Last Will and Testament of
Little Berry Janes
I LITTLE BERRY JANES of Adair County and State of Ky. Do hereby make my last Will and Testament in manner and form following that is to say:

1st I desire that all my final Debts be paid.

2nd I give to the children of my daughter
RACHEL SPARKS decd. five dollars.

3rd I give to the children of my daughter
PEGGY GREEN decd. five dollars.

4th I desire that the balance of my Estate Real and personal be valued and divided in the following way:

1st - I give to my son
PRESTON B. JANES one sixth part, he is to have the Land he lives on valued to him as unimproved Land. If it is worth more than his share of my Estate, he must pay to the other heirs the overplus. If it is worth less it is to be made up to him.

2nd - I give to my son
THOMAS M. JANES one sixth part, he is to have the land he lives on valued to him as unimproved Land. If it worth more than his share of my Estate, he is to pay over to the other heirs the overplus. If it worth less it is to be made up to him.

3rd - I give to my daughter
NANCY ENGLAND and my granddaughter NANCY BLANKENSHIP one sixth part of my Estate to be equally divided between them and my daughter Nancy England is to have the land She lives on. Valued to her as unimproved Land, if it worth more than her portion of my estate she must pay over to the other heirs the overplus. If it is worth less it is to be made up to her. My will is if either of the above namd heirs is dissatisfied with the valuation of their Land the Land may be sold and they can have their portion in either proberty or money.

4th - I give my Son
WILLIAM JANES one sixth part of my Estate.

5th - I give to my daughter
SALLY TURNER one sixth part of my Estate.

6th - I give to my Wife
GRACEY JANES one sixth part of my Estate to be hers during her natural life and at her death I will that portion of my estate to my Grandson ANDREW JACKSON JANES. Also I give him one sorrell colt to be his when my Estate is divided.

Now my will is if my Estate cannot be satisfactorily divided among the heirs that the Land & personal proberty be sold and the proceeds of the sale divided among them according to the foregoing provisions of my will.

Lastly I do hereby nominate, constitute and appoint Executor of thie my last Will & Testament in writings thereof I have hereunto set my hand and Seal this February 9th, 1853.

At a County Court began and held for the County of Adair at the courthouse in Columbia on Monday the 5th day of December 1853, an Instrument of Writing purporting to be the last Will & Testament of
LITTLE BERRY JANES decd. which was produced at a former term of this court; and partly proven and filed, and continued until this term to be fully proven, was this day fully proven by the Oath of RICHARD P. BREEDING a subscribing witness to said will, and the same is produced to be recorded; and it appearing to the satisfaction of the county that GRACEY JANES the widow and relict of said decedant relinquishing her right of administering on her deceased husbnds estate; One the motion of FRANCES M. BREEDING the administration of said decedent Estate is granted him , with the will of said decedent annexed, he having taken the oath required by law & executed & acknowledged bond with JAMES BREEDING his security, Conditioned as the law directs.
