EPISCOPAL WILL Lezayre 1880 #175 FHL Film #0106491: This is the last will and testament of me John James Quayle of Ballaskella in the parish of Lezayre being of sound mind memory and understanding at the making hereof. I leave and devise to John Cowley of Crammag and Edward Henry Quayle of Ballaskella as executors in trust of this my will all and singular that and those lands and premises called and known by the name of Ballaskella situate in the parish of Lezayre together with all other lands and premises whether quarterland or intack situate in the said parish of Lezayre or elsewhere including and comprising herein the whole of the real estate to me belonging or to which I may be in any way entitled at the time of my decease to have and to hold the said real estate with all right and privileges thereto belonging or in anywise appertaining unto the said John Cowley and Edward Henry Quayle and the survivor of them and their assigns and the heirs and assigns of such survivor. I also leave and devise to them my said executors the whole of my personal estate of every kind and description wheresoever the same may be situate or discovered subject however to the terms conditions and legacies hereinafter set forth and contained namely that my said executors shall in the first place pay and discharge all my just debts funeral and testatmentary expenses and invest the residue of my personal estate on such tangible security as they may select thence forward pay over to my wife Ann Quayle the whole of the net rents issues and profits of my real and personal estates as aforesaid until my youngest surviving child shall have attained the age of twenty one years provided she remains my widow but in the event of her intermarriage with any other man then all right to her under this my will shall imrnediately ceases and determine and in that case and in case my said wife should during the minority of my children or any of them by reason on incapacity or otherwise refuse or neglect properly to expend the returns of my estates as aforesaid (or so much thereof as might to be expended) upon the maintenance education and due advancement in life of my children then it is my wish and I do direct my executors to take her place in the discharge of said duty towards my children. I also authorize and empower my said executors to expend when necessary a portion of the proceeds of my real estate for the purpose of necessary repairs to houses and fences with further power to charge and incumber the said real estate with such sum or sums of money as may at any time be required to pay off and discharge any encumberance affecting such real estate at the time of my decease and with further power should it be absolutely necessary to do so to sell and for full market value the whole or any portion of my said real estate and good and valid titles to sign and deliver for the same provided always that in the event of such sale taking place that the net balance arising therefrom shall be invested at interest and the proceeds yearly devoted to the same purpose as the net rents could have been devoted to as hereinbefore set forth and the principal sum of such surplus handed over to my heir, at the proper time, as if the same had been unrealized real estate. And at and upon my youngest surviving child attaining the age of twenty one years. I direct my said executor to convey the whole of my real estate or its representative value as aforesaid to my eldest son William Cowley Quayle as a customary estate of inheritance to him his heirs and assigns forever and in case of his decease before the said time without lawful issue him surviving them to such next brother or sister of his surviving or issue of any of them lawfully begotten as shall be then my heir or heiress at law. I leave and bequeath to my daughters Elizabeth Emily, Julia Frances, and Eleanor Theresa the sum of one pounds sterling each as legacy to be paid to them on attaining the age of twenty one years respectively. I leave and bequeath to my sons John James and Robert Thomas the sum of thirty pounds each to be expended by my executors for their benefit in giving them education and trades. If either of my said children died without having received his or her legacy or any part thereof leaving lawful issue her or him surviving then such issue to have the parents legacy or such part thereof as may have remained unpaid at the time of the parents death but in case of the decease of any ofmy sons departing this life aforesaid without leaving lawful issue then his legacy to be divided equally to arid amongst all his surviving sisters and brother the eldest surviving son being excluded and in like manner in the event of the decease of any of my daughters as aforesaid, and in the event of the decease of all my sons and either of my daughters succeeding as aforaesaid as my heiress at law then and in such case the said daughter so succeeding shall pay to each surviving sister the sum of twenty five pounds sterling after payment of the legacies aforesaid the proceeds of the balance of personal estate to be handed over to my widow yearly and upon her decease or future marriage the said surplus to be equally divided to and amongst my surviving daughters share and share alike. I do also further direct that my executors shall be at liberty and they are hereby empowered to pay and discharge all debts and demands against my estate without claims and orders provided always that they my said executors are satisfied that such demands are just and correct, and further I direct that my funeral shall be conducted without pomp and display and without the needless expense of hatbands. I do further direct that in the event of my personal estate proving insufficient to discharge my liabilities and the legacies hereinbefore mentioned that then and in such case the said legacies shall be discharged out of my real estate and I do hereby make and constitute such legacies a lien and charge therein. I do hereby nominate and appoint the said John Cowley and Edward Henry Quayle executors in trust of this my will hereby revoking all former wills by me heretofore made declaring this to be my last will and testament. Robert Cowley Ann Quayle I the foregoing John James Quayle do make and publish the following as a codicil to my will namely should my eldest son William C. Quayle desire it, I do hereby authorize my executors to advance him a sufficient sum of money to provide him with suitable education and proper outfit to enable him to emigrate and to make such sum with the interest to arise thereon a lien and charge upon my Real Estate. Before executing the foregoing Codicil I do hereby further declare that my will is that in the event of another child being born of my wife after my decease that my executors aforesaid shall make due provision out of my estate for the expenses attending the birth of such child and its future maintenance education and advancement in life so as to be made equal to the other children herein before provided for.
