The Environment (Protection) Act, 1986 :-
This Act has been enacted to supply the deficiencies of the Water Act, 1974 & Air Act, 1981. This Act is the most important piece of legislation which is intended to implement Stockholm Declaration of 1972.
Important provisions of this Act :-
1. Section 3 states the power of the Central Government to take measures to protect & improve environment. Section 5 confers the Central Government to give directions. Section 6 empowers the Central Government to make rules.
2. Section 15-17 provides the penalties under this Act. The punishments provided under this Act are imprisonment for a term which may extend to 5 years or with fine which may extend to 1 lacs rupees. Section 16 provides offences against companies & section 17 provides offences by Government Departments.
3. Section 24 is very important. It states that if any act or omission constitues an offfence under this Act and also under any other Act, then the offender found guilty of such offence shall be liable to be punished under the other Act and not under this Act.
