This Indenture made entered into This 21st day of Spetember 1830 Between James Hudgins of the first part Thomas Booker of the second part and Samuel Hatcher of the third part Witnesseth whereas the said James Hudgins is justly indebted to Samuel Hatcher as per bond bearing even date with this deed to which the said James Hudgins is calling and desirous effectively to secure now this indenture Witnesseth that the said James Hudgins for and in the consideration of the premises as also for the further consideration of one dollar cash in hand paid by the said Thomas Booker before the sealing and delivery of these presents the receipt whereof is hereby acknowledged he the said James Hudgins hath this day grant bargain and sell and confirm to the said Thomas Booker his heirs and assigns forever a certain tract or parcel of land 12 3/4 acres adjoining the lands of Wm Flippen and Wm Hudgins with all and singular the appurtenances to the tract of land in any wise appertaining and all the estate rights title and interest of the said James Hudgins in the said granted or intended to be granted tract or parcel of land and premises to have and to hold the said hereby granted or intened to be hereby granted tract or parcel of land and premises with the appurtenances unto the said Thomas Booker his heirs and assigns forever and the said James Hudgins doth ___ commend ___ and agree to and with the said Thomas Booker his heirs and assigns in manner inform following that to any ___the said James Hudgins the aforesaid tract or parcel of land and premises and appurtenances afreosaid unto the said Thomas Booker his heirs and assigns against all persons whatsoever shall ____ warrant forever defend by these presents upon tract nevertheless that the said Thomas Booker and his heirs shall presnt the said James Hudgins to remain in quite and peaceable possession of the said tract of land and premises aforesaid and take the profits thereof to his own use until default be made in the payments of the aforesaid of money heretobefore mentioned either in the whole or in part and this upon further trust that he the said Booker shall and will as soon after the happening of such default of payments of the sum of maney as he the said Booker may think proper and sai Sam Hatcher request sell the said tract of land and premises to the highest bidder for ready money first giving twenty days notice of the ____ time and place at the trustee ___ discreation but should the said James Hudgins pay off the debt ___ and interest so that no default be made then this Indenture to be nul and void also to remain in force and virtue as witness hand and seal the day and year forst above written

At a Court held for Cumberland County the 27th day of September 1830 The foregoing deed of Trust was presented in Court and acknowledged by James Hudgins a party thereto to be his act and deed Thereupon to same was ordered to be recorded.
