John Twyman's Will

This is the will of my great-great-great-grandfather's will.  I have transcribed it exactly as it is.  Except for the fact that I captialized and made bold all the last names to make them easier to find.  Hope you find it interesting.

This is from th Barren Co. Will Book 3, pgs. 421-423

I John TWYMAN of the County of Barren & State of Kentucky being weak in body but of sound disposing mind & memory do make and publish this my last will & Testament revoking all other 1st I desire my body to be decently buried and all my Just debts to be paid  Item 2nd I give and bequeath to my beloced wife Margaret TWYMAN my negro woman Juda & two negro boys Jim or James and Jo all my household and Kitchen furniture and my red cow during her life  Item 3th I give and bequeath to my daughter Francis R. MUNDAY & her husband George W. MUNDAY one hundred & fifty acres of land on which they now live said land to be taken off the North East of tract of land on which they live at the price of five dollars per acres also my Negro Woman Henrietta & her children Rachel which negro they are to hae at the price of Eight hundred & fifty dollars said negroes are now in there possession.  Item 4th I give and bequeath to my daughter Mary H. JONES wife of Wm. S. JONES & the heirs of her body Seven hundred dollars that I have paid & will have to pay for her husband Wm S JONES and one hundred dollars which I have charged for the trouble & expence in boarding her and her children  I allso give and bequeath to my said daughter Mary and the heirs of her body my negro woman Vincy at the price of one hundred & fifty dollars and is now in her possession & is for the sole use & benefit of my said daughter & her children & not to be subject to the debts of her said husband in any event whatever.
Item 5th I give & bequeath to my son William F. TWYMAN my negro boy Moses which is now in his possession at the price of Six hundred dollars
Item 5 I will and desire all my lands except the 150 acres divided to George W. MUNDAY & wife together with all my personal property be sold upon such terms as my Executors may think proper and after the death of my beloced wife that all the property devised to her during her life and the increas thereof be sold and that all my children be made equal each one receiving one third of my Estate but it is my will that that portion of my Estate going to my Daughter Mary H. JONES is for her exclusive benefit & her children and is not to be subject to the debts of her husband Wm S JONES and I hereby appoint my executors herein after named as her trustees to receive & hold that part of my Estate in there hands and to use & manage it for the sole & separate use of my said daughter & her children during her life and at her death to be equally divided between her children
Item 7 I appoint my son William F. TWYMAN & my son in law George W. MUNDAY my Executors to this my will and the court is not to require security of them

The foregoing writing purporting to be the last will & Testament of John  TWYMAN decd was produced in Court and proven in due form of law by the Oaths of Thomas H. PENICK and Allen W. DURHAM two of the subscribing witnesses thereto Wherupon the same was ordered to be recorded as the true last will & Testament of sd John TWYMAN decd
