Many people in the United States continue to believe the popular misconception that Congress is free to propose and establish, whatever laws Congress believes is good for the general welfare of the United States of America, under the last paragraph of ARTICLE I, Section 8. This misconsception is far from the reality of the real truth about what Congress and members of Congress can, and can not do with the Constitution and the Laws of the United States.
"They [Congress]
are not to do anything they please to provide for the general welfare, but
only to lay taxes for that purpose. To consider the latter phrase not as
describing the purpose of the first, but as giving a distinct and independent
power to do any act they please which might be for the good of the Union,
would render all the preceding and subsequent enumerations of power completely
useless. It would reduce the whole instrument to a single phrase, that of
instituting a Congress with power to do whatever would be good of the United
States; and, as they would be the sole judges of the good or evil, it would
be also a power to do whatever evil they please... Certainly no such universal
power was meant to be given them [Congress]. It was intended to lace them
up straitly within the enumerated powers and those without which, as means,
these powers could not be carried into effect."

To Preserve, Protect, Defend, and to strictly Obey the United States Constitution, is the first and most important duty of those that are elected to the United States Congress. This is not an option for members of Congress, it is their absolute sworn and mandatory obligation, and it is to be adhered to without any question or any hesitation.
So what does preserve, protect, and to defend mean, and how are members of Congress to act towards the United States Constitution?
When a member of Congress Preserve(s) the United States Constitution correctly, it means that the member of Congress will keep or save the Constitution from any and all harm or destruction. Member's of Congress are bound by Oath or Affirmation to keep the Constitution in the same state; to uphold, sustain, and to protect the Constitution from any type of alteration or misconstruction which may harm it's 'true' intent and meaning. Members of Congress are to preserve the Constitution, not to abuse or misconstruct it to whatever ends they see fit.
When a member of Congress Protect(s) the United States Constitution correctly, and as it should be protected, it means that the member of Congress will cover or shield the Constitution from any attack or injury, and the member of Congress will do this without any question or hesitation. Member's of Congress will act as if they are the supreme guardian's of the supreme Law, which of course is what the United States Constitution is; the 'absolute' and supreme Law of the United States of America.
When a member of Congress Defend(s) the United States Constitution correctly and like it should be defended, it means that every member of Congress will do everything within their power, and even beyond that, to see to it that the Constitution is shielded against any injury or attack. Member's of Congress will act as lawyer's for the Constitution, and at all times member's of Congress will vindicate the authority of the Constitution, and member's of Congress will uphold or support the Constitution without hesitation, or without question, and all member's of Congress will be ready to defend the Constitution with their own lives if the occasion should ever arise for such a sacrifice on their part.
When a member of Congress gives their constitutional Oath or Affirmation to Support, and therefore, Preserve, Protect, and Defend the United States Constitution, it means that each and every member of Congress will give their total allegiance and total loyalty to performing that duty. Any less than performing that duty, exactly as stipulated and demanded of members of Congress, and it becomes a matter of disloyalty or treachery to one's country, and that is tantamount to performing the illegal act of giving aid and comfort to those who would be the enemy to the true intentions and meanings of the United States Constitution.
In the United States of America the supreme Law of the Land is the United States Constitution, and there is no higher authority or power than the Constitution. Any member of Congress that states or acts otherwise in regards to the power and authority of the United States Constitution, is acting in a 'hostile' manner towards the Constitution.
When any member of Congress acts or behaves in a 'hostile' manner towards the true, and absolute intentions and meanings found in the 'restrictive,' and 'declaratory' provisions of the US Constitution, these actions and acts are to be interpreted as being 'hostile' to the support of the Constitution, and anything that is 'hostile' to the Constitution, is by virtue of those actions, an enemy of the Constitution.
What if a member of Congress disagrees with what is in the United States Constitution; are they free to propose Laws and Amendments which are contrary to the true intent and meaning of the 'restrictive,' and 'declaratory' provisions of the Constitution? The answer is NO; members of Congress are not 100% free to do whatever they like with the US Constitution.
Members of Congress must stay within the limitations of the 'restrictive' and 'declaratory' clauses of the United States Constitution, and in many cases these protective provisions of the Constitution are absolute and totally untouchable to Congress, and members of Congress. This is one of the most important reasons why the Bill of Rights was added to the United States Constitution; to protect the Constitution from abuse and misconstruction by Congress. The opening part of the ratified and accepted United States Bill of Rights [known as the Preamble] makes this fact perfectly clear: "THE Conventions of a number of the States having at the time of their ADOPTING the CONSTITUTION expressed a desire, in order to prevent misconstruction or abuse of its powers, that further declaratory and restrictive clauses should be added: And as extending the ground of public confidence in the Government, will best insure the beneficent ends of its institution." The Preamble is the one part of the United States Constitution most abused and purposely [intentionally] overlooked by Congress and members of Congress. This Preamble to the United States Bill of Rights, up until very recently, has been purposely hidden away from the masses of American people by Congress, and others who are in the United States government.
