In the name of God, Amen, I John N. Romine of the Township of Pompton in the County of Bergen, State of New Jersey, being weak in body, but of sound mind and memory and understanding, for which blessing I most devoutly thank my God, do make and publish this my last will and testament in the manner and form following, that is to say, First, it is my will, and I do order that all my just debts and funeral expenses be duly paid and satisfied, as soon as conveniently can be after my decease.
Item, I give and devise unto my son, Nicholas I. Romine, all my lands, tenements, hereditaments and real estate whatsoever and wheresoever lying in the Township of Pompton and County of Bergen, and it is my will that the said Nicholas shall maintain his mother during her life.* (see note at end)
Item, I give an bequeath unto my beloved
wife Ellen Romine as much of my personal property as she shall deem
requisite for her own use and benefit, and the remainder of my personal
estate I do hereby order to be sold, and the money arising from the sale
of said personal estate I do order to be equally divided among my three
children, vis. Nicholas I. Romine, Abraham Romine, and
Mary Romine, the wife of Garrit Van
Cleve.
Item, I do hereby order my Executors herein after named to pay unto my son Nicholas I. Romine at six months after my decease the sum of Two Hundred and fifty dollars.
Item, I give and bequeath unto my son
Abraham Romine the sum of Four Hundred dollars, subject to the following
conditions - that is to say - the said four hundred dollars shall be at
the discretion of my Executors put to interest, and the interest thence
arising, I do order the said Executors to pay semiannually to the said
Abraham Romine, and
in case the interest of the said four
hundred dollars should not be sufficient to meet all absolutely necessary
and reasonable expenses, then it is my will, and I do hereby order my Executors
to appropriate as much of the principal as they shall consider just and
reasonable from time to time, and in case that the said Abraham Romine
should die,
then it is my will, and I do hereby order
by Executors to pay as much of the remainder of the said four hundred dollars
to the children of the said Abraham share and share alike as they shall
respectively come of age.
Item, I give and bequeath unto my daughter
Mary, the wife of Garrit Van Cleve, the sum of Five hundred dollars
subject to the following conditions, that is to say - the said five hundred
dollars shall at the discretion of my executors be put to interest, and
the interest thence arriving, I do order my executors to pay semiannually
to the said Mary, the wife of Garrit Van Cleve, and in case the said Mary
should become the widow of the said Garrit, and the interest of the said
five hundred dollars should be insufficient to meet all necessary and reasonable
expenses, then it is my will, and I do hereby order my Executors to appropriate
as much of the principal for the decent support of herself
and children as the said Executors shall
from time to time consider just and reasonable, during her widowhood, and
in case the said Mary should marry a second time, then it is my will that
she receive the interest only of the sum then at interest remaining - and
in case of the death of the said Mary, then it is my will, and I do hereby
order my executors to pay the balance in their hands to the children of
the said Garrit Van Cleve and Mary his wife, share and share alike as they
shall respectively come of age, and in case any of these children should
die under the age of twenty one years, then my will is that the
portion herein devised to such child or
children of the Garrit Van Cleve and Mary, his wife, shall be equally divided
between the remainder of said children. Lastly, I hereby appoint
my son Nicholas I. Romine and Nicholas Ackerman Executors of this
my last will and testament.
