargain, sell, and release unto the said Miles Cone all that plantation or tract of land situated, lying, and being in St. Paul's Parish, Colleton District, containing (248) two hundred and forty eight acres, more or less, bounded southwest by lands of Coln. B. Perry, northeast by lands of Est. Somners Lorette, east by lands of Est. Martin, and more particularly described by a plat made by Thomas P. Cooper, Deputy Surveyor, January 15th 1847,

TOGETHER, with all and singular the Rights, Members, Hereditaments and appurtenances to the said Premises belonging, or in anywise incident or appertaining:

Dalton, Trustees of Shepherd Baptist Church of St. Paul's Parish, Colleton County, all that lot of land situated in the parish, county, and state aforesaid, containing one acre, bounded on the north, east, south, and west by land of Mrs. M.J. Cone, as a plat made by L.A. Strobel, surveyor, will more fully show, bearing date of April 21st, 1885,

Waring Cone in the State aforesaid, (the receipt whereof is hereby acknowledged), have granted, bargained, sold, and released, and by these presents do grant, bargain, sell, and release unto the said M. Waring Cone all that piece, parcel, lot, or tract of land lying and being in St. Paul's Parish, Colleton County, State aforesaid measuring and containing ninety three (93) acres, more or less, and bounded as follows on the north by lands of Perry Tumbleston, on the south by lands of Clark (?), on the east by lands of Mrs. Mary Jane Cone, and on the west by lands of Mrs. Eliza Jane Tumbleston. The above land is received and is accepted by the said Waring Cone as his full and equal share and child's part of the real estate of the said Mary Jane Cone and W.F. Cone.

Cone, in consideration of the sum of seven hundred dollars ($700) to me paid by Mrs. Mary Margaret Moore (the receipt whereof is hereby acknowledged), do grant and release unto the said Mrs. Mary Margaret Moore all that piece or plantation of land situated in St. Paul's Parish, County of Colleton, in the State aforesaid containing one hundred and twenty (120) acres, more or less, bounded on the north, east, and west by lands of Mrs. A.L. Tumbleston, and on south by lands of Charles Tumbleston as a plat drawn by Louis A. Strobel, Surveyor, bearing date of April 21st 1885 will more fully show, and I declare it is my intention to seal, dispose of, and convey this my separate estate, as herein mentioned for my own benefit,

Know all men by these presents, that I, Mary J. Cone of Colleton County and State aforesaid, married woman, in consideration of the sum of two hundred dollars to me paid by G.A. Norwood and company of the City of Charleston, County of Charleston, and State aforesaid, Factors and commissioners merchants the firm of G.A. Norwood & Company consisting of Geo. A. Norwood Jr. and E.L. Wilkins of the City and State aforesaid have granted, bargained, sold, and released, and by these presents do grant, bargain, sell, and release unto the said Geo. A. Norwood and Company all of that piece or parcel of land situated, lying, and being in St. Paul's Parish, Colleton County and the State aforesaid containing two hundred acres and bounded by lands of Charles A. Tumbleston on the north, on the south by lands known as Clarks, on the east by land of same tract belonging to Mrs. M.J. Cone, and on the west by land formerly known as Dily Flodd now owned by Benjamin Stokes as a plat of same bearing date of March A.D. 1892 drawn by Louis A. Strobel, surveyor, will more fully show. This piece of land is part of a tract of land of three hundred and ninety nine acres granted to John C. Wood on the eighth day of September A.D. 1847 conveyed by Wood to Tumbleston by said Tumbleston to James Elzy and by said Elzy to Pinckney Lacy and by said Lacy to Mary J. Cone.

TOGETHER, with all and singular the Rights, Members, Hereditaments and appurtenances to the said Premises belonging, or in anywise incident or appertaining:

Know all men by these presents, that I, Mary Jane Cone in the State aforesaid, a married woman and freeholder, in consideration of the sum of one dollar to me in hand paid at and before the sealing of these presents by Eliza Jane Tumbleston in the State aforesaid, (the receipt whereof is hereby acknowledged), have granted, bargained, sold, and released, and by these presents do grant, bargain, sell, and release unto the said Eliza Jane Tumbleston all that piece, parcel, or tract of land situated, lying, and being in Burns Township, Colleton County measuring and containing one hundred acres, more or less, butting and bounding on the north by lands of Tumbleston and Muckenfus, on the south by lands of Sheppard, on the east by lands of the said Mary Jane Cone, and on the west by lands of B. Stokes. The above land is received and is accepted by the said Eliza Jane Tumbleston as her full and equal share and child part of the real estate of the said Mary Jane Cone and W.F. Cone.

TOGETHER, with all and singular the Rights, Members, Hereditaments and appurtenances to the said Premises belonging, or in anywise incident or appertaining:

