BOARD HAS TO RESPOND TO ALLEGATION OF
VIOLATING FLORIDA LAWS
The Department of Business and
Professional Regulation, Bureau of Condominiums has written the Board of
Grand Vista a letter, dated July 31, 2002 requiring the Board President,
Jose Maurelo to reply to four allegations that the Board has violated the
laws of the State of Florida (Florida Statutes). The statutes and
details of these allegations are listed below:
1.) Section 718.112(2)(c) of the Florida
Statutes, it is alleged the Board of Directors failed to give 14 day
notice of the Special Assessment meeting of May, 2002 to the property
owners. Furthermore, the Association failed to set any previous
meetings to speak about the Special Assessment.
2.) Section 718.111(12)(c) of the
Florida Statutes, it is alleged that the Board of Directors failed to
provide a unit owner (or a group of unit owners) with the requested
documents. Specifically after an appointment was scheduled to review
the Official Records of the Condominium, and several written requests to
inspect, the documents are still in the care of Tower Management Services
Inc.
3.) Section 718.112(2)(d)3 of the
Florida Statutes, it is alleged that the Board of Directors failed to send
out first notice of election and annual meeting. Specifically it was
alleged that the Association failed to schedule the 2002 elections and
annual meeting on the designated date of May 1, 2002.
4.) Section 718.111(13) of the Florida
Statutes, it is alleged that the Board of Directors failed to provide unit
owners with the 2001 financial report. Specifically, as of May 1,
2002 no report has been given to the unit owners who have requested this
information.
Jose Maurelo and the Board of Directors
have been asked to respond to the Department of Business and Professional
Regulation about these allegations by August
15, 2002. If you have
