Descendants of John Benham

The Descendants of John Benham

Generation No. 1

1. JOHN1 BENHAM was born Abt. 1600 in Plymouth, Devonshire, England, and died 1661 in New Haven, Connecticut. Burial: 1661, Wallingford, Conn. He married (1) MRS. JOHN BENHAM in England. She was born 1602 in Plymouth, Devonshire, England, and died January 1657 in New Haven, Connecticut. He married (2) MARGERY ALCOTT, widow of Thomas Alcott

Notes for JOHN BENHAM:

John Benham came to this country in 1630, sailing from Plymouth, England, March 20th, in the "MARY AND JOHN" and landing on May 30th at Nantasket Point. The next day, Capt. Squib put them on shore and left them. With the aid of the planters, they obtained a boat and went up the Charles River to a place called Watertown, Mass. where they landed. They found a neck of land called Mattapan, and named their town Dorchester, Mass., where he was made freeman May 18, 1631, having requested the privilege on the 10th of October, 1630.

In 1639, He moved in New Haven, Conn., with the colony of Eaton and Davenort and became on of the founders of that place. He was listed as head of one of the 70 families that constituted that settlement, with 5 persons in his household and $70. The earliest maps of New Haven show the location of his home lot.

In 1643 he is listed in the group of New Haven planters with a family of five persons. We know that he had two sons who survived and left descendants. He was a brickmaker by trade, the drummer of the town, and the town crier. His duties included calling the people to church, to elections, and to public gatherings.

For some reason, John seemed to get in trouble with the town council about every six months, even though he sat on it as one of the original settlers. The following is a short version of his time line, with some of the case in point from the New Haven Town Records:

1639 - Assigned a 4 acre homelot and a 16 acre outlot as one of the original 70

families of colonists.

Jan. 4, 1643 - Fined 2 Shillings for a defective gun.

1645 - Property / Water dispute with neighbor Eaton over brickmaking – nothing

determined by court.

Apr. 7, 1646 - "A difference betwixt dome of Guilford for whom Mr. John Caffinch

stood plaintiff, and Elias Prkmen of Windor, for whom Bro. Benham stood

defendant, was presented to the court but testimony not being present for

either side, it was recipted."

Jul. 7, 1646 - Fined 1 shilling for a "foule locke".

1646/47 - John Benham informed the courts he was fined for neglecting to warn

David Atwater to watch, fined 5 shillings, reduced to 2 shillings by the court.

1648 - "John Benham was complained of for being absent two general trayning

dayes....Answered that he had many oxen in his corne.....Court orders that

hee pays halfe ye fine for absence which is 2 shillings, 6-d.

May 7, 1650 - "John Cooper complained of a peece of fence which is betwixt Mr.

Malbon, Mr. Gilbert, Thomas Kimberly and John Benham, which lay down

a great part of last summer, though he warned then at least 4 times of it, and

now since May day two lengths of it have bin down againe. The court

ordered that for ye laying down so long ye last summer, they pay 8 shillings

besides 6d, a time to John Cooper for warning them, and that they pay 2

shillings for ye two lengths down now since ye 1st day of May."

March 10, 1650 - Chosen by the town council to be a "Fence Viewer".

Dec. 3, 1650 - Fined 7 shillings for "7 places in his fence defective, not mended,

though he was warning to do it."

Nov. 4, 1651 - "John Benham was complained of becaue he and his sonn were

absent one traying day...For his sonn, ye court passed it by, and for himself,

because he came not in the afternoon, as he might, he is to pay a third

of ye five, which is 20-d."

Feb. 1, 1652 - "John Benham was complained of for absence of traying one day, he

said, he had a kill of Bricks to burne.....and if he had not begun it upon ye

second day, he could not finish before ye Sabbath, upon which ground the

Court passed it without a fine."

April 6, 1652 - "John Benham was complained of, because his fence is defective in

two places, and though he hath bine warned of it, yet hath not mended it,

for which he is fined 2 shillings."

Aug. 7, 1652 - "John Benham was complained of for a defective gunn, he said he

could not get it mended....he has two gunns in good order besides the

defective one, soe it passed without a fine".

July 5, 1653 - "Thomas Nash complained of John Benham's fence....To secure

Thomas Nash from damage, the court must cast a sharp five upon him."

July 21, 1543 - John Benham was complained of the the Townsmen, for bringing in

an impertect note of his rates, last year, and this year, leaving out last year

one mare, and this year one mare, and one horse of two years old."

March 12, 1654 - John retires a drummer and the town agrees to release him from

that duty.