Why would Congress, members of Congress, and others in the United States government intentionally ignore and hide away the Preamble to the United States Bill of Rights? So that those in power and who would be in power, could do whatever they want to with the United States Constitution, and get away with it, without any argument or protest from the people. Since those in power [like members of Congress] seldom, if ever oppress themselves and their special or personal agendas, then it is only natural to ignore [and hide from the people] those part's of the United States Constitution, which restricts and oppresses the power of those in government.
What are some of the 'restrictive' and 'declaratory' provisions within the United States Constitution, and which of them are absolutes?
1. The guarantee of a Republican Form of Government, and the constitutional principles necessary to carry out that guarantee. This is an absolute part of the Constitution, and has been one of the most heavily attacked and purposely altered by those in power for the last 200 years. So much so, that the guarantee of a Republican Form of Government has become practically and almost, totally null and void. For the guarantee to be valid and in good working order, the guarantee must include Representation and Taxation as put forth in the original Constitution - these are principles necessary for a true Republic, and which no longer exist. The constitutional guarantee also insists that the money of the United States be owned and controlled by the masses of American people, and regulated and overseen by Congress - which it isn't.
2. The United States Constitution, and the laws of the United States in pursuance of the Constitution shall be the highest Authority and supreme Law of the Land. This is an absolute part of the Constitution, and also one of the most ignored by those in Congress and elsewhere in US government.
3. Congress shall make no law which abuses or misconstructs in any manner, the rights and privileges enumerated within the First Amendment, because whatever throws down or interferes with any part of the First Amendment, throws down the whole of the First Amendment. This is an absolute part of the US Constitution, and the 'restrictive' and 'declaratory' opening clause of the First Amendment stating that Congress shall make no law, is one of the most intentionally abused and ignored by Congress, and members of Congress; especially by those who are aligned to the ultra-conservative radical right.
The United States Constitution continues to be the most abused, misconstructed, and improperly supported of the founding American documents, and most of the abuse, misconstruction, and neglect that has been heaped on the Constitution, has been the direct result of numerous radical right Congresses of the United States of America, both past and current.
It is the ongoing abuses and lack of proper support of the United States Constitution by current Congresses, like the 105th through the 107th, which this article is mostly concerned with at this time.
Radical right elements within the United States have through treachery, deceit, and lies, slowly wormed their way into, and taken over the control of Congress. These extremist right wing elements are steadily at work [even now] chipping away, and eroding what little republican principles and rights are left in the US Constitution. Radical right members of the 107th Congress continue to propose and legislate an array of Congressional Bills, which are at their very heart and nature, totally contrary to the proper support, and therefore, preservation, protection, and defense of the US Constitution.
Radical right members of the Congress have, and continue to introduce numerous Congressional Bills which are 'hostile' to the US Constitution; namely to the protections and rights enumerated within the First Amendment. Certain members of Congress continue to propose, sponsor, co-sponsor, and to support Congressional Bills which are 'hostile' to the preservation, protection, and defense, and therefore, the support of the protections, privileges, and rights contained within the First Amendment. [These 'Hostile' Bills can be viewed at The Congressional Watch] These Bills are a direct failure of these members of Congress sworn Oath or Affirmation to support the United States Constitution, and under ARTICLE VI, second paragraph, the Constitution is the supreme Law of the land and because of this one constitutional statement, there is no higher authority of Law then the United States Constitution. This means that the opening clause of the First Amendment is an absolute and unbendable instruction to Congress and members of Congress, and those in Congress who break that absolute instruction are guilty of giving aid and comfort to the enemy, because whatever act or action is 'hostile' to the proper preservation, protection, and defense of the US Constitution, is an enemy of the Constitution. Giving aid and comfort to the enemy, under the power and authority of the US Constitution ARTICLE III, Section 3, is a treasonous act against the United States of America. Hostile acts and actions to the Constitution are worse than internal espionage and selling secrets to foreign interests, because 'hostile' acts and actions to the Constitution undermine the power and authority of the Constitution, and it must be remembered at all times, that the US Constitution is the supreme Law of the Land.
There is also another popular misconception among members of Congress and other's in the United States, that Congress is free to propose whatever Amendments to the US Constitution that it wants to under ARTICLE V. It is true that Congress and members of Congress are free to propose Amendments to the Constitution under ARTICLE V, as long as those Amendments are not targeted at the protections and rights under the First Amendment. The reason for this is simple; the authority and power of the opening clause of the First Amendment to the United States Constitution, supersedes the power and authority of ARTICLE V. This is why they call them Amendments to the Constitution, because Amendments supersede original parts and instructions in the main body of the original US Constitution. If this is not so, then all of the Amendments that have ever been passed and ratified, would have little to no effect, because only the original Constitution would stand as being correct, but that is not the case.
