Bookings made through Fuerteventura Holiday Homes constitute a contract between the holidaymaker and the property owner or property manager. Any disputes will be resolved between the holidaymaker and the property owner or property manager and will not involve Fuerteventura Holiday Homes whose sole role is to act as advertising agent for property owners.
For Property Owners:
Fuerteventura Holiday Homes agrees to:provide a facility through which you can offer accommodation for holiday letting to Customers via the Fuerteventura Holiday Homes website. This facility shall enable you to offer the accommodation for letting, to accept, confirm, amend, and cancel bookings and to receive and confirm payments, notice of cancellations and amendments from customers. Nothing in this agreement however shall impose any obligation on Fuerteventura Holiday Homes to accept or manage or become liable in any way whatsoever for any bookings on your behalf.
2. The following expressions shall have the following meanings unless the context otherwise requires:-
(1) "Accommodation" means any and all hotels, apartment blocks, apartments, houses or other accommodation building or otherwise occupied by any Customers including the accommodation premises, any swimming pool(s), ancillary building(s), annex(es), all contents, fixtures and fittings, grounds, facilities and services (both inside and outside) available or accessible to any Customers as offered for letting by you.
(2) “the Website” means the website owned and controlled by Fuerteventura Holiday Homes through which you can offer the Accommodation for let.
(3) "Customer(s)" means any and all person(s) who book the Accommodation or any of them or on whose behalf the Accommodation is booked.
Fuerteventura Holiday Homes confirms and agrees that following acceptance of these Terms and Conditions you will be given access to and use of the Website as specified by them in return for payment by you of commission due..
3. Nothing in this Agreement shall prevent the website owners from allowing other persons access to and use of the Website on any terms it sees fit if it so wishes and you acknowledge that Fuerteventura Holiday Homes is entitled to allow persons in direct or indirect competition with you to advertise accommodation on the Website simultaneously with you.
Unless requested otherwise by you all monies collected by Fuerteventura Holiday Homes from Customers and owed to you will only be available for payment to you or your Property Managers.
Accommodation
You agree and confirm the following:-
(1) the Accommodation will be provided with all due skill, care and diligence and that all persons provided or used by you (whether or not employed by you) in connection with the provision of the Accommodation will be appropriately qualified, experienced and capable of competently performing the work or jobs for which they are provided.
(2) the Accommodation will at all times remain of a good and clean standard, in full working order and safe for occupation and use.
(3) the Accommodation complies and will at all times comply in full with all applicable national, local, trade and other laws, regulations and codes of practice (including EU legislation where applicable) relating to hygiene, fire, safety and other standards for those using the Accommodation and that you have and will at all times maintain in force the appropriate current certificates confirming such compliance.
(4) You hold and will at all times maintain all necessary licences, consents and permissions required by applicable national and/or local law in relation to the Accommodation.
(5) You confirm that you own the Accommodation and/or have full and unrestricted power to enter into this Agreement unless otherwise agreed with Fuerteventura Holiday Homes.
(6) You have a duty of care to the holidaymaker up to, but excluding, forces outside of your control.
(7) Acceptance of your property appearing on the Website implies acceptance of the terms and conditions.
For the holidaymaker:
Fuerteventura Holiday Homes acts as an introduction agent for you and is entitled to collect a deposit and any other monies due to the property owner or property manager. It may, at its discretion, offer other services such as airport collection, arrangement of welcome packs, cot hire etc.
Any disputes will be with the property owner and not with Fuerteventura Holiday Homes who will, however, do everything reasonable to resolve any dispute arising from booking through the website.
Fuerteventura Holiday Homes is not responsible for events outside its control.
Apartments, villas and houses are to be vacated by 11am on the day of departure and are normally available at 5pm on day of arrival although this can be earlier if at all possible.
Bookings made through Fuerteventura Holiday Homes implies acceptance of these terms and conditions.