Now, this goes on and on but you get the picture. I found 2 more entries quite interesting though. John's wife died in January 1657, then the entry in the town records shows up the following summer:

May 3, 1657 - " The Marshall had an order to speak with John Benham; as from ye

court, that a woman he bought into the town, from West Chester, (as is said, wife to one Knap in Vergenia) who hath given ofenc here, that she be carried

away by him againe, else he will be lyable to answer to what damage doth

come thereby."

And the last entry that I thought amusing was the following:

June 10, 1658 - "Mr. Tuttle made complaint of unruly doggs, which hunt cattell in

ye night, which was occasioned by biches going to ye dogg, John Benham's

bich was nominated, and he warned to take care of her."

Now, all of this makes John Boy look pretty bad, but apparently this is just the way towns were run in the 1600's, because fhe last entry I list shows him held in high esteem, about 6 months before he died:

April 13, 1660 - A letter to Gov. Winthrop from John Davenport:

" Honered Sir:

I received yours by Brother Benham, whom God preserved from being drowned in his journey homeward, the river by Mr. Yale's farm was swollen high, his wife was fearfull of riding through it God provided an help for her at the instant by a passenger who travelled from Windsor to Branford...To Mr. Crane's whose daughter he had married. He helped sister Benham over a tree, but her husband adventuring to ride through a foot slipped of his horse, so he fell into the water, and his horse as he thinketh, fell upon him or struck him with his foot, for he had a blow to his head, but through the mercy of God, he is now well.."

2. JOSEPH2 BENHAM (JOHN1) was born Abt. 1631 in Plymouth, Devonshire, England, and died 1702 in Wallingford, Conn. or Staten Island N.Y.. He married WINIFRED KING January 15, 1657 in Boston, Massachusetts. She was born Abt. 1638 in Boston, Mass, and died Aft. 1697 in Staten Island, New York.

Notes for JOSEPH BENHAM:

Joseph and Winifred married in Boston within days of his mother’s death in Connecticut, but they moved beck to New Haven where his mother died, and settled in plot 4 of the original town layout in Wallingford, Connecticut. Joseph and Winifred had many troubles throughout their life, such as Winifred being accused of Witchcraft 3 times between 1692 and 1697. The last time her youngest daughter stood accused with her. When suspicions arose yet another time, the family fled to Staten Island New York, in fear of their lives. Winifred and her 13 yr. old daughter who was referred to in trial records as "Winifred Jr.", were the last witch trial to be held in the New England Colonies, in August of 1697.

Joseph seemed to have even worse luck with the town council than his dad, including being publicly whipped. The following is an entry, 1 year after the death of his father that has left me puzzled as to what they did to precipitate this action:

March 23, 1652 - "At a Court of Extraordinary, upon a complaint made to the Governor of Sundry youthes in ye town, that had committed muchwickedness in a filthy corupting way, one with another, they were called before the Governor and Magistrates viz: Benjamin bunhill, Joshua Bradly, Joseph Benham, William Trogridg, Thomas Tutthill, and Thomas Kimberly, they were examined in a private way, and their examinations taken in writing, which were of such a filthy nature, as is not fitt to be made known in a publique way, after which the Courts were called together and ye youthes before them, their examinations were read and upon their severall confessions, the court being met at the meeting house, upon the day above written, sentenced the youthes above named to be whipt publicquely, and whereas John Clark, servant to Jeremiah Whitnell was charged, and questioned by one of them, for some filthy carriag, he denyed, and another in the same company cleered him from that the other charged him with, thereupon he was not sentenced to be corrected publiqly, but the court left it with his master, to give him that correction in the famoly which came forthe against him hereafter, the Court would call these miscarages charged upon. him, to be made again."

Notes for WINIFRED KING:

For more about Winifred King Benham see the History section entitled:

"Winifred the Witch of Wallingford"

Winifred's mother was said to be Mary Hale, twice accused (but acquitted) Witch of Boston, Mass. in 1681 and 1691, who is said to have owned a boarding house and was also accused (though it was never proven) of poisoning her boarders.

11. LANDON J.8 BURCH (ELIZABETH7 BENHAM, JOHN6, PETER5, JOHN4, JOHN3, JOSEPH2, JOHN1) was born August 09, 1801 in Amherst Co., Virginia, and died March 17, 1882 in Knoxville Iowa, Marion Co.. He married MARY ELIZABETH PURSLEY October 16, 1832 in Barren Co. Kentucky, daughter of WILLIAM PURSLEY and NANCY BUCKLEY. She was born January 18, 1811 in Barren Co. Ky., and died January 19, 1890 in Marion Co., Ohio. Both are buried in the Burch Cemetery Plot north of Knoxville Iowa, Marion Co.

