The National Environment Tribunal Act, 1995 :-
This Act has been enacted to provide for strict liability for damages arising out of any accident occuring while handling any hazardous substance and for the establishment of National Environment Tribunal for effective and expeditious disposal of cases. The United Nations Conference on Environment and Development held at Rio de Jenerio in 1992 it was stated there to develop national laws regarding liability & compensation for the victims of pollution and other environmental damages.
Important provisions of this Act :-
1. Section 3 states about the liability to pay compensation in certain cases on principle of no fault.
2. Section 8 mentions about the extablishment of the National Environment Tribunal.
3. Section 25 states whoever fails to comply with the orders made by the tribunal shall be punished with imprisonment for a term which may extend to 3 years and a fine of 10lakh rupees or both.
