One might even come to the conclusion that the majority of ‘federal’ laws put into effect by the government are unconstitutional when imposed on the sovereign states and, therefore, in need of repeal. The reality is most federal laws should only be imposed on residents of the District of Columbia and those who have residence on federal government property (including residency in the possessions).
Furthermore, most laws are written in such a devious, confusing manner that, if it were enforced, most would be null and void due to vagueness. (An article will follow concerning this, in particular Supreme Court rulings on the meaning of vagueness.)
Let’s take one series of unconstitutional legislation. The Declaration of Independence is 1,337 words in length, roughly the length of this article when it is finished. But the massive legislation under consideration is over 7,000,000 (another source stated 2.8 millions) words long now and growing every year. Whether it is 2.8 million or 7 million or some figure in between, the fact is most of the words are meant to deceive.
One hundred percent of the Declaration was applicable at the time of its writing while very few of the words being ‘applied’ to American citizens is constitutionally legal. You see, while truth is being spoken or written, one may be simple and direct. However, when one is defrauding, one of the easiest means is to confuse and distort meanings so that misrepresentation is much easier to accomplish.
Thus, the documents that are most dear to us, The Declaration of Independence and the Constitution of the United States of America along with its amendments are simply written and direct. Truth has nothing to hide plus the intent of the founders was to make sure citizens could read and understand the documents.
Not so the laws dealing with the fraud we call INCOME TAX. The intent of the federal, state, and local governments is to defraud people concerning directly taxing earnings and property. Thus, it now takes millions of words with very, very few actually legally requiring citizens of the 50 states to pay direct tax on their incomes or property.
Now, this may not be stated exactly legally correct. So, let me state this: If you are a citizen of the 50 states and do not have an income from a foreign source in excess of $70,000 per annum ($76,000 for the year 2000), you owe exactly zero tax.
In the case of having foreign income, the sole purpose of the 1040 form for a citizen of the 50 states is to figure any tax owed in association with Form 2555 (used to report earnings from a foreign source). Otherwise, as a citizen with domestic earnings only, you do not have to file a 1040 and you actually perjure yourelf by doing so.
So, essentially, the entire code is being applied unconstitutionally to the people of the sovereign states rather than only applicable sections being applied. After studying this to great length and with increasing anger and frustration, it led to considerations of other matters in which the government exceeds its limitations and violating the sovereignty of the 50 states.
One matter brought to mind immediately is the obstruction of justice that is done by the Justice Department itself. Justice would require the government itself not violate the Constitution and the rights of man. However, it does allow it and often works so as to totally distort justice. Ask the thousands who have had property seized by the IRS. Absolutely in violation of justice and the code itself while criminal in nature. Thus, pseudo ‘justice’ is administered since it most often suits the government’s purpose.
Then, there are the judges in federal courts (and other levels) who respond to dictates of the government. Any judge who has ever ruled a citizen of this country (discounting foreign earnings as above) owes the IRS anything has made an decision against the Constitution of the United States of America AND rulings of the Supreme Court of the United States. Again, not justice but simple theft (for which the judges are rewarded if sources are correct).
In accomplishing its intent, the government has also created special offices to carry out its dictates. The Internal Revenue Service of Puerto Rico (or the Philippines) is a trust established to collect due taxes from the residents of the District of Columbia, the possessions, federal properties, and those due on imports, not the citizens of the 50 states making up the union (unless, of course, they have income from a foreign source in excess of $70,000 per annum). However, it is now carrying out illegal dictates of the government through the Code by applying it against the citizens of the states.
Then, the is the Bureau of Alcohol, Tobacco, and Firearms (actually one and the same as the Internal Revenue Service according to knowledgeable sources, including government records).
Where in the Constitution does it state the government has the duty of controlling alcohol, tobacco, and firearms?
In which constitutional article is it stated you may not grow tobacco, produce alcohol, or own as many firearms as you want in the Constitution? Or, amendments.
It isn't stated. The truth is government wants to control alcohol and tobacco for the taxes that it might be able to impose on them. If a person manufactures any of these items and sells them within his own state, there isn't any federal tax that may be imposed on them. As an example, Al Capone wasn’t convicted for avoiding income tax; he was convicted for evading excise tax due on alcohol being imported from Canada.
The government also keeps a standing army which has been used against citizens of this nation, including Kent State, Waco, and anytime troops have been used to control citizens and their movements. The army under these conditions actually superimposed itself over civil power. And, in doing so, a number of rights of American citizens were violated.