Notes for LANDON J. BURCH:

Landon and Mary moved to what is now known as Knoxville in Marion County, Iowa in 1844. The following is an abstract from an article Landon submitted to the "Old Settler's Association" of that county, describing the hardships of being one of the first settlers of that county.

FROM:

THE HISTORY OF MARION COUNTY IOWA

Landon J. Burch, a prominent old settler in the northern part of this township, and still a well-known resident there, was born in Virginia in 1801. He became an orphan early in life and was subjected to many hardships and adventures during a long career of changes of place and occupation, till he finally located here in 1844. In relation to his adventurous experience as a pioneer, we will let him speak for himself, quoting from an elaborate paper, submitted by him to the "Old Settlers Association" of this county.

"I and my brother William shouldered a parcel of provisions, a coffee pot, and axe and a gun, and left Winchester some time in January. We traveled up the Des Moines Valley to White Breast Creek, and there took the claim where I now live for myself, and my brother took that whereon John Fry now lives. We stayed there eight or ten days, made some little improvement, lived in camp and suffered a great deal from cold. During one day of the time it snowed, after which the weather became warm enough for the bees to come out, but still cool enough for some of them to become so chilled that they could not fly far. Then we went bee hunting. Instead of looking up into the trees we traced p the hives by the fallen bees; and by this means we found several swarms, some of them quite rich.

"Then we had plenty of honey, but our bread and coffee soon gave out, and we went to an Indian trader at Red Rock, (or where the town now stands) and got a supply of coffee, meal, and a little whiskey. But the snow was so deep and the weather otherwise so bad, that we could not go on with our improvements; so we concluded to home and move our families up at the earliest practicable time.

"A thaw commenced about the time we started which was about the last of January and continued till the ice broke on the river, and we began to prepare for moving. We had now been several years in Iowa, encountering all the difficulties attending up a newly settled country, and I had spent what money I had brought from Kentucky. Besides improving several lots in Winchester, I had built a small boat on the Des Moines river, with which I had carried lumber from Passmore's mill, on Lick Creek, to Ottumwa, to build the first frame house there and took my part in trade.

"On the 1st of March we loaded our plunder on the boat, at the mouth of Lick Creek, and started up the river. A man named Miles Wilkinson took passage with up intending to take a look at the country, and join with me in building a mill, provided he liked the situation.

"Soon after we got on the way the weather became cold and stormy, and as our boat was an open one, and our children small, we had to camp on shore every night for the sake of fire. Besides, Wilkinson had the ague, and was not able to work the boar more than half the time. In this way we got along very slowly, and were twenty-one days getting to our claims. But here we were at last, with our wife’s and little ones, five children each. Not a neighbor's dog could we hear bark, nor a chicken crew. Wilkinson spent two days in prospecting between where Knoxville now stands and the Des Moines river, and came to the conclusion that the country would never be settled enough to justify the building of a mill, that the toll from all the custom we would get would hardly feed a few pigs. So he went back and built a mill somewhere in the southern part of Wapello County.

"As for Bill and me, we were located, and if we had no kind neighbors to hold friendly conversation with, we had frequent opportunities to listen to the howling of wolves. Yet we were not quite destitute of neighbors. The Jones’s had settled in the timber west of Knoxville; Elian Fuller had made a settlement on White Breast, and Wm. McCord had located between there and Red Rock, and he was my nearest neighbor. Two bachelors living on the river, named Johnson, I also became acquainted with.

"As soon as we got into a shelter brother Bill took my boat and went to work on the river, carrying flour from Meek's Mill, (Bonaparte) to the garrison on "Coon River", where Des Moines City now is. The river was high and my brother worked hard to make even small wages. At the same time I worked about home, planted three or four acres of corn, fixed up my smith tools, did some little jobs in that line for my distant neighbors, and also for the Indians, repairing their guns, ect., for which they paid me punctually with one exception. The children also traded with the Indians in little trinkets, and thereby obtained quite a friendly understanding with them. Both the children and I acquired a knowledge of their language very rapidly; but they left too soon to enable us to become perfect in it, or to make it useful to us.

"The creek was full nearly all summer, and as I had a patch of corn on each side of it, I had to cross pretty often in a little unwieldly canoe. On one of these trips I came very close to losing 2 of my children.

