October Court 1816

In the name of God amen, I John Henslee of the county of Caswell and the state of NC being advanced in years and feeling myself in a declining state of health and knowing that it is appointed for man to die, and being desirous to set my temporal affairs in order therefore do constitute and ordain this my last will and testament in manner and form following.

That is to say -

First I give and bequeath my land and plantation whereupon I now live containing by estimation one hundred and seventy three acres to be equally divided between four of my sons and one of my daughters, that is to say my son Richard, my son William, my son John, my son Benjamin and my daughter Sarah - to them and their heirs and assigns forever.

I also further give to my son John one feather bed and furniture bedstead about it being a bed that is commonly called his. I also further give to my daughter Sarah one sorrel mare known by the name Medley, 1 feather bed and furniture bedstead about it being a bed that is commonly called hers, one womans hunting saddle, one cow and calf, and two ewes and lambs.

And, I have heretofore given to two of my sons (to Wit) Macksfield and Thomas what I suppose to be ratiable part of my estate. In addition, I thereto give my son Macksfield all my wearing apparel.

I also give to my son Thomas my riding saddle and whereas by contract between me and my son John, the stock of cattle and flock of sheep that is now on my plantation with their increase belongs jointly to us both and whatever crop or profit may arise from the tillage of the plantation over and above a support for the family is likewise to be equitably divided between us both.

My will and desire is that the crop that may be begun at the time of my death may be finished and the family supported till the crop is finished as though I were living and the part of the aforesaid crop when finished and the part of the aforesaid stock of cattle and sheep that falls into my estate by an equal division between my son John and me with all the residue of my estate not heretofore named I leave to be sold by my executors hereafter to be appointed on a credit of twelve months to the highest bidder and out of the money arising from such sale, I will that my just debts be paid and the balance I leave to be equally divided between three of my daughters (to Wit) Eleanor Ray, Kiziah Ray and Betsy Pleasant.

Lastly, I nominate and appoint my friend Nathan Williams Esq. and my son Richard Henslee and my son-in-law Beauford Pleasant whole and sole executors of this my last will and testament to be performed revoking and disannulling all and every other will or wills by me heretofore made.