Even with President Clinton no longer in office, powerful radical right members of Congress, like Representatives Dan Burton, Tom DeLay, Bob Barr, and others in both the US House and US Senate, continue their merciless attacks and investigations into the Clinton's, and other influential Democrats. It is easy to see from these continued attacks on Clinton and other powerful Democrats, that all the radical right is really after, is the destruction of any type of opposition to the radical right movement. The destruction of opposition to the radical right is necessary, so that the radical right can solidify it's power and authority over the political machinery of the United States. This is not much different than what Adolph Hitler did right before he and his fascist brown shirt supporters took control of Germany in the 1930's.
There is another interesting point about the radical right and their investigations into Clinton, and other powerful Democrats, which needs to be brought out at this time. Most of these attacks on Clinton center around the Separation of Powers, and the radical rights continued quest to do away with those powers and put the control of US Government under the power and authority of whoever or whatever controls Congress, and not under the supreme authority and power of the US Constitution.
It seems that what really needs to be seriously investigated in the United States, is the money being funneled into elections by the radical right, to elect radical right members to Congress. This radical right money and power is being used to elect members into Congress, who continue to use there Congressional power and authority to propose, sponsor, co-sponsor, and support numerous Congressional Bills, which are 'hostile' to the proper support of the US Constitution. This seems a far more important issue than the relentless pursuit of Clinton and other powerful Democrats. The latter is a witch hunt looking for the possibility of a crime, while the first is a crime; a crime of high crimes and treason against the United States, and against it's Constitution.
The use of radical right money and power to influence an election [and to buy politicians], so that radical right members can be elected to Congress, to carry out an agenda, which is contrary to the proper support of the US Constitution, is a true quid pro quo misuse of power. If the Clinton's and other Democrats are going to be subjected to an investigation for potential violations of the misuse of quid pro quo, then each and every radical right and Republican member of Congress should be subjected to the same type of investigation, and put under the same strict scrutiny as the Clinton's and other Democrats. The situation here, is that the potential violations over quid pro quo against the Clinton's and other democrats is yet to be proven, while the situation over quid pro quo with radical right members of Congress, like Rep Dan Burton, can be proven beyond any doubt.
So, who are the members of Congress that pursue this unrelenting and continual campaign of 'hostile' attacks against the privileges, protections, and rights enumerated within the First Amendment of the United States Constitution? Following is a list of US Representatives and US Senators 'hostile' to the preservation, protection, and defense of the US Constitution. This list was compiled from official Congressional Record(s) at Thomas, which is the record keeping arm of Congress located at the US Library of Congress. [Note: Don't be the least bit surprised to find several Democrats names on this list, up to and including Rep Dick Gephardt. If a Congressperson is not willing to fight the 'hostile' attacks aimed at the US Constitution, and instead are willing to support Congressional Bills that are part of the problem, then these Congressperson's are just as much a part of the problem, as the problem itself.]

The list is a long one, but so are the 'hostile' offenses against the United States Constitution by these members of Congress, who continue to ignore their sworn duty to properly preserve, protect, and defend the Constitution.
The Roundhead Watch asks that all loyal and patriotic American's who care anything about the welfare of the United States, start contacting their member of Congress, and start asking them why they are not defending the First Amendment of the United States Constitution openly and publicly, like it should be done, and why the above members of Congress are not preserving and protecting the US Constitution correctly, as is required of them by ARTICLE VI of the Constitution?
Start asking the media, both local and national, why they are not covering this important issue, and why isn't the media doing there part to help preserve, protect, and defend the First Amendment to the US Constitution? Has selling sensationalism for a few dollars become more important to the media than the truth about protecting our Nation, and our Constitution?
Radical right members of Congress state that they believe in the rule of law and in the United States Constitution, and that they are supporting the Constitution and enforcing it. Then why do the facts clearly spell out quite an entirely different story about what the radical right is really doing to the First Amendment and the US Constitution?
Because of the treachery and disloyalty radical right and Republican Congressional members continue to show towards the US Constitution and the American people, the Roundhead Watch is calling for an immediate criminal investigation into the activities of the Republican Party, the radical right movement and those involved with that movement, and the above members of Congress. And, into the part's these various individuals, groups, and elements have played in sponsoring, co-sponsoring, and supporting Congressional Bills, which have been totally contrary to the proper support of the First Amendment to the Constitution of the United States of America.
The American people have the right to know why members of Congress are not doing everything in their power to support, and therefore, preserve, protect, and defend the First Amendment to the United States Constitution.
America and the American people, are awaiting the investigation and the answer's.
