The Wildlife (Protection) Act, 1972 :-
The Wildlife Act & the Forest Act together establish five main categories of protected areas - National Park, sanctuaries, reserved forests, protected forests and village forests.
Important provisions of this Act :-
1. Section 3 states about the appointment of Director & other officers whereas Section 4 states about the appointment of Chief Wildlife Warden & other officers. Section 6 states about the constitution of Wild Life Advisory Board.
2. Section 17 states about restrictions of the hunting of wild animals. But Section 11 states about hunting of wild animals in certain cases.
3. Section 39 - 49 mentions the various provisions relating to trade & commerce in wild animals, animal articles & tropies.
4. Section 50 - 58 mentions about the prevention & detection of offences. The punishments provided are imprisonment for 2 years or with fine of Rs2000 or both. Even anybody abets the commision of any offences under this Act is also punished.
Note :- The Wildlife Protection Act is inadequte relating to the punishments provided. In 1991 significant improvements were made to increase the punishment from 2 years to 3 years and the fine from Rs2000 to Rs5000. However this amount is inadequate when compared to the value of the goods smuggled.
