Bill of Complaint, call for settlement of Accounts for Thomas Hudgens estate and division of the estate between the Heirs of Thomas Hudgens.

To the Hon. Daniel A. Wilson judge of the Circuit Superior Court of law and Chancery for the County of Cumberland respectfully complaining sheweth to your honor your orators and oratices Daniel Martin and Elizabeth his wife (formerly Hudgens) Thomas H. Hudgens and Frances Hudgens that sometime in the year [blank!] Thomas Hudgens died inteste in the County of Buckingham being possessed of a considerable personal estate and leaving the following children his lawful heirs and distributees to wit Your orator Thomas H. Hudgens and your oraticees Frances Hudgens and Elizabeth Hudgens who intermarried with the said Daniel Martin, and Albert Hudgens, Jane Hudgens who intermarried with Goerge W. Dowdy, Robert Hudgens, Susan Hudgens, who intermarried with Henry Bagby, Benjamin Hudgens and James F. Hudgens. On the 9th January 1837 the County Court of Buckingham upon motion permitted Poindexter P. Smith to qualify as Admin of the said Thomas Hudgens, dec'd who gave as his securities the said Albert Hudgens, George W. Dowdy, Robert Hudgens, Henry Bagby, Benjamin Hudgens and James F. Hudgens which S___fully appear on the records in the Clerk's office of the County Court of Buckingham, a set___ of which duly certified by the Clerk and haven it filed and prayed to be taken and considered as a part of this bill. [one sentence not included, hard to read] On the 11th January 1837 there was an inventory and appraisement duly made and certified, which was at sometime thereafter returned and by the County Courts of Buckingham intended to received. But there has been no settlement of the accounts of Poindexter P. Smith as Admin of Thomas Hudgens, dec'd before any commission or commissioners appointed for that purpose by the Court of Buckingham County, or by the court of any other county; neither has there been any settlement of his accounts with parties entitled to the assets nor any references to a commissioner in Chancery for settlements in any pending suits; whereas the saidPoindexter P. Smith has forfeited his commissions in the administration of the estate of Thomas Hudgens dec'd according to the statute in such case made and provided. In as much as your orators and oratrices are wholly remediless except in a court of chancery when such matters are properly cognizable they respectfully petition your honor to requier a settlements of the administration accounts of Poindexter P. Smith admin before the commissioner of this court and a preport of the same; that the unadministered assets amy be distributed among the heirs abd distributers of Thomas Hudgens dec'd as they are legally entitled to the same: thus Poindexter P. Smith, Albert Hudgens, George W. Dowdy and Jane his wife, Robert Hudgens, Henry Bagby and Susan his wife, Benjamin Hudges and James F. Hudgens may be made parties defendants to this Bill and required to answer the allegations herein contained upon oath. That your honor will grant suchthis and further relief as from the premises may seem just smf equitable and your orators and oratrices as in in duly bound will ever prays
