EXTRACTED FROM THE ORIGINAL COURT RECORDS OF AUGUSTA COUNTY 1745-1800
"In the year 1745, all that portion of the Colony of Virginia which lay west of the Blue Ridge
Mountains was erected into a County which was named Augusta. In December of that year, the
County Court was organized and held its first sitting. Prior to that time it had become the refuge and
abiding place of a strong body of Scotch-Irish immigrants. The bounds of the new County were
limited on the north by Fairfax's Northern Neck Grant and the boundaries of Maryland and
Pennsylvania to the westward of Fairfax; on the east by the Blue Ridge mountains; on the south by
the Caroline line. On the west its territory embraced all the soil held by the British without limit of
extent. For about twelve years the County Court of Augusta was the only Court and repository of
records within that district. From the end of that period, at frequent intervals, its jurisdiction was
restricted by the erection of other Counties as the demands of the settlers required. Its original
constitution embraced all Virginia west of the Blue Ridge (with the exception of the Northern Neck
Grant, whose southern boundary was in the present County of Shenandoah, and western, through
the Counties of Hardy, Hampshire, and northward to the Potomac); the whole of the present state
of West Virginia; a portion of the present Western Pennsylvania, including Pittsburgh, which was, at
times, the seat of the County Court; and the lands on the waters of the Ohio and Mississippi Rivers. "

 22d August, 1786. Defendants returned no inhabitants, 27th May, 1788. Richard Madison was
 son of John Madison. John Madison's will is in Botetourt. Pricilla married William Miller, Agatha
 Madison answers from Botetourt County. Thomas was also son of John, who died first part of
 1784. John's children, Margaret, Lucy and George, were living with him at the time of his death.
 John had sons. James, Gabriel. John was clerk of Augusta and resigned only upon the express
 condition that Richard should be appointed and this appointment was considered as an
 advancement to Richard by his father, John. Pricilla was daughter of William Bowyer. Thomas
 Madison's answer sworn to in Washington County, 16th September, 1788. Robert Rennick's
 deposition in Botetourt, 1790. Hugh Crockett's deposition in Montgomery County, 14th

AUGUSTA COUNTY COURT RECORDS. ORDER BOOK No. XXIV. page 503 Samuel Gray vs. Thomas Rowland, administrator of Robert Rowland.-- Superior Court of Law at Staunton. James Breckenridge deposes, 7th September, 1811, in Botetourt County, before Mathew Harvey, William Anderson: That shortly after the death of Robert, Thomas informed deponent that he had lost a considerable quantity of gunpowder, perhaps about five hundred weight, which he said belonged to Robert's estate, and had in his lifetime been made and packed perhaps for the plaintiff, to discharge a debt due to him which was payable in that article; that he apprehended it had been stolen by negroes in the neighborhood and desired this deponent to collect at the Court House such as he suspected for the purpose of examining them, which was done immediately. This happened shortly after the insurrection among the negroes in the neighborhood of Richmond was discovered. Deponent had no reason to believe that any quantity of gunpowder was stolen. Botetourt County records prove that defendant was convicted of slandering Paxton. John Smelzer was convicted in Sweet Springs District Court of slandering Joseph Ghent. Joseph Ghent is known to deponent since Joseph's infancy and is entitled to credit. On defendant's complaint many negroes were brought to the Court House and regularly examined, but nothing transpired to excite in deponent's understanding the least suspicion of their guilt.

CIRCUIT COURT RECORDS, SECTION "I." JUDGMENTS. page 29 Fletcher vs. Kelso--Eleanor Fletcher, heiress of Rev. John Hindman, conveyed Hindman's land to Fletcher. Deed was executed long potesior to death of her husband. John Fletcher, when she was femme sole. She was sister of whole blood of John Hindman. Original deeds from Beverlev to Hindman recorded in General Court, 17th April, 1745. Depositions by Margaret McCutchen, Jean Martin and Agness Harvey as to relationship between John Hindman and Eleanor Fletcher. Original deed Elcanor Fletcher to son, Job Fletcher, 1790, recorded Rockbridge. James Elliott says his father, William Elliott, is 93 years old, 12th July, 1792.

