S.L.A.P.P. - STRATEGIC LAWSUIT AGAINST PUBLIC PARTICIPATION
A S.L.A.P.P. suit is a type of threatened or actual lawsuit which big corporations and other big entities use, with which to keep the voices of the little people that speak out against them silent. The one and only purpose of a S.L.A.P.P., is to intimidate and silence through legal threats and maneuverings, the right of an individual or group, to have and use their constitutionally guaranteed Free Speech.
These S.L.A.P.P. suits can be extremely
expensive, time consuming, and mentally draining on the part of someone
that gets served with one of these dirty legal tools. Following, is an example
of a party that has been served with such a suit. You can reach them at
the URL, at the end of their own words:
"I, Ashley Wilkes, author of
Amway Motivational Organizations (AMO's): The Nightmare Builders, have abandoned
cyberspace as my particular vehicle to get the truth out about AMO's. AMO's
are entities LEGALLY separate from the Amway Corporation.
First posted in March of 1996, my web site has been on the internet longer than any site critical of AMO's and/or the Amway Corporation.
Since I was served my first subpoena from the
Amway Corporation on February 10th of this year, I have endured months of
legal maneuvers that I felt were in defense of attacks on my first amendment
rights to free speech, privacy and assembly. However, the concomitant drain
on my emotions and finances has left me no choice but to retreat from the
front lines in cyberspace."

Ashley had a very informative and factual site up on Amway, but as you can see a S.L.A.P.P. suit had the power to shut it down.
This is the type of legal maneuverings that are accomplished by S.L.A.P.P. suits.
In another instance of what a S.L.A.P.P.
can do, an individual had their computer and other material confiscated
by police on October 2, 1999, through a signed court order that was manipulated
by Amway. For specific information about this ongoing matter please contact:

Big corporations and other rich entities have the power to control entire legal departments and/or legal firms. These businesses legal groups usually have several attorneys in them, as well as several individuals of varying and lesser law training.
People like Ashley, and the other above mentioned site critical of Amway, are for the most part usually single individuals without the backing of lawyers and adequate funding, and most have little training in legal matters. By the time these individuals end their current legal battles, they will know legal matters a lot better than before.
The point is this; big corporations and other big money concerns have just that, lots of money, and with that money they can buy themselves a legal department with several of those attorneys, representatives, and legal aids in it. Then they have that legal department and the legal lackeys in it, whose souls they have bought, make life a living nightmare for the little lone person attempting to seek some honorable justice from the that big money concern.
These big corporations and other big money concerns use money and power with which to destroy their opposition, and it makes no matter that their opposition's position may be on honorable and just grounds.
Any legal attempt's or maneuverings of any sort, by Amway, Crawford & Company Insurance Adjusters, or anything and anyone associated with them, to S.L.A.P.P., and/or in any other manner silence Sherwood C. Ensey, and/or otherwise interfere with his First Amendment constitutional right to Freedom of Speech, or the Freedom of Speech of any member of his family, will immediately result in the automatic filing of a counter suit 3 times the size of the S.L.A.P.P. suit.
It is the legal right of New Mexico residents to properly protect themselves against such ill willed and slimy legal tactics as S.L.A.P.P. suits, and New Mexico law has legal guidelines that allows for very liberal counter suits to be filed against those who unfairly interfere with it's residents First Amendment constitutional rights by using S.L.A.P.P.'s or other unwise legal tactics against them.
In New Mexico, there is a very large segment of the population, both in and out of political power, who believe that it is a strong Bill of Rights that best preserves our liberties and rights as United States citizens, both as individuals and as a society.
Fairly &
Honorably Asked of Amway
All that is being fairly and honorably
asked of Amway, is that they acknowledge there is a problem
with the fact that there is no adequate warning, hazard, and precautionary
labeling on its product, Amway Metal Cleaner, and that they correct
this situation immediately in order to protect the safety of the consuming
public that uses Amway Metal Cleaner. A better and improved child
warning label also needs to go on the product.
All that is being fairly and honorably asked of Amway, is for them to put the contents of the Amway Metal Cleaner into a more secure container, and hopefully a container that will more adequately fit what metal cleaner should go into, and that the contents of the metal cleaner is clearly labeled on the container for all to read.
All that is being fairly and honorably asked of Amway, is that Amway notifies the Poison Control Center immediately of what the exact contents of Amway Metal Cleaner is. This is necessary for individuals who get hurt by Amway Metal Cleaner and go to the emergency room, because emergency rooms and the personnel in them need to know exactly what ingredients are in the metal cleaner, in order to give adequate and proper care to that individual.
All that is being fairly and honorably asked of Amway, is that Amway acknowledge the reality of the fact that I was hurt by Amway Metal Cleaner without a warning of any sort. There was no printed warning that Amway Metal Cleaner could hurt me, no warning telling me to wear goggles when using Amway Metal Cleaner, and there was no warning when the inadequate container [tube] that the contents of Amway Metal Cleaner was packaged in, suddenly split open spewing the highly acidic and abrasive content's of the defective container into my left eye and severely burning it.
All that is being fairly and honorably asked of Amway, is that Amway pays my long over due and turned over as a bad debt, emergency room bill, and that Amway clear up the credit record of my wife and I, in regards to the emergency room bill which a defective and improperly labeled Amway product caused. That in addition to that emergency room bill, Amway also owes the Veterans Administration Hospital (US Gov) in Albuquerque, New Mexico, for the medical services they provided to Sherwood C. Ensey for their end of treating the Amway caused medical emergency to Sherwood, on December 15, 1999. And that Amway pay all future medical expenses of Sherwood C. Ensey as outlined in the most recent offer to settle by him.
All that is being fairly and honorably asked of Amway, is that Amway meet the terms of what I consider to be a very modest settlement offer, considering what I have gone through with Amway up to this date, and the risk that Amway Metal Cleaner continues to pose to an unaware public.
The last thing that I asked for from Amway, was for myself, and in todays world you know in your hearts, that I asked for very little compared to the legal judgments juries are handing out these days. A man in New York just sued for $10 million because he was stuck in an elevator for 45 minutes. Based on that, how much do you now consider my case worth? That person only had 45 minutes of torment and agony, with no injury. I have had nearly a year of torment and agony, with an injury, and no end in sight to the torment and agony that Amway continues to put me through.
All that I ask for is the justice, honor, compassion, and integrity deserved as a human being who has been unjustly injured, and unfairly treated by another. Is this to much to expect and ask of Amway and those that run it?
