TORONTO -(Dow Jones)- An international arbitration tribunal has ordered Canada to pay damages of $8.231 million to U.S. company S.D. Myers Inc. as compensation for discrimination against S.D. Myers operating in Canada between 1994 and 1997.
In a news release, S.D. Myers said this award follows the November 2000 Liability Award which found that Canada violated two NAFTA investment chapter obligations when it wrongfully closed the border to the export of polychlorinated biphenyls, or PCB, wastes from Canada to the U.S. in 1995 only to protect the market share of Canadian competitors from US-based competition.
The NAFTA Tribunal found that Canada had discriminated against S.D. Myers as well as finding the Canadian actions unfair, and falling below international law minimum standards of treatment, it said.
Canada changed its own PCB export policy in 1997 and Monday's NAFTA award hasn't resulted in any change to Canadian laws, S.D. Myers said.
The damages award of the NAFTA panel isn't subject to appeal, S.D. Myers noted. A final consideration of costs is now underway before the NAFTA Tribunal.
