The humble petition of John Cowley of Crammag in Lezayre.

Sheweth: That your petitioner's father John Cowley Senior of

Crammag aforesaid lately deceased. Sometime previous to his decease made

his will and appointed your petitioner sole and whole executor of his

said will.

That the goods and effects of the deceadent requires the most

immediate care which care your petitioner is well advised he can not legally

proceed to - until the said will is perfected in law.

Your petitioner therefore humbly pray your Reverences would be

pleased to order this cause to come on to be heard before your Reverences

with all convenient speed. That the said will may be proved and

perfected in law. And your petitioner sworn in form of law as executor of the

said will to proceed to the care and disposition of the said deceadents

personal estate And your petitioner shall pray.

Ordered that the within written petition do come to be heard at a

Court to beholden at the Parish of Bride on Friday the 11th day of May

instant whereof all parties or persons to have due notice. Wm Clucas

In the name of God Amen. The last will and testament of John

Cowley of Crammag in the parish of Lezayre being of sound mind and memory

at the making hereof. Hoping through the merits of his saviour Jesus

Christ, to have remission of his sins.

First - He committed his soul to God and body to Christian burial.

Item - He left and bequeathed unto his seven children vizt Three

sons and four daughters namely John, Wm and Philip Cowley, Catherine, Ann,

Alice, and Jane Cowley an English ---each. He left and bequeathed

unto his two daughters Alice and Jane Cowley the one half and moiety of

Close B Callow equally between them. He left and bequeathed unto

his foresaid daughter Jane Cowley twenty shillings. And in case my

said son John Cowley shall pay unto his said two daughters Alice and Jane

Cowley the sum of Thirty one pounds as before specified that then

and in that case he the said John Cowley is to have that parcel of land

called Close E Callow as before bequeathed in case he his said son John

Cowley shall pay the foresaid sum within the term and space of three

years after his decease. He left an bequeathed unto his son Wm Cowley

fifteen pounds together with an day moth of the hay or meadow land in the

south west side and comer of Rush Close as the same is already marked

and in case his aforesaid son John Cowley shall pay his brother the

before mentioned fifteen pounds within the space of three years that

then and in that case he the said John Cowley is wholly to enjoy the first

day moth. He left and bequeathed unto his son Philip Cowley all the

sheep belonging unto him in Glandish Baon and in Gland no Yhoan. He

left also to his son Philip all his shapened and unshapened clothes vizt

woolen and linnen cloths. He left and bequeathed to his loving wife Alice

Cowley the bed, bed cloathes and bed stead whereon she now lay in case she

shall live after me and in case she my said wife shall die before me

that then and in that case this article mentioned in this will is to be

null and void and of none effect and in case the said John Cowley the testator

doth at my time hereof give any settlement or dowry to my one of my

aforesaid children that then and in that case he him or she is to be

excluded of the legacy left them in this his last will and testament. He left and

bequeathed that his executor hereafter is not to sue or prosecute

any or either of his brothers and sisters my goods given them by the

testator and his wife Alice. He left and bequeathed unto his eldest son

and heir Rush Close and lastly he nominated constituted ordered and

appointed his said son John Cowley sole and whole of all the rest of his

worldly goods and chattels of what nature or denomination soever.

At a Court holden in the parish of KK bride 11 May 1798.

The executor is sworn in court in form of Law and hath given

pledges for payments of goods and legacies namely the witnesses of the will.