Deed

South Carolina

To all whom these presents shall come, I, Mary Cone of the Parish of St. Paul's in the District of Colleton in the State aforesaid, send Greeting, whereas in and by a marriage settlement, duly executed on the second day of May A.D. 1849 between John Cone, of the first part, Mary Miller, of the second part, and Edward D. Hutson, of the third part, it was agreed by and between the said parties, in contemplation of a marriage, then about to be had between the said John Cone and the said Mary Miller, that all the propery, Real and Personal, of the said Mary Miller, consisting of a tract of land situated, lying, and being in the Parish of Saint Paul's, containing six hundred acres, all her household furniture, one mare and colt, three cows and calves, lot of hogs & co. should be conveyed to Ed. D. Hutson, Trustee for the following uses and purposes, to wit, for the use of Mary Miller, until the solemnization of said intended marriage, and from and immediately after said marriage, to permit the said John Cone to receive the rents and profits thereof. And should the said John Cone die before the said Mary Miller, then all said property to rest absolutely in the said Mary Miller but should she, the said Mary Miller, die first, then to such person or persons, as she may direct, and whereas I am desirous that all of the aforesaid property, real and personal, shall, from, and immediately after my decease be equally divided between my children, to wit, Thomas Miller, Daniel Miller, Isaac Miller, Martha Ann Miller, and Lydia Hutson, wife of Edward D. Hutson by nature of the powers conferred upon me by aforesaid marriage settlement. Now therefore know all men by these presents, that I, Mary Cone of St. Paul's Parish in the District and State aforesaid, under and by virtue of the power aforesaid, and for and in consideration of the love and affection which I have and here unto my said children, Thomas Miller, Daniel Miller, Isaac Miller, Martha Ann Miller, and Lydia Hutson, wife of Edward D. Hutson, and in further consideration of the sum of one dollar to me in hand paid have given, granted, bargained, sold, and released, and conveyed, and by these presents do grant, bargain, sell, and release and convey unto the said Thomas Miller, Daniel Miller, Isaac Miller, Martha Ann Miller, and Lydia Hutson, their and each of their Heirs, Executors, Administrators, or Assigns, in equal shares or proportions, all the property, real and personal, covered by the marriage settlement aforesaid, to wit, all that tract of land situated, lying, and being in the Parish of St. Paul's in the District and State aforesaid containing six hundred acres butting and bounding on lands of Geliyer (?) and Branton, and purchased by me from, as also all the household furniture, the mare and colt, cows, calves, & hogs as aforesaid.

TO HAVE AND TO HOLD, all and singular the said real and personal property hereby granted, bargained, sold, and conveyed, and every part or parcel thereof unto the said Thomas Miller, Daniel Miller, Isaac Miller, Martha Ann Miller, and Lydia Hutson, wife of Edward D. Hutson, their and each of their Heirs, Executors, Administrators, or Assigns forever to be equally divided between them provided always and these presents are upon this special trust and confidence, and upon this express condition that they, the said Thomas Miller, Daniel Miller, Isaac Miller, Martha Ann Miller, and Lydia Hutson, their heirs, executors, administrators, or assigns, shall and do permit and suffer me, the said Mary Cone, to have use, keep, possess, and enjoy all and singular the real and personal property aforesaid, for and during the term of my natural life, without paying or yielding up anything for the same, or in respect thereof. And from and immediately after my decease, they, the said Thomas Miller, Daniel Miller, Isaac Miller, Martha Ann Miller, and Lydia Hutson, their and each of their heirs, executors, administrators, or assigns shall or may lawfully have, hold, possess, and enjoy all of said property, real and personal, in the equal shares or proportions as herein after set forth.

Know all men by these presents, that I, Daniel Willis of St. Paul's Parish, Colleton County, and in the State aforesaid, planter, in consideration of the sum of fifteen hundred dollars lawful money of the United States to me in hand paid at and before the sealing of these presents by William F. Cone of St. Paul's Parish, Colleton County and in the State aforesaid, planter, (the receipt whereof is hereby acknowledged), have granted, bargained, sold, and released, and by these presents do grant, bargain, sell, and release unto the said William F. Cone all that plantation or tract of land situated, lying, and being in St. Paul's Parish, Colleton County, and in the state aforesaid on east side of Edisto River about four (4) miles from Sulivans Ferry, containing twelve hundred and forty six acres (1246), more or less, said plantation or tract of land having been lately granted to Bayard B. Davidson by Eliza C. Grimke, special trustee and executrix of the late Will and Testament of Henry Grimke deceased and still more lately granted, sold, and conveyed by the said Beynard B.                             said James Perry unto me the said Daniel Willis as will more fully appear by title bearing date January 1st A.D. 1860, and recorded in Register Mesne Conveyance Office, said plantation or tract of land being bounded on the northeast by the public road to Beach Hill, on the northwest by a road called Cane Acre Road, and on the same road last aforesaid, and on the southwest by lands of Benjamin Perry and of the heirs of H. Ewing, and on the southeast by lands of the heirs of H. Ewing and on the Estate of Boone late Seals as a plat of the same will more fully show,

Know all men by these presents, that I, Adam Miles Cone, for and in consideration of the sum of five hundred dollars to me in hand paid by Gideon Smith, the receipt thereof I do hereby acknowledge, have granted, bargained, and sold, and by these presents do grant, bargain, and sell, all that plantation or tract of land containing seven hundred and forty two acres, more or less, situated in Colleton District on Penny Creek waters of Ashley River bounding on I.M. Crosby's land and on Isham Walker's land and on Benton land and on Jesse Altman's (?) land and on vacant land, and hath such forms as a plat of the same will more fully represent.

TOGETHER, with all and singular the Premises above mentioned unto the said Gideon Smith, his Heirs and Assigns forever.

On hearing the report on the commissioners in this case -- On motion of D.S. Henderson, solicitor for the petitioners, it is ordered that the same be confirmed, that the commissioner execute a bill of sale to Mr. Harrison for the woman Maria and child, that the "Cone Farm" be substituted in lien and stead of said slave, that the balance after deducting the expenses of the petition in this can be put into stock cattle and that the funds be received and disbursed by the trustee and be held responsible for their faithful application. No part of this order to be carried into execution until the trustee shall have given bond with good security to the commissioner (to be taken and approved by that officer) for the faithful discharge of his trust. The penalty of the bond to be double the value of the trust property.

N.