"This was the summer of '44, during the latter part of which my brother Bill moved to his own claim, and we lived about 3/4 of a mile apart. In August, our families all got sick, I being the only well one. We had got our stock up from Van Buren county, during the summer, and when sickness came the care and labor that fell upon my unaided shoulders were enough to have employed three men. Our eldest daughter died after a lingering illness of about 3 months. She died from the want of medical aid and attention, when there was not a soul present except I and my sick family. My wife was unable to turn herself in bed; and as for me, trouble and the loss of sleep had so nearly worn me out that I scarcely knew anything. But for the fact that I was in good health, we must have all perished.

"When I say that my daughter was dying, I went out every few minutes and blew a little tin trumpet as loudly as I could, hoping to attract the attention of someone who might be within hearing. As is happened, a young man named Moyer, was crossing the prairie at day dawn, and hearing the blast, surmised it to be a note of alarm or distress, and came to the house. He and my brother laid out the corpse, and then went abroad amoung our scattered neighbors, who came in and assisted us to bury our child in a tolerably decent manner.

"Having failed, on account of sickness, to make a trip in the fall, our provisions gave out. We had plenty of milk, but no bread. During Sickness and after, I had to beat corn in a mortar and sift it for bread; and now this process had to be kept up until the ice broke out of the river in the spring following. Then I made a voyage to the old neighborhood for a cargo of bread stuff. I shall never forget the rejoicing of the children on our return. Little ones that could scarcely utter their words plainly would cry out "we'll have plenty o'bread now, mother!"

"On reaching Eddyville, during one of these trips, we fell in with one of the agents of the contractor, names Scott, who was there after corn for the garrison at Ft. Des Moines, and who prevailed on us to ship a load to that place, offering a high-price. There was no available means of transporting it by land just then, for the roads were so bad that a team could not draw much more than would feed it for the trip.

"So we agreed to turn back. The weather was good to start with, and if it so continued we calculated to make the trip in eight or nine days. It was important to get provisions enough to last us for that length of time. But after insisting very hard, all the meat we could get were a couple of small thin sides of bacon. We had plenty of tea, and could have supplied ourselves with plenty of molasses, but could procure only one small jug to hold it. Meal we had none to start with, but supposed that when we should reach the horse mill, (or rather ox mill), just above where Coalport now is, we could get a supply. But here we could get only about 3 quarts. We could have got some of our cargo ground, but didn't, thinking we could surely get a supply at Red Rock. But we were again disappointed, for the only eatable thing we could get there was a peck of very small potatoes, and what whiskey we wanted.

"Here, the weather turned cold, and the wind blew so string against us that we had to lay by. It grew so cold that the water froze on our poles, making them so slippery and heavy that we could not use them. And to Add to our troubles, our small potatoes, the only substitute we had for bread, froze and became utterly worthless. We, however, made the best we could of them by trading them to the Indians for maple sugar. And they in turn, made the best of them by thawing them and drinking the juice with much relish.

"Having at last reached the Fort and delivered our load, we started on our return voyage with nothing to ear, hoping to reach Red Rock before we should suffer much. At that time there was but one settlement between the Fort and Red Rock, on what is now called Butcher's Prairie. By the time we reached this point the wind blew so hard up stream that we could make little or no progress, through one hand went on shore with a rope to pull while the others paddled on board.

"The situation was by no means promising, and we were compelled to land an wait for fair weather. So I went to the house to see if I could get something to eat. It was occupied by a man and his wife, whose name I have forgotten. The man was a surly fellow. No dry joke that I could Pass in stating my case, could make him smile, and he looked suspiciously at me and talked as though he thought the whole world was composed of robbers, and that I had come to impose upon him. In reply to my request for4 something to eat, he gruffly said he had nothing for himself. But the woman wore a different countenance, and from her pleased expression I was able to glean a hope. And not only her words but her works soon confirmed it. She said we were suffering and must be fed. So she went out and killed the only chicken she had, and with that and some flour, butter, and milk, she provided us a full meal, cooked. I carried it to the boar, and after our feast, when I returned the vessels, she would receive only the moderate sum of fifty cents. She was truly a sister of charity. Blessed be her memory.

"Next morning the weather was quite calm, and we finished our voyage without any further difficulty.

"Some time in the Spring or Summer of 1845, I commenced building a mill, and in about 20 months began to grind. It was a poor thing. I could not make more than 16 or 18 bushels of meal per day, but every bushel of toll was worth .50 cents, and as many settlers had came into the neighborhood, I got all the grinding I could do. My customers extended twelve or fifteen miles around; and after this there was no scarcity of bread."