I Philip Cowley do hereby acknowledge to have received the sheep

bequeathed me by the last will and testament of my father John

Cowley as also the shapen and unshapen clothes linnen and woolen and do

hereby acquit release exonerate and discharge the executor of the last

will and testament of my said father of all claims and demands for or on

Know all men by these presents that I Alice Cow]ey otherwise

Quayle of Crammag in the parish of KK Christ Lezayre and relict and widow

of John Cowley late of Crammag now deceased for and in consideration of

the sum of five shillings to me in hand now paid at by and from the

hands of my son and heir John Cowley of said Crammag as also for and in

consideration of the natural affection and peculiar regard which

I have and do bear towards my said son. Have given granted confirmed

estated and settled and by these present to give grant confirm estate and

settle unto and upon my said son John all and every the whole of my

estate of lands called Crammag at the east and west Rushy Closes and Close F

Callow situated in Lezayre aforesaid To have and to hold unto the

said John Cowley the said premises coming from the 12th of November

ensuing my decease with all and every title way, waters, and

watercourses, easements, buildings, edifices, gardens, stack

yards, and appurtenances to the same belonging for ever aforesaid. He

the said grantee yielding and paying the annual chief rent the premises

with all boons suits and services annually incumbent on at the times and

seasons usually accustomed. And I the said Alice Cowley do hereby further

settle upon my said son John all and every my goods chattels

credits and effects whatever immediately upon the said 12th of November next

after my decease. And I the said John Cowley do hereby covenant and

agree by and with the said Alice Cowley my mother that I the said John

Cowley my heirs executors administrators and assigns shall well and

truly pay the said Alice Cowley just and lawful debts after her decease

and to be at the expense of seeing her decently buried. And whereas I the

said Alice Cowley have previous to the execution hereof executed a

Deed of Gift in favor of my son's William arid Phillip Cowley and

daughters Alice and Jane Cowley wherein certain sums of money are settled upon

them part of which is to be paid upon demand and the remainder parts

thereof after my decease. It is hereby to be understood that whatever part

thereof is mentioned in the said Deed of Gift payable after her

decease is to be understood as part of the lawful debts of me the said

Alice Cowley and to be fully and truly paid by the said John Cowley his

heirs executors administrators and assigns the proper objects named in

the said Deed of Gift as this sums becomes payable by virtue of the

said Deed of Gift provided always that said granter is to possess and

enjoy present personal estate and to reap profits and issues thereof

during her natural life after such sums as are now payable by the said Deed

of Gift or Settlement are discharged out of the same which profits and

issues are to be considered as her own real property in all respects

whatever. And whereas those parts or parcels mentioned in this Deed called

Crammag and the East Rushy Close have been previously settled as

inheritance the same is to be possessed by said grantee according

to their previous manner of being possessed by virtue of a Deed of

Contract between the said deceadent John Cowley and Alice Cowley the

granter hereof but the other parcels herein mentioned called West Rushy

Close and Close F Callow to be possessed upon the 12th November next

ensuing the said Alice Cowley's decease as aforesaid. And for the faithful

performance of al] and singular the before written Deed of

Settlement. I the said Alice Cowley and John Cowley do bind and oblige

ourselves our heirs executors administrators and assigns in the penalty of One

thousand pounds sterling as witness our subscriptions this 30th

This is declared to be the last will and testament of John Cowley

of Crammag in the parish of Lezayre, being of sound mind and memory

at the making hereof.

First - I commit my soul to God and my body to a Christian burial.

Secondly - I leave to my sons, namely John, Thomas, William, and

Philip one pound each as legacy.

Thirdly - I leave to my daughters Jane (widow of John Cowley

deceased) and Ann, wife of Thomas Kelly, one pound each as legacy.

Fourthly - I leave to my son Robert the sum of two hundred pounds

which I have lent him and secured on the estate of Cleanagh in the

parish of Lezayre as legacy.

Lastly I nominated, constitute and appoint my son John whole and

sole executor of this my will and I leave to him all the residue and

remainder of my personal property of what kind or nature soever.

At Kirk Michael 13 August 1850 - Between John Cowley, petitioner and

Jane Cowley, widow, defendant. In Consistory Court of Isle of Man

exhibited to Thomas Cowley, John Corlen and John Quayle,

witnesses, produced sworn and examined on the part of the petitioner and

referred to in their depositions taken this day before me, Joseph Brown.

Depositions of witnesses were taken - Thomas Cowley of

Ballaskella in the parish of Lezayre yeoman testified he had looked over the

will and that John Cowley duly signed and executed same in the presence of

the witnesses and that John Cowley was of sound and disposing memory

and understanding.

John Corlett of the Kella in the parish of Lezayre testified the

same as Thomas Cowley. On cross examination he said he had never seen the

decedent but when he was not of a particularly strong and sound

state of mind and he was a man of sound discriminating judgement.

John Quayle of the Craigmoar in the parish of Lezayre testified

the same as Thomas Cowley and John Corlett.

It had been suggested to John Cowley, after the death of one of

the witnesses and another had gone to Australia, that he execute a

new will in presence of two or three other witnesses, and the defendant

said "No, his mind was not changed in any way and he saw no reason for

altering his will". Decedent looked at will on said occasion and said his

eyes were failing him and handed said will to John Corlett, the

witness, to read it, and he read every word of said will to decedent. He

declared the decedent was fit on the day he executed the ratification and

confirmation of said will.

At a Consistorial Court holden at Kirk Michael on the 28th day of

November 1850: lii the pursuance of the Judgement of this Court,

dated the 31st day of October last, John Cowley, the executor of the

last will and testament of John Cowley, late of Crammag, in the parish of

Lezayre, deceased, is sworn well and truly to fulfill and execute the said

will according to Law, to pay all just debts, legacies and funeral

expenses of said testator so far forth as the goods and effects will extend

and the law bind him, to return unto the Episcopal Registry a full, true,

and perfect inventory of said goods, and effects with an accurate

account of his administration thereof, and to these ends he hath given

pledges, namely William Quayle and Thomas Cowley, who have executed a bond

to that effect bearing equal date herewith.

21 January 1854. Jane Cowley claims 100 pounds sterling with

interest. Philip Cowley1 a legatee, named in the foregoing will of John

Cowley, deceased, personally appeared at the Episcopal Registry and

acknowledged that he had received and been paid the legacy of one

pound bequeathed him by said will and he the said Philip Cowley hereby

acquitted and discharge the executor John Cowley his heirs and

executors of the said Legacy and of every part thereof. Dated 23

Oct 1851.

John Cowley of Crammag, Lezayre, Episcoal Will 1850 #50 that on

the 23rd day of July 1850 John Cowley of Crammag, your petitioner's

father departed this life having first duly made and published his last

will and testament and thereof appointed your petitioner executor. That it

is expedient that the said will should be received and probate

granted thereon and your petitioner sworn executor thereof.

At an Ecclesiastical Court holden in Ramsey 3 August 1850.

Upon hearing the petition after due notice to all the parties and

Jane Cowley, widow, having opposed the proof of the will of John

Cowley, deceased, on motion of her advocate (The other parties having

declined any opposition) it is ordered that the evidence of such witnesses

as may be required be taken before his Rev. Roger.

At a Consistorial Court held in Kirk Michael 31 Oct 1850, John

Cowley will was proved and granted executorship to John Cowley and the

court ordered that the defendant Jane Cowley be ordered to pay the cost

of the suit.
