The Last Will and Testament of Edward Burlison Know all men by these presents that I, Edward Burlison, of the County of Buncombe, and Commonwealth of North Carolina, being sick of body, but of perfect mind and memory, and calling to mind the mortality of the body and knowing that it is appointed for all men once to die, do make this and no other, my last will and testament viz: First, and personally, I give my soul into the hands of the Almighty God that gave it to me and my body to the earth from whence it came to be buried in a decent form after the directions of my Executors, hereinafter named, not doubting but I shall receive the same at the general resurrection by the same Almighty power and, as touching such worldly goods or estate, wherewith it hath pleased God to bless me with, give and disposed of in the means and form following viz: 2ndly, I give and bequeath unto my present and beloved wife, Polly Burlison and her heirs all of the Old McKissick tract of land from John Greenwoods land up to the tract of land that my son, Isaac Burlison lately lived on and also I give them one hundred dollars to be paid out of the balance of my property and all the household and kitchen furniture and one years provisions to be laid out by two disinterested men on the day of sale for her and all the family, and stock that remains with her. 3rdly, It is my will and desire that all the remainder of my real and personal estate be sold on a credit of twelve months and after paying all of my just debts out of the money, then the remainder to be equally divided between my first wife's children viz: Margaret Coats, Polly Dillingham, Isaac Burlison, Rebecca Carter, D. W. Burlison, Jane Williams, Jackson Burlison, Washington Burlison, Anderson Burlison and Elizabeth Burlison. 4thly, and I hereby ordain my worth friends and son-in-law, Gabriel G. Coats and Edward Carter, Executors of this my last will and testament. In Witness whereof, I the said Edward Burlison, have set my hand and seal, this the Sixteenth day of January, One thousand eight hundred and forty one. The State of North Carolina

By virtue of warrant entry taken from M. B. Patton, Entry Taker, on land in the county aforesaid No. 5125 Entries the 26th of November 1834. I have laid off & surveyed a tract of land for Isaac Burlison in the county aforesaid. On the south side of the North Fork of Big Ivy. Beginning at a dogwood on the North Bank of the creek on Ed(ward) Burlison's line & runs with his lines. South 20 east 33 poles from a dogwood, there with his other line south 80 west 140 poles to a stake, then south 10 east 85 poles to a stake, then north 80 east 180 poles to a stake then north 10 west 125 poles a stake on the North bank of the creek then down the meadow of this creek to the beginning. Containing 100 acres certified the first part of text 1836.

M. B. Patton, Entry Taker, of claims for land in the County of aforesaid to the surveyor of said County thusly required. As soon as may be to lay off and survey for Isaac Burlison 100 acres of land lying on the North Fork of Big Ivy beginning at the old McKissick line above. Entered November 26th, 1834.

And return the works of survey to the secretary's together with this warrant of observing of the acts of the General Assembley. In such case made and provided, given under my hand at office this 27th of February 1835.

Note:: This document concerns 100 acres that Ed. Burlison (Isaac's father) sold him in 1834. This land is mentioned in Edward's will, and had been sold back to him by Isaac before Isaac left for Georgia. (transcribed from original)
