The Myth of Constitutional Rights


We in this nation of states joined as a Union do have a written Constitution guaranteeing us specific, unalienable, God given rights. In the document is also stated specifics of law that may not be affected by Congress, nor by the majority. It is the highest law of the land - or supposed to be, anyway.

This document in its simplicity protects the rights of the individual and outlines specifically the power of government, the power of the people. In regards to this, the government must always remain subservient to the people.

So, just what the hell gives?

The Constitution states quite simply that no citizen of any state may have earnings directly taxed. Furthermore, the Supreme Court has upheld that the 16th Amendment did not give any additional powers to Congress to directly tax citizen’s earnings. USC 26, Subtitle A clearly states ‘persons’ taxation of this nature may be applied to and it is not your earnings or mine as citizens domestically earning money by working a regular job.

No citizen has to have a social security number nor does any citizen have to allow money to be withheld as social security. The W-4 is used by a citizen to effectively volunteer for the system, a system that, in reality, is fraudulently presented to the American people. It is a Ponzi pyramid scheme people have been duped into becoming part of. The W-4 has absolutely nothing to do with code defined federal income taxes (as commonly thought of) and the Constitution still prohibits directly taxing citizens domestic earnings, whether they be wages, tips, salaries, or whatever. (By the way, for you waitresses, tips are gifts and, as such, are not ‘income’ just as Christmas or Birthday gifts are not considered as such.)

So, why in the devil is Wal-Mart Stores, Inc. (the firm I work for) taking my money I have earned in a trade of my property (my labor) for theirs (my earnings)? Rights may not be taxed, only privileges granted by government, such as foreign corporations and aliens earning an income in this country or citizens having income in excess of $70,000 from a foreign source with who we have a tax treaty.

Ignorance of the law, and perpetuation of the myth is how. The legal department only goes by what it believes, not by what is written. It uses the same misinterpreted phrases as does your local CPA or IRS representative and the facts ignored, including very important definitions included in different sections of the USC.

I never signed a W-4 which is the only authorization a firm may have to have any of my money earned withheld as tax. But it is not federal income tax per se; it is employment tax as applied to social security. When one signs the document ‘under penalty of perjury’, one essentially commits perjury.

But, did the legal department of Wal-Mart research the validity of my statements sent them? No, (or if they did, they seriously misinterpreted the Constitution, the many US Supreme Court rulings, and USC 26, Subtitles A and C) because they believe the myth of income taxation on our earnings and are afraid of the facts - or fear retribution by the government.

What retribution you might ask? None - because there is none the government in fact may take.

But, the myths, and as long as all Americans refuse to get the facts concerning the Constitution and taxation, will continue to have a strangle hold on those of us who do know our rights. And it is not just government but businesses of all sizes which support beliefs, however erroneous, in the myths.

Wal-Mart is depriving me of my constitutional rights, ignoring and/or misinterpreting the laws, and essentially stealing my money and giving it to a system I haven’t any desire nor requirement to contribute to. The corporation cares little about the facts, only that it is able to exercise power over me and the money I earn as indicated by 'Tiffany’s attitude': "We will withhold regardless of no W-4 (I refused to sign one prior to beginning work at Store 109, Cameron, Mo.) and no matter what Publication 515 states."

It mistakenly believes it must withhold earnings from employees, that it is required to. Nothing could be further from the truth but is the truth important? Not really. It gets its billions in profits and that is all that matters - the bottom line. One employee trying to right what is wrong by demanding the laws as written be observed and followed is insignificant.

Thus, unless thousands - millions - of employees, demand their constitutional rights regardless of the size of the business they work for, we will all remain slaves to falsehoods with our earnings systematically stolen by ignorant-of-the-law socialists.

And, in essence, our constitutional rights will remain as they are - nothing but myth.