CIRCUIT COURT RECORDS, SECTION "I." JUDGMENTS. page 73 James Brynsides vs. Thomas Madison's Exrs.--O. S. 33; N. S. 11--Injunction granted 31st October, 1803. Richard Madison died 23d February, 1785, seized of land in Greenbrier, now Monroe. 750 acres by survey, 1751, and two days before his death he expressed his will that his wife, Priscilla, should have his whole estate, and this nuncupative will was proved in Augusta. He left no issue, and his eldest brother, Thomas, became his heir at law, who wrote to William Bowyer, father of Priscilla, renouncing the estate in her favor. John Milier married Priscilla. Thomas is dead and these are defendants (representatives) viz: Henry Bowyer and Agatha, John H. Madison, Peggy Madison, Thomas Madison, Patrick H. Madison. Major Mathew Harvey deposes in Botetourt, 15th February, 1805, that he has lived near Thomas Madison's place, "The Stone House," since 1784. Thomas moved to the Salt Works in Washington County, where he was living in October, 1787. He returned to live at the Stone House in the fall of 1788 or 1789. He rented the Stone House place to the late William Watts.
CIRCUIT COURT RECORDS, SECTION "I." JUDGMENTS. page 123 Robert Harvey and Martha, his wife et als., vs. John Bowyer--O. S. 140; N. S. 48. Orators Robert and Martha are children of Magdalen Bowyer of Rockbridge, wife of John. Complainants are, viz: Robert Harvey and Martha; David McGavock and Elizabeth; James McDowell of Rockbridge; James McDowell, son of John, said John next friend to his infant children, Polly, Samuel, William, Sarah and John; George Moffett and Sarah, his wife, representatives of Magdalen Bowyer, deceased. Samuel McDowell of Jessamine County, Ky., deposes 26th July, 1808: Was son of Magdalen; was Dr. McDowell; moved to Kentucky with his family in 1783. Andrew Reed was Samuel's son-in-law. Martha Harvey was only daughter of Benj. Borden, her sister Hanna having died infant and intestate. Elizabeth McDowell was widow of James McDowell (deceased intestate), son of Magdalen. Martha had been the wife of Benj. Hawkin's, deceased. Benj. Borden, Jr., died April, 1753. Magdalen Bowyer and Mary Greenlee were sisters-in-law. John McClung deposes 7th August, 1809, he was acquainted with Gen. John Bowyer on his arrival in this country, which was about fifty-five years ago. John came as a school teacher, which he followed only a few months, when he married Mrs. Magdalen Borden. Samuel McDowell's wife was sister of deponent. William Patton deposes (same time as above) that in fall coming it will be about 55 years since Genl. John Bowyer came first to this part of the country. Deponent was about 13 years old. Bowyer opened a school which William attended, and in a few weeks Bowyer and Magdalen were married. Bowyer had of property only a horse and saddle and the usual clothes which young men in his station had.
CIRCUIT COURT RECORDS, SECTION "I." JUDGMENTS. page 165 Scott vs. Baltzell--O. S. 206; N. S. 73--Oratrix is Nancy Scott, widow of administratrix of Wm. Scott, who sold to Jacob Baltzel a tract near Middlebrook in 1805. Wm. died intestate, leaving children and heirs, viz: James Harvey and John Newton Scott, infants. Jacob is also dead, leaving widow Ann, who has married Alexander Drumgold, and children, viz: Peggy, Nancy, Elizabeth and Samuel, all infants. Power of attorney by Nancy and Elizabeth Baltzell of Frederick County, Maryland, heirs of William, 1818.
CIRCUIT COURT RECORDS, SECTION "I." JUDGMENTS. page 186 Harvey vs. Lewis--O. S. 242; N. S. 85--Will of Andrew Lewis of Botetourt. Wife; sons, John, Samuel, Thomas, Andrew, William; daughter, Ann; grandsons, Andrew, Samuel and Charles, sons of John Lewis; brothers, Thomas and William; sister, Margaret. Dated 28th January, 1780. Recorded 14th February, 1782. Andrew's son John and daughter Anne died in lifetime of Andrew. This is a suit to construe Andrew's will.
