In the Name of God Amen, I James Hudgins of the County of Cumberland Being in Strong mind and good ____ do make this my last will and testament and measurement of form ___, that is to say, In the first place I recommend my soul to God who gave it and my body to be buried by my dear wife, Item 1st, It is my will and desire that my executor hereafter named shall sell as much of my perishable property as will pay all of my just debts The balance of my estate I give the following____ 1st I give to my son John Hudgins two ewes to him and his heirs and assigns forever 2nd I give to my son Thomas Hudgins one bed and furniture to him his heirs and assigns forever, 3rd I give to my son William Hudgins one bed and furniture to him his heirs forever 4th I give unto my grandson William Hudgins son of John one bed and furniture to him his heirs forever 5th I give unto my Grand Daughter Sally L. Hudgins one red heifer to her her heirs and assigns forever 6th my will and desire is that the balance of my estate be equally divided unto three parts giving one third part to my son Johns children to be equally divided among them their heirs and assigns forever and I do hereby appoint William Hudgins my Grandson and son of John as Guardian for them and Trustee for their several Legatees 7th One third part I give too son Thomas Hudgins to him his heirs and assigns forever8th and the balance that is one third part to my son William Hudgins his heirs and assigns forever And lastly I do hereby constitute ordain and appoint my son Thomas Hudgins of this my last will and testament hereby revoking all former wills and testaments by me heretofore made In Witness whereof I have hereunto set my hand and affixed my seal this 18th day of October one thousand eight hundred and twenty two

At a Court held for Cumberland County the 28th day of April 1823 This Last will and Testament of James Hudgins dec'd was presented in Court and proved by the oaths of William Flippen and John Flippen two witnesses thereto Ordered that the cause be recorded, On the ____ of Thomas Hudggins executor in said will named who with John Hudgins and Robert Scauggs[?] his securities interest unto and acknowledged their bond for the purpose in the penalty of five thousand dollars ___ and according to Law and took oath requested by law ____ for obtaining a probate thereof in this form is granted therein
