Thomas Hudgens Cumberland County, Virginia Chancery Court Record 1847-005 Bill of Complaint by Daniel Martin and Elizabeth his wife, Thomas H. Hudgens and Frances Hudgens against Poindexter P. Smith the Commonwealth of Virginia, To the Sheriff of Cumberland County Greeting. Whereas Daniel Martin and Elizabeth his wife, Thomas H. Hudgens and Frances Hudgens, heretofore exhibited to our Circuit Superior Court of Law and Chancery, directed by law to be holden for the County of Cumberland, their bill of Complaint against Poindexter P. Smith adminr' of Thomas Hudgens dec'd, Albert Hudgens, George Dowdy and Jane his wife, Robert Hudgens, James F. Hudgens, Henry Bagby and Susan his wife and Benjamin Hudgens - Whereupon sundry proceedings have been had, as appears from the records and files of the said Court, but before a final decree could be pronounced in the cause the said Poindexter P. Smith departed this life, having first made his last will and Testament in writing, and therefore appointed Martha J. Smith Executrix, who hath taken upon herself to ____ of the Execution thereof, and the said Daniel Martin and Elizabeth his wife, Thomas H. hudgens and Frances Hudgens having supplicated us for a proper remedy in this behalf; and we being willing that what is right and just should be done. Therefore, we command you that you make known according to law to the said Martha J. Smith, that she be before the Judge of our Circuit Superior Courts of Law and Chancery at the Court-house of said County, in the first day of March term next, to shew, if any thing for herself, she have or know to say, why the said suit should not be proceeded into a final decree against her in her character aforesaid, and be in all things in the same plight and condition as it was at the time of the decease of the said Poindexter P. Smith, and further to do and receive what our said Court shall in that part consider. And have then there this writ Witness John Daniel Clerk of our said Court at the Courthouse this 26th day of February 1846 in the 70th year of the Commonwealth