CIRCUIT COURT RECORDS, SECTION "I." JUDGMENTS. page 198 Woods vs. Tapscott--O. S. 261; N. S. 92--Bill, 1817. On 16th September, 1782. William Crow received a warrant for 5,401 acres, of which he located 200 acres in Botetourt. He assigned to Doctor John Wood, who made an entry on 30th September, 1788. John died, leaving John Fourose and James Stanhope Wood his only children and heirs. His widow married James Tapscott. James has died, leaving a widow (mother of John T. and James S. and since dead) and children, viz: Robert, Albion. Warner, Baker, James, Caroline, Newton, Chichester and Louisa (married to Baker White). James, Jr., is dead, leaving children, viz: Jurita, Elizabeth, James Harvey, Priscilla, Mary. Margaret and Warner, Tapscott. The 70 acres involved line on Looney's Creek. Spa. to Northumberland County, 29th March, 1817, for Warner L. Tapscott.
CIRCUIT COURT RECORDS, SECTION "I." JUDGMENTS. page 240 Hull vs. Lance--O. S. 328; N. S. 118--Bill, 22d November, 1818, by Henry, Peter, Susannah (wife of Thos. Kinkead), Barbara (wife of John Sitlington), Adam, Jacob, William Hull, heirs and devisees of Peter Hull of Pendleton, who on 3d June, 1788, bought land of George Lance which had been devised to him by his father, Bernard Lance, in Crabapple Bottom in Pendleton. Mary, the mother of George, had some interest in this land which adjoined Joseph Lance; 230 acres now occupied by the widow of Barnet. George Lance died February, 1818, testate. Sons, Jonas and Benj. Peter Hull died 1817, testate. Barnhard Lance's (of Augusta) will dated 5th March, 1786. Wife, Mary; son, George, infant; son, Joseph; son, Conrad; daughter, Elizabeth; daughter, Mary; devisee, Martin Lee; devisee, Conrad Buck; daughters, Margaret, Amy, Christina. Recorded in Augusta, 20th June, 1786. Susannah Lantz is mother of Jonas and Benj. Lantz. Deed, 4th October, 1790, by George Lance of Fayette County to Peter Hull of Pendleton County, 230 acres part of two tracts, viz: 400 acres and 390 acres, both granted to Bernard Lance, 10th April, 1781, in Pendleton on Crab Bottom. Recorded in Pendleton, 4th October, 1790. Will of Joseph Lance of Pendleton County dated 14th February, 1817. Wife, Susannah; sons, Jonas and Benj., Joseph; daughters, Susanna, Barbara, Mary, Catherine, Christina. Recorded in Pendleton, 2d June, 1818. Will of Peter Hull of Pendleton County. Bill in February, 1788, by Robert Moore Riddick and Elizabeth, his wife, vs. James Minor, Garland Carr and Nathaniel Anderson, executors of Samuel Carr, deceased, and Samuel Carr, infant by Overton Carr, his guardian. Elizabeth was widow of Samuel Carr, who died 177--, testate, devising land to his wife Elizabeth and his nephew Samuel Carr, son of brother Dabney Carr. Will of Samuel Carr, dated 6th March, 1776. Proved in Louisa, 13th October, 1777. Wife; nephew, Saml. Carr, son of brother Dabney Carr; brothers and sisters (no date and no certificate of record). The estate was settled in Louisa in 1777. In 1804, Elizabeth died. Robert Moore Riddick died 1805. Copy of settlement of accounts in Louisa: 1778, paid John Poindexter for schooling; 1778, paid Dr. Honeyman. Bill by John Carr, executor of Thomas Carr, deceased, filed 9th July, 1810. In 1773 or 1774, Samuel Carr of Albemarle bought land in Albemarle from John Harvie and executed bonds with Richard Harvie and Thomas Carr as sureties. Samuel, Richard and Thomas have all died. Samuel died, testate. Will dated 6th March, 1776. James Minor, executor of Samuel, is dead.