Plus, it is fairly common knowledge that police are being trained as soldiers, not as peace officers. Many, such as SWAT teams, are soldiers trained to invade and kill when deemed necessary by them and are not simply police officers.
The IRS, DEA, CIA, FBI, and others have their own little armies not to be used so much against foreign invasion but against citizens. Far too often, the actions of these ‘armies’ have been taken against citizens innocent of any wrong doing.
And these government terrorists get away with it. HOW? The government protects those law enforcement army types who have attacked innocent people, their homes or taken their lives or violated other rights by saying the 'agents' were just doing their jobs.
I have yet to read of one case in which a law enforcement officer was convicted of murder or even manslaughter after shooting and killing an innocent person. More times than not, the offending officers are given suspended duty with pay. Wow, some punishment for terrorizing and/or killing citizens.
Thus, in a very real sense, we have standing armies amongst us, whether we are close to a military base or not. It is an army that will do the government’s bidding whether legally or constitutionally correct.
Now, the government is controlling most trade, whether it be farmer to consumer or trade we have with foreign countries. And, it is attempting to control it even further with the WTO. Soon, any business will have to have a license to sell any product or trade it for another’s product. Hey, wait a minute - the government IS requiring business licenses to trade one’s goods or skills to others in order to obtain either money or goods in trade.
Certainly, government has imposed many taxes on us (including the income tax discussed above) without our consent. Auto registration, driver’s licenses, building permits (government hasn’t any right to tell you what to build on your property), city stickers, and so on. All are a means, along with many other examples, of taxing citizens without their consent, of controlling citizens rights to pursue happiness and enjoy his own gains through his own efforts.
Then, there is the problem of being deprived of a trial by jury. Not only that, but in government seizures, the rest of the 5th, along with the 10th, and 14th Amendments are also violated. The IRS does so on a regular basis plus uses government armies (usually US Marshals) to accomplish it in many cases. Due process is out the window when it comes to many actions of the government against citizens.
There are people, completely innocent of any crime, who are railroaded by the government and its special offices in order to cover up government wrong-doings. Charges are fabricated as is evidence. This, as is witnessed by the Los Angeles Police Department, is not limited to federal government but to lower governments and their agencies as well.
Consider this. This government ‘owns’ possessions which is absolutely contrary to the principles this nation was founded on. That aside, though, there has been arbitrary legislation passed to govern the possessions. Then, after establishing the legislation, it was expanded to apply through very deceitful, tricky wording to the states making up the union. The same rules applying to the residents of the District of Columbia, federal properties, and the possessions are treated, through great distortion of facts, as also applying to the people of the 50 states.
The Congress and offices of government have assumed the role of absolute legislation and, in a sense, is waging a war against the Constitution and the liberties of the people of this nation. Hundreds, perhaps thousands of lives, have been ruined in the process to date and there will be many more thousands ruined in the future if its tyrannical pursuits are allowed to continue.
People, as in Waco, have been executed by government forces. Or, a better word - MURDERED. Innocent people have been murdered in their homes. Government agencies with guns and other weapons act so as to terrorize people into submission and to voluntarily (actually coerced) complying with unconstitutional laws.
Foreign mercenaries have been hired, especially in the world of drugs and CIA activities. Hit men, mercenaries of sorts, are hired regularly by the CIA and FBI to take out those targeted for termination. This was vividly made known by further investigation of Waco and Ruby Ridge.
Any who attempt taking action against the government are often targeted for terroristic actions unworthy of a civilized nation. Computers and other communication systems are monitored by the government in keeping track of people who are in opposition to government actions. Computers along with other records are seized illegally. Friends of those who act against government are harassed. The atrocities go on and on.
Doesn’t sound like this should be the United States of America, does it? Well, in a sense, it isn't. You see, the Declaration of Independence stated the exact reasons for the colonies declaring themselves independent of England. The above is written from those reasons put in modern context and reflects the reasons the people of the colonies initiated war by declaring their independence from the most powerful monarch and nation on Earth. The outcome, after much sacrifice, blood, and loss of life, resulted in this nation being founded.
Maybe it would do well for this nation if all the people who can read would read the Declaration of Independence again and again, and read it to those who cannot read until all knew it by heart.
And, then follow this procedure with the Constitution.
And, then work together to fill the government of this Republic with people who understand and defend the Constitution rather than putting those who have, or will, rape it repeatedly.
Otherwise, this Republic is lost as a Republic and we, the American people, will be no better off than our forefathers were prior to the Revolutionary War.
And, that, Ladies and Gentlemen, with the level of intelligence we have in this nation, with the mass communication we are capable of, would be a sad state, indeed, to leave future generations in.
